I agree with you that the telephone pole should be removed. I have requested Mass. Electric re- move the pole. This will take 8 weeks. I would appreciate the Certificate of occupancy being based on the pole .removal and not the build- ing permit, so I do not lose my contractor and the winter construction season. Thanak you. As I mentioned to you during our telephone conversation, we cannot relocate this pole at the request of the Town of North Andover, since this construction is being done solely for the convenience of a private party. I must also advise you that the petitioning process through the town officials entails an approximate five-week wait. To this end, I would appreciate it if you would notify me of your decision as to whether you intend to proceed with the relocation. Thank you for your cooperation. In my opinion, he has not completely complied with the condition set prior to issuing a Building Permit and I am looking for further input or review by the Board in determining if the condition has been met to its satisfaction. - BHC:gb 1 A t t. 11Cj * James Mavrokos * 88-90, 88A -90A Pleasant St ** North Andover, MA 01845 * * * * TOWN OF NORTH ANDOVER MASSACHUSETTS BOARD OF APPEALS Petition #95-88 DECISION The Board of Appeals held a public hearing on October 13, 1987 on the application of James Mavrikos requesting a Special Permit from the requirements of Section 4, Paragraph 12 of the Zoning ByLaws so as to permit a fifth unit on the premises located at 88-90, 88A -90A Pleasant Street. The following members were present and voting: Frank Serio, Jr., Chairman, Alfred Frizelle, Vice-chairman, Augustine Nickerson, Clerk, Walter Soule and Louis Rissin. The hearing was advertised in the North Andover Citizen on September 24 and October 1, 1987 and all abutters were notified by regular mail. Upon a motion made by Mr. Frizelle and seconded by Mr. Rissin, the Board voted to GRANT the Special Permit with the following condition: 1. Ten(10) parking spaces parallel with the house must be provided, as shown on plans, existing apron removed and landscaped, and construction of parking spaces be completed prior to the issuing of a building permit or any other type of permit. The Board finds that the petitioner has satisfied the provisions of Section 10, Paragraph 10.3 of the Zoning ByLaws and the granting of the Special Permit will not derogate from the intent and purposes of the Zoning ByLaws nor will it ad- versely affect the neighborhood. RE: Anthony Conte, 11-13 Third St. James Mavorkos, 88-90 Pleasant St. In reply to the question of issuance of a building permit for Anthony Conte, the Board determined that the permit be issued as stated in the original decision. With regard to James Mavorkos, the Board determined that there is no pole shown on the plans presented to them and if a utility pole exists on the entrance to the main parking lot, then the plans have to be re- vised or the pole removed.
