Dear Mr. Long:
The Board of Appeals held a public hearing on Tuesday evening, January
14, 1986 upon the application of Paul W. & Marlaine H. Aufferman. The
hearing was advertised in the North Andover Citizen on December 19 and
on December 24, 1985 and all abutters were notified by recr.,'ar mail.
The following members were present and voting Ms. ,Anna O' ;r,
alternate;: Frank Serio, Jr., Chairman, Alfred Frizelle, , Vice-
chairman, Augustine Nickerson, Clerk,
The petitioners seek a variance from the provisions of Section 7,
Paragraph 7.1, 7.2, 7.3"and Table 2 of the Zoning By Law so as to
permit relief from the 41 required area, frontage and set back require-
ments of the by law and to create a buildable lot.
Upon motion made by Mr. Frizel.le and seconded by Mr. Nickerson to
grant this variance but when vote taken it was not unanimous.. In
order to grant a petition for a variance or an appeal, four (4) of
the five (5) members of the Board mi4st concur. There were three (3)
affirmative votes and one (1) negative, therefore petition was DENIED
Section 10, Paragraph 2 of the Zoning By=Laws.

The principal points upon which I base my application are as follows:

The variance would permit use of the property which is fullv harmonious
with the neighborhood. The property cannot be developed without the
variance, which presents a substantial hardship to the applicant. -The
variance can be granted without detriment to the public good or substantial
derogation from the intent or purpose of this By Law.

Every application for action by the Board shall be made on a form approved
by the Board. These forms shall be furnished by the Clerk upon request.
Any communication purporting to be an application shall be treated as mere
notice of intention to seek relief until such time as it is made on the
official application form. All information called for. by the form shall
be.furnished by the applicant in the manner therein prebcribed.
Every application shall be submitted with a list of "Parties In Interest"
which list shall include the petitioner, abutters, owners of land directly
opposite on any public or private street or way, and abutters to the
abutters within three hundred feet (300') of the property line of the
petitioner as they appear on the most recent applicable tax list,
notwithstanding that the land of any such owner is located in another city
or town, the Planning Board of the city or town, and the Planning Board of
every abutting city or .town.
*Every application shall be submitted with an application charge cost in
the amount of $25.00. In addition, the petitioner shall be responsible
