As Principal of the Bradstreet Erly Childhood Center, I have had the opportunity to work with Mrs. Mithchell and her staff for a number of years, and have observed many children who have completed their program and entered kindergarten here. Out Country Preschool is, in my opinion, an excellent, viable neighborhood school which provides a stimulating preschool environment for children in the "out country" section of North Andover. My observations of the children who have attended the program, and interactons with their parents indicate that they have had a thorough, stimulating preschool experience which focuses on helping each student develop at his or her own rate and stresses the development of self-esteem. Mrs. Mitchell has consistently maintained open and frequent communication with the North Andover Public Schools, through Bradstreet, concerning her program and children who are transitioning to the public kindergartens here. I am impressed with her knowledge of children as well as her genuine concern for each child's well-being. She has -worked hard to help make each child's entrance .into kindergarten as smooth as possible by arranging for them to visit the school and by communicating information to parents and to the schools. As you know, the preschool is located in a residential area. The home setting is one of the features that makes coming to Out Country a special learning experience. It also requires that you and I respect the concerns of the other Candlestick residents. The safety of the children in the neighborhood absolutely requires that drivers go slowly, 20 mph or less, on Candlestick Road. For a few minutes at the beginning and end of classes the school adds more traffic to the neighborhood. Before the school year begins, I am requesting that you plan to bring and to pick up your child without rushing, consider car-pooling, and be considerate of the neighbors. The children's safety is paramount and to that end the failure to obey the preschool's 20 mph speed limit policy will be considered a failure to adjust to the preschool. As the parent handbook states, the school reserves the right to terminate the child who is not making a satisfactory adjustment to the preschool program. Class lists to help facilitate car-pooling will be mailed early in August. Please try to make arrangements to car-pool. List all drivers your child will be riding with on the bottom of the Authorization and Consent Form. This form must be notarized. Your child will be put into his/her regular car pool unless we have a note on that specific day stating otherwise. They intend to construct an addition to their home adding sufficient area to operate a children's day care center in conformance with the requirements of the Commonwealth of Massachusetts Division of Children's Services to accommodate 31 children. The applicant is a duly licensed and qualified instructor and has a waiting list of parents for the admission of children into the day care center. There is existing drastic shortage of needed facilities of the type being provided by the applicant and the applicant believes that her home environment and teaching qualifications and staff could best be utilized in providing day care services for 31 children. The applicant believes that the area in her home in the country atmosphere at Candlestick Road is an appropriate if not an ideal location for the use proposed. The area is readily available for access by the families within the Town of North Andover utilizing her services. The scale of the operation proposed by the applicant is such that it will not adversely effect the neighborhood surrounding her home. The applicant has a large driveway with adequate turn -around space so that the children and the vehicles of the parents transporting the children to the day care center will not create a nuisance or serious hazard to vehicles or pedestrians in the area. The area of the applicants home to be created will expand the house and the existing child care facility sufficiently to accommodate the additional number of children. It will have immediate door access to the outside for access and egress needed for safety and other purposes. The applicants yard is large and provides adequate space and area for outdoor play and recreation at appropriate times. The children are at all times supervised and their use of the premises does not constitute an annoyance or nuisance -to the abutting property owners. The applicant believes that the use as proposed by her will be in harmony with the general purpose and intent of the North Andover Zoning By -Law and will provide much needed service to the community. In hopes of alleviating many of those concerns we are willing to commit to the following: • A reduction in our request from 31 children to a limit of 24 children, an additional 12 children per session. • Require parents to enter Candlestick Road from Boxford Street and exit via Jerad Place, creating a one-way traffic flow to and from the school. • A letter will be circulated to all parents requiring them to abide by the school policy of traveling at 25 MPH while on Candlestick Road. Families warned and not in further compliance will be asked to find a school better suited to their needs. • Children will be removed from and returned to motor vehicles by teachers thereby eliminating loitering and congestion. • Instructions to parents will include a request to car pool whenever possible. Parents will be required to park only in the preschool driveway or street frontage of preschool property. A diagram will be included to reinforce the only designated areas available, This