McKay Interim Conservation Administrator April 3, 2004 Heritage Green Condominium Trust C/o Karen Sorkin 39 Farwood Avenue, #1 North Andover, MA 01845 Telephone (978) 688-9530 Fax (978) 688-9542 RE: ENFORCEMENT ORDER: Property at #88 and #90 Farwood Avenue Violation to the Massachusetts Wetland Protection Act (MGL C.131 S.40) and the North Andover Wetland Protection ByLaw (C.178 of the Code of North Andover). Dear Ms. Sorkin: On 3/17/04 the Conservation Department issued an Order of Conditions, DEP file #242-1234, to allow work activities to proceed on the reconstruction of the decks and stairways at the above referenced property. The approval was granted in conjunction with specific conditions so as to adequately protect the wetland resource area on site. Furthermore, several conditions were required to be met immediately upon the receipt of the Order and have not been executed. This department received the signed certified mail receipt from yourself some time ago indicating that the Order of Conditions had been received. However, to this date, no action has been executed to indicate compliance with the Order. A recent site inspection of the property also indicates non- compliance with the Order. Full compliance with the Order of Conditions must be executed immediately, specifically to conditions 38, 39, 42, 44 (proper installation of erosion controls as specified), 45, 46, 47, 48, 51, 52, 58, and 69. Aside from the violations pertaining to the Order of Conditions referenced above, additional work activities were observed to have occurred adjacent to building #50. An excavated open trench of 2-4 feet in depth and of approximately 50 feet in length was observed along the side of the building. Excavation was noted to have occurred within the 25' no -disturbance zone protected under the local Bylaw. This work was conducted within 100' of a wetland resource area without a permit from the Conservation Department and is in further violation of the Wetlands Protection Act and the local Wetlands Protection Bylaw. All activities pertaining to this site work must cease and desist immediately until a proper filing has been submitted and approved for the work. ORDER: Acting as an Agent of the Commission under MGL C.40, S.21D and the Act (310 CMR 10.08(3)), enclosed please find an Enforcement Order mandating immediate compliance with the Order of BOARD OF APPE ILS 688-954] BUILDING 688-9545 CONSERVATION 688-9530 HEALTH 688-9540 PL/ NINING 688-9535 2 Conditions under DEP file # 242-1234 and the submission of a permit fling for work activities adjacent to building #50 by no later than April 16, 2004. The violations as documented herein are subject to a $100 per day per violation penalty' until such time as the impacted resource areas have been mitigated. Each day or portion thereof during which this violation continues shall constitute a separate offense. At this time the Conservation Department has elected to levy a fine in the amount of $1,200. However, we reserve the right to take additional action in the future should this Enforcement Order not be complied with retroactive from the date we were first made aware of the violations. Failure to comply with this Order and the deadlines referenced herein will result in the issuance of additional penalties. MGL C.131 S.40 and the North Andover Wetland Bylaw, C.178 authorizes the Conservation Commission to seek injunctive relief and civil penalties per day of violation. In addition, a violation of the Massachusetts Wetland Protection Act and the North Andover Wetland Bylaw constitutes a criminal act, which is subject to prosecution and the imposition of criminal fines, also per day. Massachusetts General Laws chapter 152 requires all employers to provide workers' compensation for their employees. Pursuant to this statute, an employee is defined as "...every person in the service of another under any contract of hire, express or implied, oral or written." An employer is defined as "an individual, partnership, association, corporation or other, legal entity, or any two or more of the foregoing engaged in a joint enterprise, and including the legal representatives of a, deceased employer, or the receiver or trustee of an individual, partnership, association or other legal entity, employing employees. MGL chapter 152, §25C(6) also states that "every state or local licensing agency shall withhold the issuance or renewal of a license or permit to operate a business or to construct buildings in the commonwealth for any applicant who has not produced acceptable evidence of compliance with the insurance coverage required." Additionally, MGL chapter 152, §25C(7) states "Neither the commonwealth nor any of its political subdivisions shall enter into any contract for the performance of public work until acceptable evidence of compliance with the insurance requirements of this chapter have been presented to the contracting authority." These buildings were constructed in the mid -sixties and consist of multi -family condominium units of various configurations. Due to rather heavy vegetated cover, the South side of the buildings where the balconies are located are exposed to minimal direct sunlight and therefore they remain damp and wet for extended periods after moderate rains. The prolonged periods of moisture has caused areas of green moss to form on the ground, as one would expect, and on parts of the building. The balconies on these buildings not only serve as recreational seating areas for the occupants, but also serve as a second means of egress in the event that an emergency arose. The buildings are not equipped with a sprinkler system and if the front entry hall and stairs were blocked, the balconies would then be used to egress the units. Two means of egress are required per the Massachusetts State Building Code. The original balconies which were constructed in a cantilever configuration, that being simply extending the floor joists beyond the face of the building fagade, and subsequently connected