TOWN OF NORTH ANDOVER MASSACHUSETTS BOARD OF APPEALS * Messina Development * Petition #001-92 805 Winter Street North Andover, MA 01845 * DECISION * *************************** The Board of Appeals held a public hearing on January 14, 1992 upon the application of Robert Messina of Messina Development requesting a variance from the requirement of Section 7, Paragraph 7.3, Table 2 so as to permit relief from side yard setback to construct a single family dwelling OR Section 4.136, Paragraph 2-B, to construct a single family dwelling within the 100' buffer zone to a tributary in the watershed on the premises located at 9 Village Way. The following members were present and voting: Frank Serio, Jr. Chairman, Walter Soule, Clerk, Raymond Vivenzio, and Anna O'Connor. The hearing was advertised in December 31, 1991 and January notified by regular mail. the North Andover Citizen on 8, 1992 and all abutters were Upon a motion made by Mr. Vivenzio and seconded by Mrs. O'Connor the Board voted, unanimously, to GRANT the variance from Section 4.136, Paragraph 2-B to construct a single family dwelling within the 100' buffer zone to a tributary in the watershed as shown on plan dated 1-13-92. Specifically, the structure will be no closer than 70 feet to the wetlands. The Board finds that the granting of this variance will not adversely affect the neighborhood or derogate from the intent and purpose of the Zoning Bylaw. Dated this 24th day of January 1992. Huntress, DATE: January 14, 1992 To' d ` er RE: Messina - Lot 1, Village Way. 120 Main Street, 01845 (508) 682-6483 On January 9, 1992 the Planning Board opened the public hearing with regard to the above referenced lot. After review of all pertinent issues with regard to construction in the watershed protection district, the Planning Board voted unanimously to close the public hearing, take the matter under advisement and directed staff to draft a conditional approval for review at their next meeting on January 23, 1992. The conditions discussed at the meeting on 1/9/92 include the following: 1. All driveway and roof runoff be collected by interceptor drains to a leach pit located at least 100' from the edge of wetlands. 2. A detention and drainage easement be granted to the Town of North Andover. This easement should include all wetlands and drainage structures on the property, with a pedestrian access from the edge of Village Way. 3. Ground water elevations be determined to insure that the proposed leach pit is above existing ground water. 4. A locus be added to the plan. Should the applicant make the above modifications, I anticipate that the Board will act favorably upon this application on January 23, 1992. Mr. Robert Nicetta was present throughout the Planning Board public hearing on this matter and should be able to answer any questions you may have. Should you have any further concerns please feel free to contact my office. 4 rI JAN 4 4 092 BUILDING EVER; R- t,ii Received by Town Clerk: TOWN OF NORT11 ANDOVER, MASSACHUSETTS BOARD OF APPEALS Tri APPLICATION FOR RELIEF F1tOM THE REQUIREMENTS OF THE ZONING ORDINANCE , Applicant !N T -- ------ C S l.} _ fiu. 1. A structure was constructed within the 100 foot buffer zone without a permit from the North Andover Conservation Commission. The Enforcement Order mandated a filing with the Conservation Department no later than December 27, 2002. A fine in the amount of $100 per day continues to be levied from the date the violation was discovered. To date, no filing has been made with the Conservation Department. A filing must be submitted within thirty (30) days from this notice and I suggest you contact me as soon as possible to discuss the violation and mitigation methods. In addition, please be aware you are in violation of zoning and state building code regulations and must address these violations with the Building Department. It appears that our neighbor at number 9 Village Way has a business with 7 or 8 employees running out of his house. There is a constant flow of cars, delivery trucks and other vehicles on the street every day. He is also cutting down dozens of trees in the watershed area and constructing a large outbuilding on the property. He already has a storage shed on the property that is too close to the property line, but the neighbors have to date ignored it. We would like to request someone look into the possible illegal activities being carried out. This is a residential area and we purchased our homes with the confidence that we would enjoy the peace and quiet of a small, dead end street and that our children would not be endangered by traffic constantly coming and going on our small circle. Thank you for your help. VVI REcEIvE® RE,--1VED NOV 7 2002 K _ 402 BUILDING DEFT, SUILU-'G DEPT.
