O O �9SSACrHUS�' TOWN OF NORTH ANDOVER MASSACHUSETTS BOARD OF APPEALS Petition 497-88 DECISION The Board of Appeals held a public hearing on November 10, 1987 on the application of Ms. Joyce D. Patracone, Trustee, Branman Realty Trust requesting a variance from the requirements of Section 4.123(18) and Table 1 of the Zoning ByLaw so as to permit professional offices on first floor with no reduction in number of residential units in remainder of building on the premises located at 90 Sutton Street. The following members were present and voting: Frank Serio, Jr., Chairman, Alfred Frizelle, Vice- chairman, Walter Soule, Raymond Vivenzio and Louis Rissin. The hearing was advertised in the North Andover Citizen on September 24 and October 1, 1987 and all abutters were notified by regular mail. Upon a motion made by Mr. Frizelle and seconded by Mr. Rissin, the Board voted to GRANT the variance as requested. The Board finds that the petitioner has satisfied the provisions of Section 10, Paragraph 10.4 of the Zoning ByLaws and the granting of this variance will not derogate from the intent and purpose of the Zoning ByLaws nor will it adversely affect the neighborhood. OF COUNSEL Pursuant to our previous telephone conversation, I have examined the variance that was granted and the then applicable rules, and I have determined that I do in fact need some manner of corrective memoranda. I have taken the liberty to prepare an Affidavit which will straighten out two matters: 1. The correct section is listed (as I told you the new rules and regulations had been passed but were not yet distributed, so I applied for a variance under the wrong section although the wording is identical); and 2. The matter regarding the parking. Obviously, there is no room for new parking spaces on the premises as far as I can tell, and as you pointed out, these premises have been used for a long time and without a problem as both commercial and residential with the existing number of parking spaces. Entrances, exits, driveways, etc. that are pertinent to the granting of the variance shall. be shown. All proposed data shall be shown in red. Any topographical feature of the parcel of land relied upon for a variance, such as ledge, rock peat, or natural condition of water, brook, or river, shall be shown on the engineering plan. When a variance is requested to subdivide a parcel of land, the dimen- sions and area of the surrounding lots may be taken from the deed or lotting plan for comparison of the size of the lots in the neighborhood, noted on the plan as such, and marked "approximate". The plan shall be signed and bear the seal of a registered surveyor or engineer. Any plans presented with the petition shall remain a part of the records of the Board of Appeals. This office has employed a Registered Architect, together with the services of a Structural Engineer. As indicated by the Statement of Facts submitted by theprevious owner, M & S Building & Construction Co., Inc., please be advised that under date Cf June 22, 1967, M & S Building & Construction Co., Inc. employed "Carr -Dee Test Boring & Construction Corp.", 37 Linden Street, Medford, Massachusetts. A copy of their results of test borings at our site is attached hereto. It was the expressed opinion of the representative of Carr -Dee Test Boring that additional borings would be a waste of money, that the results indicated an excellent basis for the proposed structure with reference to the sub -soil. Two dwelling units have been demolished and excavation started. At this point, it has become very evident thatthe site contains, generally speaking, approximately 7' of a substance known as river silt loam. rood engineering and construction practices immediately indicates that to attempt the erection of a structure as contemplated on this site would necessitate the removal of such soil in order to insure a structurally sound. building. As a result of the findings of this condition, we have further commissioned our architect, together with his structural engineer, to evaluate the most practical and structural modification to the plan originally submitted. for your approval. a The following recommendations and procedures have been made: To excavate all foreign soil matter down to a solid base of undisturbed soil; to place thereon footings of sufficient size, consistent with engineering recommendations, reinforced with steel, including dowels with bends; to pour a full base- ment. Redesign also includes positioning the various levels In the same position that they originally appeared. In essence, in lieu of a concrete slab, it will require a full basement. In view of the cut necessitated in the excavation, it has been determined that the wall to the rear of the building would carry the same motif as the upper structure. The lower level of the livable area of the structure will be 1/2 story below street grade. No utilization of the basement is planned at this time excepting for an enlarged utility room which was otherwise on the original ground level floor. From the average passer-by, or as this building will appear from the street level, it will not have