As discussed, the shed was built at the beginning of May, 2003 and the builders mistakenly erected it according to the original plans (submitted October 7, 2002, denied October 11, 2002) and not the re -submitted approved plans (submitted October 23, 2002, approved November 4, 2002). In accordance with your order dated July 8, 2003, the shed has been moved to a new location outside of the 50' No -Build Zone to an area approximately 60' from any Wetlands area and, it is my understanding, that this is an acceptable new location even though it is not the same location as is indicated on the re -submitted approved plans. Also, I want to reiterate my concern about the erection of a Gazebo by our abutters at the rear of our property, which Gazebo was built very close to a pond (approximately 5- 20') that is back there. This was built within the past year and I had pointed it out to you when you came out to the property in October, 2002 and we have had several conversations regarding that Gazebo since. I have been informed that no permit or variance was .obtained for the erection of that Gazebo and I understand that it was erected after the property owners (I believe their name is Chatterjee) had previously received a fine for building an illegal swimming pool and had previously, without permission, cleared out a large amount of vegetation around the pond and were notified that they should not have done so. In the interest of both conservation concerns and consistency, I feel that they should be required to move the Gazebo to a legal location and should receive a fine reflective of their knowing circumvention of the North Andover Wetlands Protection Bylaws and the Wetlands Protection Act. As previously expressed, I would appreciate if it was not disclosed to them that we are the reporters of this violation given that they are our neighbors. Dear Ms. Kozol: On July 3, 2003 this Department visually observed an unauthorized newly constructed structure, specifically a shed, located within the 50 -foot No -Build Zone of a protected resource area enforced under Section III (D)(4b) of the North Andover Wetlands Protection Bylaw. Any work or structures proposed within 100' of a Bordering Vegetated Wetland (BVW) is subject to a Request for Determination of Applicability (RDA) or Notice of Intent (NOI) filing with the North Andover Conservation Commission (NACC) pursuant to the Wetlands Protection Act (The Act) and the North Andover Wetlands Protection Bylaw (The Bylaw). Our records indicate that you were not approved to place the shed in its current location as determined by this Department. A building permit for the shed was completed and submitted to the Building Department sometime in October of 2002 and subsequently denied on October 11, 2003 by this department. I have included a copy of this building permit application for your records. `'Furthermore, I have record of and. recall meeting with a man (Eric Kozol?) on October 18, 2002 at your property to determine a suitable location for the shed. I remember spending a significant period of time during this meeting. and thought I made it clear that the shed could not be within 50' of 4he wetland resource area. In lieu of the above violation, this Department mandates the removal of the shed by no later than July 21, 2003. The structure must be relocated out of the 50' No Build Zone. Please refer to the enclosed Enforcement Order. You are also required by the Building Department to obtain a building permit upon approval by this Department.