them to the ground by a spiral stair, which is no longer permitted by the Massachusetts State Building Code. Over the years as the New England climate battered these structures, the wooden balconies deteriorated to a point where the management company that manages the complex instructed a contractor to go to the North Andover Building Department and obtain a building permit to replace the balconies. He was told that the project was subject to Construction Control under the Massachusetts State Building Code, y Section 116.0 and as such, an Engineer would have to be retained to design new balconies in conformance with the latest Building Code Provision. The new balconies would be designed as a second Means of Egress with a design floor live load of 100#/ft2. The original spiral stairs are no longer permitted by Code and the new stairs must be constructed and protected with a roof. Our office was retained in mid-July 2003 to design the replacement balconies. Upon arriving on site, I carefully observed the structural condition of the original balconies and instructed the Property Manager, to install caution tape across the sliding glass doors as well as notifying each tenant not to use the balconies. The area was densely vegetated, as the enclosed photographs show, and the existence of a statutory wetland on the abutting parcel was not obvious. I proceeded with the work by as -building the existing balconies without realizing that there was a jurisdictional wetland on the abutting parcel. The new balconies require columns to partially support these structures and subsequently require stairways to egress inhabitants should the need arise. The columns are supported by concrete filled sonotubes and it is two of these stairway supporting sonotubes that fall inside the 50 Foot No -Build Zone. The affected sonotubes are shown on a plan prepared by the Neve -Morin Group, Inc., dated January 14, 2004 which is part of a Notice of Intent filed for this project. The decks and stairways for Building #90 are well along and work on Building #88 has not begun with the exception of removal of existing balconies and partial b excavation for foundations. As of this date, the site is frozen. The Contractor had previously installed haybales and siltation fence between the work area and chain link fence which is close to the South property line of the parcel. K A M/ N S K I North Andover Conservation Commission January 21, 2004. Page 3. The access stairways, after extensive study, were positioned as shown on our design drawings. Aesthetics dictated their style and location. The question has been asked if it would have been possible to move the stairs in an Easterly direction positioning them at the Eastern most end of the balconies, thereby increasing their lateral y dimension from the wetlands. The answer is yes, if we had known there were jurisdictional wetlands on the abutting parcel. However, in our view, this would have created an optical obstruction for the windows of the units located at the Eastern end of Building #90. The location described on our design drawings optimizes easy egress because of their location in the approximate middle of the new balconies. Constructing balconies and stairs that would obviously be functional, but also aesthetically pleasing to the unit owners was the focus of our effort. Additionally, we recommended the removal of approximately 12 mature trees between the new balconies and the property line which would help to improve the constant damp atmosphere in this area by exposing the South side of the buildings to direct sunlight. I hope this brief report explains how this whole design and construction process has evolved and emphasize that there was no intention by anyone to ignore the existence of a statutory wetland on the abutting parcel when planning this project. The building official shall inform the applicant of the required points of inspection at the time of application. Upon completion of the work for which a permit has been issued, the building official shall conduct a final inspection pursuant to 780 CMR 115.5. A record of all such examinations and inspections and of all violations of 780 CMR shall be maintained by the building official. For buildings and structures subject to construction control, the owner shall provide for special inspections in accordance with 780 CMR 1705.0. In conjunction with specific construction projects, the building official may designate specific inspection points in the course of construction that require the contractor or builder to give the building official 24 hours notice prior to the time when those inspections need to be performed. The building official shall make the inspections within 48 hours after notification. 115.3 Approved inspection agencies: The building official may accept reports of approved inspection agencies provided such agencies satisfy the requirements as to qualifications and reliability. 115.4 Plant inspection: Where required by the provisions of 780 CMR or by the approved rules, materials or assemblies shall be inspected at the point of manufacture or fabrication in accordance with 780 CMR 1703.3. 115.5 Final inspection: Upon completion of the building or structure, and before issuance of the certificate of occupancy required by 780 CMR 120.0, a final inspection shall be made. All 24 variations of the approved construction documents and permit shall be noted and the holder of the permit shall be 'notified of the discrepancies. 115.6 General: In the discharge of his duties, the building official shall have the authority to enter at any reasonable hour any building, structure or premises in the municipality to enforce the provisions of 780 CMR. If any owner, occupant, or other person refuses, impedes, inhibits, interferes with, restricts, or obstructs entry and free access to every part of the structure, operation or premises where inspection authorized by 780 CMR is sought, the building official, or state inspector may seek, in a court of competent jurisdiction, a search warrant so as to apprise the owner, occupant or other person concerning the nawre of the inspection and justification for it and may seek the assistance of police authorities in presenting said warrant. 