Dear Frank:
Unfortunately I seem to be making a career out of this
matter. On October 10, 1989, per my request to the Board, this
matter was placed on the agenda for the Zoning Board of Appeals
hearing. Unfortunately the file was not brought to the hearing
date and the building inspector showed up in opposition to the
matter. As you know, this is simply a point of clarification for
us to straighten out exactly how far from the property line the
two stall garage may be built.
I am puzzled and distressed at the opposition this matter is
engendering from the building inspector. Such opposition makes
no sense at all and my clients and I are beginning to believe
that this may be motivated by other factors. As you know, you
and I discussed this case twice before and on two other
occasions the matter was to be brought before the Zoning Board of
Appeals for clarification. This is now the third time that this
matter will be brou;ht forward. The only issue for ;,larifiCaticn
before the Board is the distance from the property line that my
client may build the garage. The original decision allowed them
to build a two stall garage and to build closer to the property
line than the setback requirements allow. The exact distance
from the property line was omitted from that decision and that is
what the purpose of this hearing is to accomplish. It would be
appreciated if this matter could be put on for the next hearing
date and that it could be clarified at that/'time.

Per my telephone discussion with Frank Serio enclosed please
find plot plans for the Board members on the above named
property.
Please place this on the next meeting agenda. The purpose
is to clarify how close to the property my clients may build
their garage. The green shaded line around the garage shows the
proposed structure. It will be two feet off the property line.
My clients were granted a variance in December of 1988 for the
purpose and although we mentioned we would build two feet off the
property line the decision did not reflect this.