substantially deviated from the original rendering submit tel to your Board. The height cf tl-�e structure from street grade will still remain 21. stories above the street grade. It is estimated that because of the ground conditions involved during the construction, there will be an additional cost of approxi- mately ;',25,000.00 to 430,000.00. Under the provisions of the Enabling Act under which your Board operates, there is provided the authority wherein the Zoning Board of Appeals may amend their Decision, when required, subsequent to the actual issuance of such a Decision. SECTION I The subject petition is for a Special Permit and Variances in connection with the use of the land as a site for a proposed multiple dwelling complex under the provisions of Section 4.7 of the Toning By-law of the Town of North Andover, Massachusetts, said Section being entitled "Apartment Developments." Section 4.7 provides for apartment dwelling developments in any zoning district. The locus under discussion is zoned. "Industry," and as such is a non -conforming parcel of land created nen-conforming by the a0r.p- tion of the current ?ening By-law itself. The land is of two distinct lots of legal record: Lct 2 contains 13,660 square feet, known as 9n Sutton Street. This lot was laid_ out and has been of record in excess cf 50 years. Lct B contains 47,680 square feet, is an interior parcel of land which is bounde(l. on the northwest and north by the thread of the Shawsheen River. Title to this parcel is by Land Court Certificate of a 1928 decree, and was separately acquired. by your Petitioner in 1966. Prom the Site Plan and? Plan of Lana by Brasseur Associates, sub- m1tted as an. exhibit to your Board., there is indicater', thereon a sewer easement. In 1966, ,your Petitioner granted ,an additional easement am right of way to your Tcwn and to the Massachusetts Department cf Public Works for the purpose of alleviating a very critical, live sewerage condition that was posing a very serious health menace to the Town of North Andover, and resulted from the diverting cf the Shawsheen River at the time, and in connection with the ccn- structi.on of Interstate Highway 7#495• No monetary consideration for this additional easement was ever sought or received, but was granted within the context.of civic pride of being a responsible part of North Andover, and to expedite the corrective action required without cost to the Town of North Andover. M II SECTICY II Under !lection VI of the current "Rules and Regulations" of the Ncrth n(lover 7ening Board of. Appeals, Sub -section B refers to conlitions especially affecting the property for which a variance is sought. The particular property, as well as the majority of aajacent properties, is located at a sensitive entrance to the Town of North .,.mover .from the City of Lawrence, Massachusetts. The properties, in general, are estimated to be of an age running frcm 125 to 150 years, and are without question the oldest structures in the community. 1 -lost of the properties are currently utilize-' as residential, and in all cases known to this Petitioner within at least 300 to 500 feet have been built as, or have been converted to multiple -?welling units. Therefore, it is ccntended that any new complex_, and especially of the type proposerl. unr er subject petition, will have a definite effect of upgrading the area, ans4 under no condition can it be termer as having, any r?etri- mental effect whatsoever. Therefore, it. is contended that the proposed complex will not adversely affect generally the zoning (9.1strict in which it is locates,., but will, in effect, �--,nhance the zoning (?istrict. SECTION III It is contended throughout past decades, and within the history of real estate ownership, that owners of property have every legal privilege an,? right to 4evelcp their property to the highest and best end use, and with the normal decay and obsolescence that has set i_nte the immediate area, it is the objectivity of the Petitioner to improve not only its lane, but enhance the area. and if such rights are deprived from a landowner, a substantial harrlship, together with excessive use of police powers will result. O suggestions of the builr1ing authority for the Town of Ycrth. Ando ver. In engaging this architectural firm, your Petitioner incurred. an obligation in the dollar, area of X10.,000.00. The plan submitted to your Board represents one of the first sets of plans for apartment dwellings to be presenter', accordance with the State Statutes requiring that all apartment dwelling plans be rlesignea by a Registered Architect. Therefore, in the event of the denial of the subject petition, the Petitioner, in adr'iticn to "restrictive uses for his land which must be ccnstruerl as substantial hardship, shall sustain substantial financial hardship. SECTICY IV Facts relied. upon to support a finding that the relief sought will be desirable and without substantial detriment to the public goer require very li._ttle justification since there is o crying nee,3 for the type of rental unit proposed. Today, in the Town of Yorth Andover, to the best knowledge of the Petitioner, there has been built, rental units consisting of 4 to 7 rooms, comprising 2, 3, and 4 bedrooms which, per unit, will acccmodate from !