115.7 Identification: The building official shall carry proper identification when inspecting structures or premises in the performance of duties under 780 CMR. 115.8 Jurisdictional cooperation: The assistance and cooperation of police, fire, and health departments and all other officials shall be available to the building official as required in the performance of his duties. 115.9 Coordination of inspections: Whenever in the enforcement of 780 CMR or another code or ordinance, the responsibility of more than one building official of the jurisdiction is involved, it shall be the duty of the building officials involved to coordinate their inspections and administrative orders as fully as practicable so that the owners and occupants of the building or structure shall not be subjected to visits by, numerous inspectors or multiple or conflicting orders. Whenever an inspector from any agency or department observes an apparent or actual violation of some provision of some law, ordinance or code not within the inspector's authority to enforce, the inspector shall report the findings to the building official having jurisdiction. 780 CMR 116.0 REGISTERED ARCHITECTURAL AND PROFESSIONAL ENGINEERING SERVICES - CONSTRUCTION CONTROL 116.1 General: The provisions of 780 CMR 116.0 define the construction controls required for all buildings and structures needing registered architectural or registered professional engineering services, and delineate the responsibilities of such professional services together with those services that are the responsibility of the contractor during construction. Said signature and seal shall signify that the plans, computations and specifications meet the applicable provisions of 780 CMR and all accepted engineering practices. 116-= Architect/engineer responsibilities during construction: The registered architects and registered professional engineers who have prepared plans, computations and specifications or the registered architects or registered professional engineers who have been retained to perform construction phase services, shall perform the following tasks for the portion of the work for which they are directly responsible; 1. Review, for conformance to the design concept, shop drawings, samples and other submittals which are submitted by the ADMINISTRATION contractor in accordance with the requirements of the construction documents. 2. Review and approval of the quality control procedures for all code -required controlled materials. 3. Be present at intervals appropriate to the stage of construction to become, generally familiar with the progress and quality of the work and to determine, in general, if the work is being performed in a manner consistent with the construction documents. 116.23 Structural Tests and Inspections: Structural tests and inspection shall be provided in accordance with 780 CMR 1705.0. 116.2.4 Tests and Inspections of non structural systems: Tests and inspections of non structural systems shall be performed in accordance with applicable engineering practice standards or referenced standards listed in Appendix A. 1163 Construction contractor services: The acetal construction of the work shall be the responsibility of the general contractor as identified on the approved building permit and shall involve the following: 1. Execution of all work in accordance with the approved construction documents. 2. Execution and control of all methods of construction in a safe and satisfactory manner in accordance with all applicable local, state, and federal statutes and regulations. 3. Upon completion of the construction, he shall certify to the best of his knowledge and belief that such has been done in substantial accord with 780 CMR 116.3 items 1 and 2 and with all pertinent deviations specifically noted. 116.4 On. site project representation: When applications for unusual designs or magnitude of construction are filed, or where reference standards require special architectural or engineering inspections, the building official may require full- time project representation by a registered architect or professional engineer in addition to that provided in 780 CMR 116-12. The project representative shall keep daily records and submit reports as may be required by the building official. Upon completion of the work, the registered architect or professional engineer shall file a final report indicating that the work has been performed in accordance with the approved plans and 780 CMR 116.4.1 Building permit requirement: This on- site project representation requirement shall be determined prior to the issuance of the building permit and shall be a requisite for the permit issuance. Notwithstanding the exemptions above, professional engineering services shall be required for activities which are deemed to constitute the practice of engineering* as defined in M.G.L. c. 112, § 81D, except as provided in M.G.L. c. 54A and any legally required profession or as provided in M,G.L. c. 112, § 81K 116.1.1 Specialized structures requiring construction control: Telecommunication towers and similar structires are engineered strucnres and shall be subject to the requirements of 780 CMR 116. 116.2 Registered architectural and engineering services: 116.2.1 Design: All plans, computations and specifications involving new construction, altera- tions, repairs, expansions or additions or change in use or occupancy of existing buildings shall be prepared by or under the direct supervision of a Massachusetts registmd architect or Massachusetts registered professional engineer and shall bear his or her original signature and seal or by the legally recognized professional performing the work, as defined by M.G.L. c. 112, §81R. Said signature and seal shall signify that the plans, computations and specifications meet the applicable provisions of 780 CMR and all accepted engineering practices. 