Every application for action by the Board shall be made on a form approved
by the Board. These forms shall be furnished by the Clerk upon request.
Any communication purporting to be an application shall be treated as mere
notice of intention to seek relief until such time as it is made on the
official application form. All information called for by the form shall
be furnished by the applicant in the manner therein prescribed.
Every application shall be submitted with a list of "Parties In Interest"
which list shall include the petitioner, abutters, owners of land directly
opposite on any public or private street or way, and abutters to the
abutters within three hundred feet (300') of the property line of the
petitioner as they appear on the most recent applicable tax list,
notwithstanding that the land of any such owner is located in another city
or town, the Planning Board of the city or town, and the Planning Board of
every abutting city or town.
*Every application shall be submitted with an application charge cost in
the amount of $25.00. In addition, the petitioner shall be responsible
for any and all costs involved in bringing the petition before the Board.
Such costs shall include mailing and publication, but are not necessarily
limited to these.
Every application shall be submitted with a plan of land approved by the
Board. No petition will be brought before the Board unless said plan has
been submitted. Copies of the Board's requirements regarding plans are
attached hereto or are available from the Board of Appeals upon request.

V PLAN OF LAND TO ACCOMPANY PETITION
Each application and petition to the Board shall be accompanied by
five (5) copies of the following described plan:
The size of the plan shall be 11 x 17, drawn to scale, 1 inch
equals 40 feet; it shall have a north point, names of streets,
zoning districts, names and addresses of owners of properties
within a minimum of 200 feet of the subject property, property
lines and location of buildings on surrounding properties. The
location of buildings or use of the property where a variance is
requested and distances from adjacent buildings and property lines
shall be verified in the field and shown on the plan. The
dimensions of the .lot and the percentage of the lot covered by the
principal and accessory buildings and the required parking spaces
shall be shown. Entrances, exits, driveways, etc. that are
pertinent to the granting of the variance shall be shown. All
proposed data shall be shown in red.
Any topographical feature of the parcel of land relied upon for a
variance, such as ledge, rock peat, or natural condition of water,
brook, or river, shall be shown on the engineering plan. When a
variance is requested to subdivide a parcel of land, the dimen-
sions and area of the surrounding lots may be taken from the deed
or lotting plan for comparison of the size of the lots in the
neighborhood, noted on the plan as such, and marked "approximate".
The plan shall be signed and bear the seal of a registered
surveyor or engineer. Any plans presented with the petition shall
remain a part of the records of the Board of Appeals.
If living quarters are to be remodeled, or areas are to be
converted into living quarters, in addition to the plot plan, five
(5) copies of the following described plans shall be furnished:
1. A floor plan of each floor on which remodeling is to be done
or areas converted into living quarters;
2. A floor plan showing the stairways, halls, doors opening into
the halls, and exit doors of each floor or floors where no re-
modeling or converting is to be done;
3. The plans and elevations shall show all existing work. All
proposed work shall be shown in red. The size of each plan
shall be 11 x 17 or 17 x 22; it shall be drawn to scale, 1/4
inch equals one foot.
All plans and elevations presented with the petition shall remain
a part of the records of the Board of Appeals.
For petitions requesting variation(s) from the provisions of
Section 7, Paragrpahs 7.1, 7.2, 7.3, and 7.4 and Table 2 of the
Zoning By Law for conveyance purposes only, a plot plan, certified
by a registered engineer or land surveyor, of the parcel of land
with a structure thereon being conveyed, will be acceptable to the
Board of Appeals provided:
1. The dwelling(s), structure(s), or building(s) were constructed
prior to March 14, 1977.
2. The petition is not to allow construction or alteration to
the dwelling(s), structure(s), or building(s) which will re-
sult in the need for the issuance of a building permit.
3. The size of the plan shall be no small.er than 8 1/2 x 11
inches and must show.the existing area of the parcel, the
existing frontage, and the existing setbacks of the
dwelling(s), structure(s), or building(s) being conveyed.
4. Proper space is provided on the plot plan for the Board's
signatures, as well as adequate space for.the following
information: date of filing, date of public hearing, and
date of approval.