+ to 7 persons. The type of unit under consideration is one that will accomodate either 1 or 2 person occupancy. Marketing research, both by the Petitioner and lending institutions who have indicated. a strong acceptability to finance the Petitioner's project, indicates that there is a complete lack of facilities for people in the area of 1 or 2 persons desiring minimum accomodations. It is inconceivable that a structure as proposed, which will add to the tax base of this community and enhance the immediate neighborhood, can in any way be construed as being detrimental to the public good; IV to the contrary, it is providing a. higher standard of habitation facilit les then currently exists for a segment cf the public who are seeking housing of this type. One of the several reasons put forth as to why this type of housing has not heretofore been adopted by privatel financed housing units are the excessive requirements of Section 4.72 and 4.73, requiring a minimum of 3500 square feet of land per dwelling unit, an(l a ceiling of not more than 1.2 units per buil,'ing. It is contended that such limitations are inconsistent with reasonable and practical interpretations of requirements for rental units. This contention is based upon the fact that a livable unit of li50 square feet, cr a livable unit of 3,000, square feet h�e.s the same requirements under saitl zoning limitations. It is contended that by the design of the preposer' apartment complex, it is in fact two separate, distinct builn_ngs within the interpretation of authorities of such ccnstrunticn; specifi- cally, by reason of complete fire -wall stoppages r'ivi?ing equal amounts of units on each floor to be supplied with said fire -wall protection andadditional egresses as distinguished from an acceptable plan under the specific written word. of the By-law in question. In the development of the end. result of the proposed building, your Petitioner held conferences with the Chief of the Fire Department of North sinrl.over, Nussachusetts, with the view of determining his desires in connection with fire protection devices. Your Fire Chief discussed various types of alarms and detector systems, and also :rade a recommendation that the very best type of fire protection devices for public safety would be a fully O automatic -sprinkled building. Your Petitioner, prior to the scheduled hearing; dict make a. decision to install a completely automatic sprinkling system throughout this building in accordance with the fire underwriters' specifications. After this determi- nation had. been made, your Petitioner returned tc the Chief of the Fire Department and stipulated to him that he intended to install the automatic sprinkler system. At the time of this conference, .your Petitioner inquirerl. about the installation of a fire alarm 'ocx to be installed cn the exterior of the building, whereupon the Fire 'hief immediately recommended that the Petitioner shculr� install an automatic fire alarm system tied in with the sprinkler system with an automatic alarm to be sounded, at Fire Headquarters in the event of detection or defectiveness which in any wa.y may involve public safety. In addition, a fire alarm box was planned for the exterior wall of the proposed structure for manual use by the public, which in.addition to the building wouldbe used for the imned.iate neighborhood in the event there were need to call the Fire Department . Immediately upon this suggestion by your Fire Chief, your Petitioner unhesitantly, co%L nittecl this installation. An educated estimate of cost in connection with the installation of this fire and. sprinkling system reflects additional cost of approximately 420,000.00. It has been adopted. consistent with the desire cf establishing a first class building, a desire to cooperate with all Town Officials, and a recognition that such an installation is substantially beneficial and should be adopted. in connection with multiple dwellings in this town. VI OThis fire protection cooperation is not provided for under the By-laws of this town or within the State Statutes wherein it is compulsory, but your Petitioner recognizes its feasibility and. displays this condition as good faith in the development of structure that will probably enable your Fire Department to attain higher standards of fire detection systems in future buildings of this nature to be erected in the Town of North i►ndover. To further support a finding that relief sought will be desirable anlwithout substantial detriment to the public good, your attention is'invitedthat under the present Zoning By-law, your Petitioner coup? build a building of the same square fc�)t size or even con- siderably larger, containing 12 rental units that would house a greater number of residents than the proposer complex under ccn- sideration. Statistics indicate that the type of unit proposed un(ler consideration will have a population of approximately ll persons per unit. This when computed woulrl indicate apprcximutf:ly 22 persons