Braese. Upon a motion by Albert P. Manzi, III and 2nd by Daniel S. Braese, the Board voted to uphold the Building Inspector's letter of July 19, 2005 ordering an immediate stop to all construction activity under Building Permit # 263 (A&B) in order to apply for a Special Permit under 4.122.14 and DENY the Finding of the party aggrieved. The Board finds that Town Meeting approved the amendment to 4.122.14 (requiring a Special Permit in order to construct a second family dwelling unit in R-4) on May 10, 2004. The Board finds that Mass. Gen. L. ch. 40A, §6, ¶ 1..."a zoning ordinance or by-law shall not apply to structures or uses lawfully in existence or lawfully begun, or to a building or special permit issued before the first publication of notice of the public hearing on such ordinance or by-law ..." nullifies Building Permit 263 (A&B). We are new residents to North Andover. In November of 2004, we purchased our home on West Woodbridge Road. Prior to the move, we lived in both Milton and South Boston. We decided to buy on this street and in this particular community for several reasons. During our six month research process, we looked at many homes in both Andover and North Andover. Through this extensive process, we narrowed our search to the Library community. The realtor we used from Coldwell Banker educated us about the desirability of this particular neighborhood, especially for a young couple starting a family and looking to put down roots. There is a mix of younger families but also a sense of community developed by families who have lived in this neighborhood for 30+ years. We feel that we paid top dollar in a hot real estate market and based the decision to buy on the fact that in this community there are several different styles of homes but they are all single family homes and predominantly owner -occupied. Another consideration was the spacious yards. Now, we have a major concern that the integrity and character of our neighborhood may change dramatically. With the possibility of duplexes being added on an abutting property, we fear that our major investment's future value may be significantly impacted. We have seen the construction currently underway firsthand in the adjacent lot and are fearful that 80 Pembroke Road will resemble that project. Our home sits directly behind this proposed project. These proposed residences will significantly change the character of this neighborhood. Duplex homes are not part of the current landscape. We are also concerned about the views from our back windows and deck. Currently, we have several large trees on our property that provide a large amount of shade. In addition, there are two old, large trees on the property we are discussing that also provide shade. We never anticipated that these trees would be removed and that a taller home would be built on that property. If this project is approved, we feel that the tress will be removed and our landscape will change drastically and we will also lose our privacy. We are also concerned that if there are four families living in an area where one had lived, that there will also be excess noise. We appreciate the time you have given us to bring these concerns to your attention. We hope this letter weighs heavily in your decision regarding this matter. We hope that we continue to see strong appreciation in the value our home and our neighborhood and also hope that you choose to protect the integrity of the current landscape. It has been brought to our attention that a new cell transmitter is planned for the tower on Mill Hill. We have very serious reservations about the new transmitter. We cannot attend the meeting tonight but would appreciate our letter being read into the record. We will make every attempt to attend future meetings as we believe this issue to be extremely important. 1. Residents at Peachtree Farm were not properly notified. Peachtree is a Planned Residential Develoment with at least 50' buffer of open space surrounding the project. The open space is owned by the homeowners at Peachtree. Hence we are all abutters to the property in question. 2. There is no reason and no precedent for granting a variance for a new cell transmitter. If a variance is granted a dangerous precedent will be set and every other cell operator will want to place a transmitter at the tower site. 3. Cingular has not proven a hardship. There are numerous other places to put cell towers. Competitive disadvantage does not equal hardship. 4. Perhaps they should acquire Sprint if they need more cell towers or lease network space from Sprint or another operator with a nearby tower. This market lends itself to natural monopolys. 5. So far there are 25 children at Peachtree Farm. Our ripen space, and numerous houses are within the 600 foot buffer. Despite FCC protests and denials there are convincing health concerns related to cell tower transmissions. That is the reason cell phones were reduced in transmission power from 3 watts to 1/6 watt. In the UK children are warned from cell usage. Cell phone makers publish radiation figures for every phone. Thank you for your consideration of our concerns on this very important matter. I cannot imagine anyone wanting a cell transmitter in their backyard. Respectfully,, Michael McGuire Local Building Inspector MEMORANDUM APPLICANT: Paul St. Hillaire, Trustee Village Realty Trust 51 Thistle Road North Andover, MA 01845 PURPOSE: Application for Finding from the North Andover Zoning Board of Appeals PROPERTY: 90 Pembrook Road North Andover, MA 01845 The Applicant seeks a finding from the North Andover Zoning Board of Appeals to reinstate a Building Permit issued to the Applicant on October 19, 2004 for construction of a two-family residential dwelling at 90 Pembrook Road, North Andover, MA. On July 13, 2004, the Applicant submitted to the North Andover Building Department a building application, a Form U lot release form, a site plan, a growth management by-law exception statement, a debris disposal permit, and a copy of his Massachusetts Construction Supervisor License, for the purpose of obtaining a building permit for construction of a two-family residential dwelling at 90 Pembrook Road, North Andover, MA. Mr. Robert Nicetta, who was, at that time, the North Andover Building Commissioner and Zoning Officer, met with Mr. St. Hilaire on several occasions regarding the application and even made suggestions with regard to a redesign of the plan. Mr. Nicetta determined that, according to the procedure in place at the time of the filing of this application, a Building Permit could be issued to Mr. St. Hilaire, and that the 2004 Town Meeting change in the Zoning By-law which required a special permit from the Zoning Board of Appeals for two-family dwellings in a residential district did not apply to him. Two-family residential dwellings are an allowed use in an R-4 zoning district. Subsequently, on October 19, 2004, Mr. St. Hilaire was issued Building Permits, signed by Mr. Michael McGuire, Building Inspector, to construct a two-family residential dwelling (Permit No. 263 A & B). During October, 2004, the Applicant demolished the existing house on the lot and commenced with the construction of the new dwellings. Mr. St. Hilaire has poured the a'l foundation for the new structure and was preparing to contruct the dwellings when he received a letter from Mr. Michael McGuire, Building Inspector, to immediately stop all construction activity at 90 Pembrook Road, stating that Mr. St. Hilaire has not complied with the requirements of Section 4.122.14, Paragraph b. The cease and desist order was delivered approximately nine months after the original Building Permits were issued. The reason for this order is that, pursuant to Town of North Andover Zoning Bylaws, Section 4.122.14 Residence 4 District (Permitted Uses), Paragraph b: "Two family dwellings, by special permit from the Zoning Board of Appeals in accordance with section 10.3 and 4.122.14.1 of this Bylaw", construction may not proceed without a Special Permit from the Zoning Board of Appeals. Please contact this department for further information and for an application fora Special Permit. Pursuant to Section 10.1 of the Town of North Andover Zoning Bylaws, if work is not stopped in accordance with this Order, further proceedings may be instituted and you may be subject to a fine as provided in Section 10.13 of the Bylaw.