The Board of Appeals held a regular meeting on Tuesday evening, April 14, 1998, upon the application of W. Scott
Hoppe, 151 Pleasant Valley Rd., Amesbury, MA, requesting a Variance for said premises located at 93-95 Union
St., North Andover, MA which is in the R4 Zoning District, from the requirements of Section 7, paragraph 7.3, of
Table 2, for relief of a front setback of 1.5',and side setback of 9.0' and 11.0% and rear setback, of 26.2', and for a
Special Permit from the requirements of Section 4.122, paragraph 14 (a & b) to convert a two family existing
dwelling into a three family residence .
The following members were present: Walter F. Soule, Raymond Vivenzio, Ellen McIntyre, Scott Karpinski, George
Earley.
The hearing was advertised in the Lawrence Tribune on 2/24/98 & 3/3/98 and all abutters were notified by regular
mail.
Upon a motion made by Raymond Vivenzio, and seconded by Scott Karpinski, the Board of Appeals voted to
GRANT a Variance for relief of a front setback of 14.9' and a side setback of 11.0' and 9.0', and a rear setback of
26.2', and to GRANT a Special Permit so as to permit converting a 2 family dwelling into a 3 family dwelling with
the condition that the petitioner present a parking plan for the Building Inspector's approval . Voting in favor:
Walter F. Soule, Raymond Vivenzio, Ellen McIntyre, Scott Karpinski, George Earley.
The petitioner has satisfied the provision of Section 10, paragraph 10.4 of the Zoning Bylaw and that the granting of
these variances will not adversely affect the neighborhood or derogate from the intent and purpose of the Zoning
Bylaw.
The Board finds that the applicant has satisfied the provisions for a Special Permit of Section 9, paragraph 9.2 of
the Zoning Bylaw and that such change, extension or alteration shall not be substantially more detrimental than the
existing non -conforming structure to the neighborhood.
Note: The granting of the Variance and/or Special Permit as requested by the applicant does not
necessarily ensure the granting of a Building permit as the applicant must abide by all applicable local,
state and federal and building codes and regulations, prior to the issuance of a building permit as
requested by the Building Commission.

Dear Mr. Long:
The Board of Appeals held a public hearing on August 12, 1986 upon
the application of... George Hanna requesting a Special Permit from the
requirements of Section 4, Paragraph 4:122(14) of the zoning bylaws
so as to permit converting a 2 -family dwelling into a 3 -family
dwelling. The following members were present and voting: Frank
Serio, Jr.., Chairman, Alfred Frizel le, Vice -'Chairman, William Sullivan,
Raymond Vivenzio and Anna O'Connor.
The hearing was advertised in the North Andover Citizen on May 22 and
May 29, 1986 and all abutters were notified by regular mail. Motion
made by Raymond Vivenzio and seconded by Alfred Frizelle to GRANT the
Special Permit so as to permit converting a 2 -family dwelling into a•
3 -family dwelling with'the condition that the petitioner present a
parking plan to the Building Inspector's approval and that off-street
parking for six (6)•icars be built before a Building Permit is issued.
The vote was unanimous to GRANT this petition.

I believe that allowing this building to be used as a three family will not adversely impact the
neighborhood in which the building is located for the following reasons:
A 4 -family residence abuts the property to the east and a 2 -family residence abuts the property to
the west. Located across Union Street are 2 -family and single family residences. Single family
residences are located north of the property, one fronting Beverly Street and one fronting
Marblehead Street. The use of the property as a 3 -family is consistent with the presence of other
multi -family residences in the greater neighborhood.
2. The proposed improvements are minimal and will not expand the footprint of the building.
The lot is large enough to accommodate six off-street parking spaces so that street parking will not
be impacted by the improvements.
4. The proposed one bedroom unit will most likely be occupied by one or two people, which will not
greatly increase the amount of people living in the neighborhood.
5. During September 1986 the Board of Appeals granted a request to use the property as a 3 -family,
indicating that the use of the property as a 3 -family is appropriate. It
I sincerely hope that the Board members will allow approval of this special permit request. Denial of this
request will represent a significant fmancial hardship to me due to the loss associated with the already
completed improvements of the building which will have been wasted without the third floor being put

Dear Board Members:
Enclosed please find a completed application for the Special Permit request for 93-95 Union Street in
North Andover. This permit request is being made to establish the property as a 3 -family dwelling from
it's current use as a 2 -family dwelling. I purchased the property in November 1996 to renovate the
property and with the hope of developing the third floor into a third unit. To this end, during the first
portion of 19971 remodeled/restored the second floor unit of the building by performing among other
things the following tasks:
Removed the acoustical ceiling file suspended ceilings, reinforced the ceiling joists to support
residential use on the third floor, installed new insulation, then placed a new ceiling of fire -rated
blueboard and plaster with crown moldings throughout the unit.
2. Installed piping for the drain and supply lines for a bath and kitchen on the third floor.
Disconnected the electrical and heat from the third floor living space and placed a new electrical
conduit from the third floor to the basement to allow for a connection to a new three meter
electrical service panel.
These items were performed under permit from the North Andover Building Department but prior to
obtaining a special permit from the Board of Appeals due to the requirement of generating income from
the rental of the second floor unit. The additional work associated with the future improvements to the
third floor was done at this time to allow for the completion of the third floor living space as a separate
residence.
The building is ideally suited to being used as a 3 -family for the following reasons:
1. The building is located on a large lot which can accommodate a total of six parking places,
meeting the requirement of two parking spaces per unit.
2. The building has stairs located at both the front and rear of the building, providing two forms of
egress for the third floor.
.3. The third floor has historically been used as living space with two finished rooms and full
gambrel -roofed dormer to provide living space.
4. By adding a ten foot wide dormer to the rear of the third floor, a total of approximately 650
square feet of living space will be made available for use as a third residence in the building.