116-= Architect/engineer responsibilities during construction: The registered architects and registered professional engineers who have prepared plans, computations and specifications or the registered architects or registered professional engineers who have been retained to perform construction phase services, shall perform the following tasks for the portion of the work for which they are directly responsible; 1. Review, for conformance to the design concept, shop drawings, samples and other submittals which are submitted by the ADMINISTRATION contractor in accordance with the requirements of the construction documents. 2. Review and approval of the quality control procedures for all code -required controlled materials. 3. Be present at intervals appropriate to the stage of construction to become, generally familiar with the progress and quality of the work and to determine, in general, if the work is being performed in a manner consistent with the construction documents. 116.23 Structural Tests and Inspections: Structural tests and inspection shall be provided in accordance with 780 CMR 1705.0. 116.2.4 Tests and Inspections of non structural systems: Tests and inspections of non structural systems shall be performed in accordance with applicable engineering practice standards or referenced standards listed in Appendix A. 1163 Construction contractor services: The acetal construction of the work shall be the responsibility of the general contractor as identified on the approved building permit and shall involve the following: 1. Execution of all work in accordance with the approved construction documents. 2. Execution and control of all methods of construction in a safe and satisfactory manner in accordance with all applicable local, state, and federal statutes and regulations. 3. Upon completion of the construction, he shall certify to the best of his knowledge and belief that such has been done in substantial accord with 780 CMR 116.3 items 1 and 2 and with all pertinent deviations specifically noted. 116.4 On. site project representation: When applications for unusual designs or magnitude of construction are filed, or where reference standards require special architectural or engineering inspections, the building official may require full- time project representation by a registered architect or professional engineer in addition to that provided in 780 CMR 116-12. The project representative shall keep daily records and submit reports as may be required by the building official. Upon completion of the work, the registered architect or professional engineer shall file a final report indicating that the work has been performed in accordance with the approved plans and 780 CMR 116.4.1 Building permit requirement: This on- site project representation requirement shall be determined prior to the issuance of the building permit and shall be a requisite for the permit issuance. Refusal by the applicant to provide such service as required by the building official shall result in the denial of the permit. Dear Ms. Sorkin: The Conservation Department has been made aware of the safety issues associated with the existing decks associated with building #90 within the condominium complex. I understand the North Andover Building Department has required the immediate replacement of the decks in accordance with current building regulations. I signed off on the building permit, as replacement of the decks were mandated by the Building Department. It was my understanding the decks would not be expanded in size, however, new footings would be required to accommodate stairs. Upon sign -off, I conducted a site inspection and observed the partial installation of the required footings for the decks. Work is located within 100 feet of wetland resource areas and will require a filing with the North Andover Conservation Commission. The project is a substantial change from existing conditions and requires ground disturbance. New structures are not allowed within 50 feet of wetland resource areas and no disturbance is allowed within 25 feet of the wetland resource areas. It appears several of the footings may. be located within 50 feet of the.wetland resource area located behind the building. Approval of these footings may be prohibited from the Conservation Commission. Erosion controls (consisting of haybales and silt fence) shall be immediately installed along the limit of work. Work may proceed on portions of the project that are located greater than 50 feet from the wetland resource areas. A Notice of Intent filing must be submitted to this Department no later than January 16, 2004. Failure to submit the appropriate filing requirements by January 16, 2004 will result in a Cease and Desist of project activities and the imposition of fines. Conservation Administrator Heidi Griffin, Community Development Director Building Department file MEMORANDUM TO: Alison McKay FROM: Mike McGuire '/0V (4"A RE: 88 — 90 Farrwood Drive Alison, The State Building Code (780 CMR) 60' Edition Chapter 10 'Means of Egress" is the governing code in regards to 2nd means of egress from all residential structures. The code specifically calls for egress components in multiple residences to be directly available to each tenant, be unobstructed and covered to prevent the accumulation of snow and ice in areas subject to such conditions. The Code also specifies the size of the egress component's, with this building housing 12 units per side of various configuration's the exact number of occupants is unclear and can change as tenants move in and out. A minimum 5 foot stair way has been discussed with the engineer and contractor on site which is acceptable. The question of whether or not the stairways could have been relocated further easterly and away from the wetland area is also governed by the code as covering a area where natural light is utilized in the building cannot be obstructed.