will eliminate any likelihood of parking in front of neighbors' property. • Graduation will be held off site. This is a compromise that takes into consideration the neighbors' concerns and we hope you will issue a special permit for the modified number of children. OFC has to set up the Fund, administratively and fiscally, and be prepared to receive the money. • The Affordability Task Force ("or any successor body named by the direc- tor") is charged with administering the fund. Employer qualifications for doing business with the state • Beginning on September 1, 1991, anyone who contracts with the Commonwealth and employs more than 50 people must offer DCAP, tuition assistance, or on-site or near -site child care to their employees. Beginning on July 1, 1991, the state and every authority shall meet this provision. • OFC will need to develop minimum standards for child care tuition assistance, and on-site and near -site child care subsidies. Floor area incentives for real estate developers • In cities and towns that restrict the total floor area of buildings, the square footage assigned to child care facilities shall not be considered part of the total square footage. • The day care center or school aged child care program shall be taxed at the residential, rather than commercial, rate. • The building. owner can charge the operator of the day care facility for certain expenses but cannot impose a charge for alterations necessary to meet Office for Children licensing requirements regarding the physical space. • If the need for the child care facility stops, the building owner must get approval from OFC before s/he can use the space for any other purpose. • OFC must develop policy or regulations that define the circumstances under which the center can be terminated. Zoning for day care centers • The state zoning statute, Chapter 40A, has been amended to allow, by right, the siting of day care centers and school age programs in every city and town. Cities and towns may no longer require. special permits. �iL 5i72 Chapter T H E C O M M O N W E A L T H O F M A S S A C H U S E T T S In the Year One Thousand Nine Hundred and Ninety AN ACT RELATIVE TO CHILD CARE IN THE COMMONWEALTH. Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: SECTION 1. Chapter 28A of the General Laws is hereby amended by inserting after section 5 the following section: - Section 5A. There shall be established and set up on the books of the commonwealth a separate fund to be known as the Child Care Affordability Scholarship Assistance Fund, in this section referred to as the fund, which shall be subject to appropriation and shall consist of revenues received from (1) state appropriations; (2) gifts, grants and donations from public or pri- vate sources; (3) interest earned from fund reserves; (4) federal reimburse- ments, grants-in-aid and other receipts which can be used for funding child care services and (5) any other monies credited or transferred to the fund from any other source pursuant to law. Up to eighty per cent of the monies deposited annually in the fund shall.be allocated to the office and adminis- tered by the day care affordability task force established by section fifty- three of chapter two hundred and six of the acts of nineteen hundred and eighty-six, or any successor body so designated by the director, in order to provide funding for child care services to children of families whose income is not.more than one hundred and ten per cent of the median income of families in the commonwealth. The remaining monies of the fund shall be used in ac- cordance with the provisions of this section. The books and records of the fund shall be subject to a biennial audit by the state auditor. SECTION 2. Section 3 of chapter 40A of the General Laws, as appearing in the 1988 Official Edition, is hereby amended by inserting after the second paragraph the following paragraph: - No zoning ordinance or bylaw in any city or town shall prohibit, or re -1 quire a special permit for, the use of land or structures, or the expansion of existing structures, for the primary, accessory or incidental purpose of oper- ating a child care facility; provided, however, that such land or structures , , % H 1772 may be subject to reasonable regulations concerning the bulk and height of structures and determining yard sizes, lot area, setbacks, open space, parking and building coverage requirements. As used in this paragraph, the term "child care facility" shall mean a day care center or a school age child care program, as those terms are defined in section nine of chapter twenty-eight A. SECTION 3. Said chapter 40A is hereby further amended by inserting after section 9B the following section: - Section 9C. As used in this section, the term "child care facility" shall mean a day care center or a school age child care program, as those terms are defined in section nine of chapter twenty-eight A. When any zoning ordinance or bylaw in any city or town limits the floor area of any structure, such floor area shall be measured exclusive of any por- tion of such structure in which a child care facility is to be operated as an accessory or incidental use, and the otherwise allowable floor area of such structure shall be increased by an amount equal to the floor area of such child care facility up to a maximum increase of ten per cent. In any case where the otherwise allowable floor area of a structure has been increased pursuant to the provisions of this section, the portion of such structure in which a child care facility is to be operated as an accessory or incidental use shall not be used for any other