as a mean average population. In a 12 unit structure comprising 3 be,1room rental units which currently exist under cul' Zcni.ng By-law, a.nq. have been built in the Town of North Andover, it has been estimated that there are 4 - 5 inhabitants per rental unit, or approximately 75-57 residents in the one building. Your Petitioner reviews the fact that in such a structure there are no fire -walls separating and constituting two structures, which. on O a total estimate for 29 apartments in the two structures, would re(?uce the !nean population to 22 inhabitants per section. Neither has the building of 12 units herein discussed had the additional protection for the public good, the extensive fire prevention and fire protection rievices and systems which are proposed for the Petit toner' s complex. In connection with a support of a finding that will be without substantial detriment to the public good, the most serious consi- .oration arises. At the present time, subject property is pro- ducing a tax base income to the Town of North Andover of approxi- mately ��:300.00 per year. When and if this projected apartment unit is completed, it is estimated, based upon the estimated cost of construction, that the tax income to the local community would be somewhere in the neighborhood of 46,000.00 per year. Your Petitioner has held conferences with your Board. of and the type of building to be erected reflects an estimated economic life of not less than 50 years. An estimate of cutting the 50. years to a mrre 25 years, it is easily calculated that the estimate(' income on this to be upgraded parcel of land could yield an income of approximately ;'150,000.00 as a 25 years' projected tax base improvement. SECTIM V Your Petitioner is relying upon the following facts to support a O finding that the relief sought may be given without nullifying or substantially derogating from the intent and purpose of the Zoning By-law. It is contended that upon the formulating ane, ad.opticn of the present Zoning By-law no consideration was given with respect to the size of units in ratio to the amount of square feet of land requirements. It is inconceivable for an apart- ment unit of 470 feet of livable area should_ and must require the same square footage of an apartment of 3,000 square feet of livable area. It is inconceivable that the preparation of the apartment by-law considered the total occupancy of inhabitants per apart - men t. ;n apartment designed fcr two inhabitants would require the same provisions of an apartment designed. for 8 inhabitants, or for 6 inhabitants, or for 4 inhabitants. It is inconceivable that In preparing the apartment Ievelop- ment by-law that the same provisions woul,1 apply to a building desi,,-med to house 20 inhabitants vs. a building designe-1. to house 60 inhabitants. In light of the foregoing, it is contende(' that Section 4.72 and. Section 4.73 has been adopted without the projection cf the entire scope of rental unit design, types, numbers, and. VIII As mentioned elsewhere, this variance is sought by a private petitioner using private funds, which in turn will yiel? an .income to the tax base for the inhabitants of the Town of North An,lover, Massachusetts. Your Petitioner points to the fact that in the Town of North Lndover, recently completed and. recently occupied, is an apartment complex ;which h&d a land-tak-in.g, depriving the town from receiving; future tax benefits, which was built totally from public funds, and. now places an additional burden on the average taxpayer, which has rental units not i.nconsis tent in size with those pro- posed by your Petitioner, which has approximately only 405 of the lani area as providedfor and imposed upon private 3_n^ustr,y unf?_er your Zcning By-law, and which will, unAer �z rental occupancy, continue to be subsi.,?ize(! by publid funds. Your Petitioner believes that the foreoi.ng is an excellent example of support for a favorable finding inthis connection. Your Petitioner calls to your attention that the variance sought under this petition may be granted without nullifying or substan- tially derogating from the intent or purpose of the zoning by- law, and that your. Board. has set a prece,'en.t for the granting of such a variance. Your attention is invited to the variances granted to the Walker Realty Trust, also in a downtown area wherein the square foot of land requirements were waived under the same conditions as are sought under our present petition. SECTION VI In conclusion, your Petitioner contends the following: a) That there are certain conditions especially affecting the parcel in question which do not generally affect the entire zoning district of which the parcel is located; b) That unless the variance and special permit are granted, the applicant will suffer substantial hardship, financial and otherwise; c) That the requested variance and permit will not adversely affect the public good to any substantial extent; quite the contrary, it will be beneficial to the public good. d) That the requested variance and special permit will not be in substantial derogation from the intent or purpose of the' Zoning By-law.
