Description of relief sought on this petition Petitioner seeks relief from side yard setback requirement of 30 feet Deed recorded in the Registry of Deeds in Book 1036 Page 347 or Land Court Certificate No. Book Page The principal points upon which I base my application are as follows: (Must be stated in detail) Upon a refinancing of subject premises the mortgagee bank required a plot plan which disclosed the present sideyard deficiency. Relief may be granted without substantial detriment to the public food and without nullifying or sub- stantially derogating from the intent or purpose of the by-laws and a literal enfacement of the by-laws would involve substantial financial hardship to petitioners. These forms shall be furnished by the clerk upon request. Any communication purporting to be an application shall be treated as mere i"otice of intention to seek relief until such time as it is made o,n the official application form. All in- formation called for by the form shall be furnished by the applicant in the manner therein prescribed. Every application shall be submitted with a list of "Parties in Interest" which list shall include the petitioner, abutters, owners of land directly opposite on any public or private street or'way, and abutters to the abutters within three hundred feet of the property line of the petitioner as they appear on the most recent applicable tax list, notwithstanding that the land of any such owner is located in another city or town, the Planning Board of the city or town, and the Planning Board of every abutting city or town. * Every application shall be submitted with an application charge cost in the amount of $25.00. In addition, the petitioner shall be respon- sible for any and all. costsinvolved in bringing the petition before the Board. Board of Appeals • NORTH DANIEL LONG F T0W-�j «RI' N0 SACMUS JAN 20 12 oo pm'83 TOWN OF NORTH ANDOVER MASSACHUSETTS BOARD OF APPEALS January 18, 1983 Richard Hillner 96 Farnum Street Petition No. 4-'83 Mr. Daniel Long, Town Clerk Town Office Building North Andover, Mass. 01845 Dear Mr. Long: The Board of Appeals held a public hearing on Monday evening, January 10, 1983 upon the application of Richard and Judith Hillner. The hearing was advertised in the.North Andover Citizen on December 23 and 30, 1982 and all abutters were notified by regular mail. The following members were present and voting: Frank Serio, Jr., Chairman; Richard J. Trepanier, Esq.., Clerk; Augustine W. Nickerson; Maurice S. Fouldst and Walter F. Soule. The petitioner seeks a variance from the provisions of Section 7, Paragraph 7.3 and Table 2 of the Zoning By Law as it relates to setbacks to allow relief from the side yard setback requirement to allow the continued existence of a dwelling located at the North side of Farnum Street and known as 96 Farnum Street. The petitioner testified through counsel that the dwelling was constructed in 1965 and when a recent plot plan was required by the bank to secure a mortgage, it was discovered that the dwelling, and more specifically a deck, did not meet the require- ments of the Zoning By Law. Upon a motion made by Mr. Foulds and seconded by Mr. Nickerson, the Board voted to grant the variance as requested. The Board finds that each of the provisions of Section 10:9 of the Zoning By Law have been satisfied.