purpose,unless, following the completion of such structure, the board authorized to grant variances under such zoning ordinance or bylaw shall have determined, with the written concurrence of the office for children, that the public interest and convenience do not require the operation of such facility. The procedures governing the granting of var- iances, including all rights of appeal, shall apply to any such determination. The.owner of a building as to which the allowable floor area has been in- creased pursuant to this section shall be allowed to charge the operator of the child care facility for the following: the cost of utilities used by the child care facility, a reasonable building operating fee for the costs of maintenance, cleaning and security, and real estate taxes for the portion of the building which is the child care facility, if such facility is operated by a for-profit provider. The owner shall not impose a charge for the cost of alterations necessary to meet the requirements of the office for children• re-. garding the physical facility of a day care center. Any person operating a child care facility in a portion of a structure which is to be used only for such purpose pursuant to the provisions of this section shall use best efforts H 5772 to assure that at least fifty per cent of the children utilizing such facility are from families whose income is not more than one hundred and ten per cent of the median family income of the commonwealth. SECTION 4. Paragraph (1) of section 1 of chapter 40D of the General Laws, as appearing in the 1988 Official Edition, is hereby amended by inserting, in line 70, after the word "facility.", the following sentence:- Industrial en- terprise shall also include the operation of a day care center or a school age child care program, as those terms are defined in section nine of chapter twenty-eight A. SECTION 5. Chapter 59 of the General Laws is hereby amended by inserting after section 3E the following section: - Section 3F. For the purpose of this chapter and any other general or spe- cial law classifying real property for the purpose of taxation and in order to assist in the provision of child care, cities and towns shall classify that portion of any such property operated as a child care facility pursuant to section nine C of chapter forty A in the same category as property used or held for human habitation. SECTION 6. Chapter 231 of the General Laws is hereby amended by inserting after section 85X the following section: - Section 85Y. Notwithstanding any general or special law to the contrary, the owner of any property containing. premises operated by a person other than such owner as a child care facility shall not be subject to any claim, liabil- ity or penalty arising from or based upon any injury to person or Loss or dam- age to property sustained or occurring on or about such premises unless such injury, loss or damage is proximately caused by the negligence or misconduct of such owner or its agents, contractors or employees. This section shall not be deemed to limit or otherwise modify the provisions of any lease or other contract between such owner and the operator of such child care facility. As used in this section, the term "child care facility" shall mean a day care center or a school age child care program, as those terms are defined in sec- tion nine of chapter twenty-eight A. SECTION 7. A qualified employer, as used in this section, shall mean an employer who has established, in accordance with the applicable requirements of section one hundred and twenty-nine of the Federal Internal Revenue Code of 1986, or any successor section, as amended and in effect for the taxable year, either a dependent care assistance program or a cafeteria plan whose benefits H 5772 include a dependent care assistance program. On or before July first, nine- teen hundred and ninety-one,,the commonwealth and every authority established as a body politic and corporate and constituted as a public instrumentality of the commonwealth, shall meet the requirements of a qualified employer as de- fined herein. On or after September first, nineteen hundred and ninety-one, no contract for goods and services of any type shall be awarded by the common- wealth or any such authority to an employer having fifty or more employees un- less such employer is a qualified employer, or offers child care tuition as- sistance or on-site or near -site subsidized child care placements except in cases of special emergency certified by the governor to involve the health or safety of the people or their property. The office for children shall by reg- ulation specify minimum standards for child care tuition assistance and on- site or near -site subsidized child care placements as used in this section. The secretary of administration and finance shall prepare a plan to implement the provisions of this section. Such plan shall be transmitted to the senate and house committees on ways and means no later than May first, nineteen hun- dred and ninety-one. SECTION S. On or before July first, nineteen hundred and ninety-one, the division of capital planning and operations shall compile a list of sites and structures owned or leased by the commonwealth suitable for the operation of a child care facility. Said list shall be filed with the senate and house com- mittees on ways and means. SECTION 9. Notwithstanding any general or special law to the contrary, the term "any city or town" as used in sections two and three of this act and the term "cities and towns" as used in section five of this act shall include every city and town of the commonwealth.
