All erosion prevention and sedimentation protection measures found necessary during construction shall be implemented at the direction of the NACC. The NACC reserves the right to impose additional conditions on portions of this project to mitigate any impacts which could result from site erosion, or any noticeable degradation of surface water quality discharging from the site. Sincerely Yours, Brian Leathe Local Building Official O `' ;<=Ontlme.Dnneright" July 9, 2015 Brian Leathe 1600 Osgood St. Bldg. 20, Ste 2035 North Andover, MA 01845 Re: Deck modifications Mr Handyman of North Essex County My Handyman of Rockingham County 60 Pine St. Unit I Methuen, MA 01844 978-521-0042 Hi Brian, I am writing today in regard to my client, Dr. Tom Murtha's deck modifications at his residence located at 95 Old Cart Way and the subsequent request to stop work on his deck modifications due to permitting. It is my understanding that a deck that is lower than 30 inches and less than 200sf in dimension did not require a building permit. If I am incorrect in my interpretation of the building code please let me know. In 2008 & 2011 Dr. Murtha hired my company to repair the rear deck stairs due to extensive wood rot, the deck had been previously rebuilt by the former owners prior to Dr. Murtha's purchase of the home back in 2003 as well. It is my opinion that the wood rot that is taking place is a result of the location of the stairs and the overhead roof lines and valleys. During rains and snow the location is saturated by water and snow. The impending result is an extremely wet location that does not benefit from long amounts of sun and never really dries promoting the rot. Dr. Murtha had requested a more permanent solution to the issue due to the rear deck exit being the only other direct means of egress from the home and his concern for family safety. His only other means of egress from the house would be through his garage which is not an excepted means of egress. Dr. Murtha's feeling is that having to continually replace and/or repair the staircase on an approximate 4 year cycle has become a hazard and the structural integrity of this stairway directly impacts the safe, direct and timely egress from the house in the event of a fire or other emergency circumstance. The alternative proposed to Dr. Murtha and decided upon was to relocate the staircase to the front portion of the deck away from the corner where it is presently located. This is not Dr. Murtha's preferred location but based on the overall layout of the home and location this was his only good location. At the same time it was decided to extend the deck to surround an existing hot tub that was there. And while I had initially intended to apply for a permit to erect a sign in front of our house to advertise my business to the public, I have recently decided against erecting a sign and have decided it would be more in keeping with our neighborhood to simply put up just an address post and plaque. The enclosed photocopy of the address post and plaque are tactual items we wish to purchase (from "FRONTGATE", a catalogue of strictly r ntial products available to home owners nationwide). The company insists that it ' t ne `ary in most areas of the country to obtain permitting for this product and any Oise -owner may install an address post on their property if they wis owever, we JWwanted to run this by you and get your ok, before making any assum ns oq-reatiq&ny issues or problems with the town or your office. I am a seamstress/fashion designer and also provide special event planning services (primarily weddings). In terms of my clientele and traffic to and from our home, this in-home business would be a relatively low volume type of business, with from zero to several client visits on average per week. There may be times of the year (May through September) when, as an event draws nearer, I might have several client visits on a given day. Although I realize it is separately permitted, ideally I would like also to have a tastefully done sign (probably a wood -carved sign mounted on arched white brick) installed at the entranceway to our driveway. I wish to thank you for your time and assistance in this matter and look forward to hearing from you. Sincerely Isabe1j_opez RECEIVED MAR 2 1 2005 BUILDING DEPT. Further Evaluation is Required by the Board of Health: Conditions exist which require further evaluation by the Board of Health in order to determine if the system is failing to protect public health, safety or the environment. 1. System will pass unless Board of Health determines in accordance with 310 CMR 15.303(1)(b) that the system is not functioning in a manner which will protect public health, safety and the environment: — Cesspool or privy is within 50 feet of a surface water _ Cesspool or privy is within 50 feet of a bordering vegetated wetland or a salt marsh 2. System will fail unless the Board of Health (and Public Water Supplier, if any) determines that the system is functioning in a manner that protects the public health, safety and environment: _ The system has a septic tank and soil absorption system (SAS) and the SAS is within 100 feet of a surface water supply or tributary to a surface water supply. The system has a septic tank and SAS and the SAS is within a Zone 1 of a public water supply. T The system has a septic tank and SAS and the SAS is within 50 feet of a private water supply well. The system has a septic tank and SAS and the SAS is less than 100 feet but 50 feet or more from a private water supply well". Method used to determine distance "This system passes if the well water analysis, performed at a DEP certified laboratory, for coliform bacteria and volatile organic compounds indicates that the well is free from pollution from that facility and the presence of ammonia nitrogen and nitrate nitrogen is equal to or less than 5 ppm, provided that no other failure criteria are triggered.
