The Board of Appeals held a public hearing on January 14, 1992
upon the application of Robert Messina of Messina Development
requesting a variance from the requirement of Section 7,
Paragraph 7.3, Table 2 so as to permit relief from side yard
setback to construct a single family dwelling OR Section 4.136,
Paragraph 2-B, to construct a single family dwelling within the
100' buffer zone to a tributary in the watershed on the premises
located at 9 Village Way. The following members were present and
voting: Frank Serio, Jr. Chairman, Walter Soule, Clerk, Raymond
Vivenzio, and Anna O'Connor.

Upon a motion made by Mr. Vivenzio and seconded by Mrs. O'Connor
the Board voted, unanimously, to GRANT the variance from Section
4.136, Paragraph 2-B to construct a single family dwelling within
the 100' buffer zone to a tributary in the watershed as shown on
plan dated 1-13-92. Specifically, the structure will be no closer
than 70 feet to the wetlands.
The Board finds that the granting of this variance will not
adversely affect the neighborhood or derogate from the intent and
purpose of the Zoning Bylaw.

On January 9, 1992 the Planning Board opened the public
hearing with regard to the above referenced lot. After review of
all pertinent issues with regard to construction in the watershed
protection district, the Planning Board voted unanimously to
close the public hearing, take the matter under advisement and
directed staff to draft a conditional approval for review at
their next meeting on January 23, 1992.
The conditions discussed at the meeting on 1/9/92 include
the following:
1. All driveway and roof runoff be collected by interceptor
drains to a leach pit located at least 100' from the edge of
wetlands.
2. A detention and drainage easement be granted to the Town of
North Andover. This easement should include all wetlands
and drainage structures on the property, with a pedestrian
access from the edge of Village Way.
3. Ground water elevations be determined to insure that the
proposed leach pit is above existing ground water.
4. A locus be added to the plan.
Should the applicant make the above modifications, I
anticipate that the Board will act favorably upon this
application on January 23, 1992.
Mr. Robert Nicetta was present throughout the Planning Board
public hearing on this matter and should be able to answer any

Please let this letter serve as a STOP WORK ORDER on the construction of an 18' x 20'
storage shed, which has commenced without the benefit of a building permit. Please be advised
your property is located in the Watershed Protection District and will require a special permit
from the Planning Board. The proposal will require a sign off from the town's planner and
conservation administrators before a building permit can be issued. Please be further advised that
upon further review of the plan submitted it appears that there may be issues on where it is being
constructed as accessory structures are not allowed to be placed beyond the front line of the
primary structure.

RE: ENFORCEMENT ORDER: Property at 9 Village Way
Violation of the Massachusetts Wetland Protection Act (MGL c.131 s.40) and the North
Andover Wetland Protection ByLaw (c.178 of the Code of North Andover).
Dear Mr. Schroeder:
During a routine inspection, instigated by the building permit filed on October 30, 2002,
conducted by the Conservation Department on November 12, 2002, my associate and I
observed the construction of a structure within the buffer zone of a bordering vegetated
wetland on your property. We met with you on the property to evaluate the violation and to
discuss state and local wetland protection regulations (Massachusetts Wetland Protection Act
(the "Act") M.G.L. c.130, s.40 and the North Andover Wetland Protection Bylaw (the "Bylaw")
Section 178). During our inspection, we observed that the structure had been constructed,
although not completed, within the 100 -foot buffer zone of a bordering vegetated wetland and
within the 50 -foot No- Construction zone of the North Andover Wetland Bylaw without an
Order of Conditions from this Department. In addition, yard waste (grass clippings) was
observed within the 25 foot No -Disturbance zone, which is not permissible under the local
bylaw. At the time of the inspection, you were instructed to cease from any additional
activities.
Specific wetland resource areas affected by the violations) include the following:
• 50 -Foot No Construction Zone (NACC Bylaw Section III.D.),
• 25 -Foot No Disturbance Zone (NACC Bylaw Section III.D.); and
• 100 -Foot Buffer Zone to a Bordering Vegetated Wetland NACC (MWPA Regulations
Section 310 CMR 10.55 and the North Andover Conservation Commission (NACC)
ORDER:
Acting as an Agent of the Commission under MGL C.40, S.21D and the Act (310 CMR 10.08(3)),
enclosed please find an Enforcement Order mandating the restoration and removal of all
unauthorized fill material, debris and structures located within Bordering Vegetated Wetland,
the 25 -Foot No -Disturbance Zone, and the 50 -Foot No -Construction Zone. This restoration
work shall be conducted in accordance with the conditions described below.
The property owner shall immediately take the following actions:

1. Wetland Field Delineation
The property owner shall have all wetland resource areas within 100 -feet of the
proposed work delineated by a qualified wetland biologist.
2. Wetland Restoration Report
A report shall be provided to the NACC in narrative form that includes a detailed
description of existing conditions, all unauthorized activities, and the proposed
restoration (25' No -Disturbance Zone and 50' No -Construction) including the sequence
Of work, resource area plantings, strategy, anticipated future construction and
landscaping activities, current and future sedimentation/erosion control measures and
site stabilization measures. The report shall address all impacts to the wetland resource
areas protected by the Act and Bylaw as well as the proposed mitigation measures in
detail.
3. Plans
Existutg Conditions Plan: The existing conditions plan shall include all information
required for a Notice of Intent application filed with the NACC. This pian shall include
the wetland alteration area, structures, facilities, storage area, etc., within 100 -feet of the
delineated wetlands, as well as the location of the 100 -foot buffer zone, 50 -foot No -
Construction Zone and 25 -foot No -Disturbance Zone. This plan will serve as the base
plan for the proposed wetland restoration plan described below.
4. Restoration Plan:
The restoration plan shall include all information required for a Notice of Intent
application filed with the NACC. The restoration plan shall show the proposed
mitigation measures including, at a minimum:
• The proposed planting and grading plan for the Bordering Vegetated Wetland and
25 -foot No -Disturbance.
• Proposed erosion and sedimentation control measures to be employed on-site.
• Any other mitigation measures deemed necessary to restore the wetland resource
areas and their associated buffer zones on the property.
5. Notice of Intent
A Notice of Intent filing application under the Massachusetts Wetland Protection Act
and North Andover Wetland Protection Bylaw.
The Notice of Intent application and Restoration Site Plan must be filed with the
Conservation Department no later than December 27, 2002.
The violations as documented herein are subject up to a $300 per day penalty' until such time
as the impacted resource areas have been mitigated. Each day or portion thereof during which
this violation continues shall constitute a separate offense. At this time this Department has
elected to levy a fine in the amount of $100 per day (from the date the violation was

identified) until the buffer zone has been restored in accordance with the approved plan by
the Conservation Department. However, we reserve the right to take additional action in the
future should this Enforcement Order not be complied with retroactive from the date we were
first made aware of the violations.
Failure to comply with this Order and the deadlines referenced herein will result in the issuance
of additional penalties. MGL C.131 5.40 and the North Andover Wetland Bylaw, C.178
authorizes the Conservation Commission to seek injunctive relief and civil penalties per day of
violation. In addition, a violation of the Massachusetts Wetland Protection Act and the North
Andover Wetland Bylaw constitutes a criminal act, which is subject to prosecution and the
imposition of criminal fines, also per day. This Enforcement Order shall become effective upon
receipt.
Attached is a list of consultants who can assist you with bringing the site to compliance.

Please be advised that the above stop work order has yet to be addressed as far as obtaining the
required permits for the construction of the shed on your property. Please be advised that the
Town of North Andover Zoning Bylaw Section 10 (10.13) Penalty for Violation states " Whoever
continues to violate the provisions of this bylaw after written notice from the Building Inspector
demanding an abatement of a zoning violation within a reasonable time, shall be subject to a fine
of three hundred dollars ($300). Each day that such violation continues shall be considered a
separate offense. (1986/15)"
Please be further advised that the MA State Building Code (780 CMR Section 118) also has
provisions for violations of the building code, which states in part " Whoever violates any
provision of 780 CMR, except any specialized code referenced herein, shall be punishable by a
fine of not more than $1000. or by imprisonment for not more than 1 year, or both for each
violation. Each day during which a violation exists shall constitute a separate offense. The
building official shall not begin criminal prosecution for such violations until the lapse of 30 days
after the issuance of the written notice of violation.
Using the numbers ($300 + $1000) per day and allowing for the 30 days after written notice
please be advised that the fine to date would be $70,200.

Please be aware the North Andover Conservation Commission issued an Enforcement

Dear Building Inspector,
I am writing to complain for several neighbors on Village Way. It appears that our
neighbor at number 9 Village Way has a business with 7 or 8 employees running out of
his house. There is a constant flow of cars, delivery trucks and other vehicles on the
street every day. He is also cutting down dozens of trees in the watershed area and
constructing a large outbuilding on the property. He already has a storage shed on the
property that is too close to the property line, but the neighbors have to date ignored it.
We would like to request someone look into the possible illegal activities being carried
out. This is a residential area and we purchased our homes with the confidence that we
would enjoy the peace and quiet of a small, dead end street and that our children would
not be endangered by traffic constantly coming and going on our small circle.
