The Board.of Appeals held a public hearing on Monday evening,
November 14, 1983 upon the application of Judith W.`Twombly.
The hearing was advertised in the North Andover Citizen on
October 27 and November 3, 1983 and all abutters were notified
by regular mail: The following members were present and voting:
Frank.Serio, Jr, -;.Chairman; Richard J. Trepanier, Esq., Clerk;
William J. -Sullivan; -and -Associate Members--Wal--ter F. Soule and
Raymo-nd.-A.-Vi-venzio.
The -pet i ti-on-er—seek-s-- a var-i ance--from-=the--provi s i ons -of -Section
7, Paragraph ---7. 3 an -d -Table =2 -to--per_mi-t rel ief.=-from=t-he--si de set-
back requirement:=to allow .the-_continued._ex-istence of a dwelling

the Zoni ng -By Law -on -premises --located- a-t--140-.Pres-cott Street.
The petitioner testified through counsel that the dwelling (unit)
was constructed in 1980 and when an "As Built" plan was required
the setback violation -.-was discove.red_. The -townhouse unit is set
back 17 feet= -where 25 -feet ---is required under .the Zoning By -Law.
Upon a motion --made -by Mr: Trepanier and -seconded by Mr -.-Soule;
the Board voted -four. to _one to grant thevariance -as requested.
The Board.finds that Section 10.4 of the Zoning By=Law has.been
satisfied. Specifically, the Board finds that due to the.loca-
tion-of the -townhouse _unit on=the--property-with-its slight devia-
tion- from ---.the .requi rements consti tutes a hardshi p to--the---pet-itione r:
