Updated letter: Re: Selective cutting of several dead and dying trees within the buffer zone
to wetland resource areas.
This is an updated letter which will allow the work outlined below to be completed this
winter during frozen ground conditions. Sufficient frozen ground conditions were not
achieved during the winter of 2011-2012. Therefore, this updated letter serves to allow the
remaining tree work to. occur during frozen ground in the winter of 2012-2013. Several trees
that were accessible from the driveway were removed and this letter serves to allow the
remaining permitted trees to be removed.
On June 17, 2011 a letter was issued pertaining to your request to remove several large dead
and/or dying trees that are within the buffer zone to a wetland resource area at Peachtree Farm
Condominiums located on Rea Street in North Andover, MA. An initial site visit was conducted
by the conservation department staff on May 11, 2011 to discuss the desire by the homeowners
to remove dozens of trees along the east property boundary. At that time a discussion ensued
regarding the procedures to remove trees which do not pose a hazard or danger and that they
would need to file with the North Andover Conservation Commission (NACC). However
several trees were identified that are dead or dying and pose a hazard. These trees were
identified to the conservation staff by Mr. Lowery during a site visit on May 20, 2011. The trees
that are permitted to be removed were marked with red tape wrapped around the trunks. The
trees that were identified for removal are all dying or dead and are in close proximity to the
driveway and homes at Peachtree Farm Condos. It was determined that the trees are within the
jurisdiction of the NACC. Some of the trees are located within the 25' No -Disturbance Zone and
some are located outside of the 25' No -Disturbance Zone pursuant to the North Andover
Wetlands Protection Bylaw (C. 178 of the Code of North Andover). Removal of vegetation,
including pruning and cutting, is prohibited within the No -Disturbance Zone except in rare
circumstances, such as safety. The trees identified for removal are not healthy and pose a
danger.

The Conservation Department will permit the removal of the above referenced trees in order to
prevent possible injury or property damage. These cutting activities shall be limited to the trees
identified during the site visit and as outlined in this letter. The trees to be removed shall be
marked prior to removal and the conservation department shall be contacted to conduct a site
visit to confirm the trees to be removed prior to any cutting activities. Any additional tree
removal will require a filing with the North Andover Conservation Commission.
The approved cutting will be subject to the following conditions:
•o• Prior to tree removal the trees to be removed shall be clearly marked and the conservation
department shall be contacted for a site visit to confirm the trees that are permitted to be
removed.
•e• The work approved in this letter shall be completed by March 31, 2013, to allow work to be
completed under frozen ground conditions.
•o• No machinery shall enter the 25' No Disturbance Zone.
•e• No work shall occur in resource areas.
•o• All tree limbs, brush, and other debris materials shall be taken off site and disposed of
properly.
•a• Stumps of the trees shall not be removed and shall be left in place. Stumps may be ground
down or cut flush with the landscape.
•o• Care shall be taken to prevent damage to surrounding trees during removal of the approved
trees.
•m• All trees are assumed to be on the property of the Peachtree Farm Condominiums; however
determination of property boundaries and ownership is the responsibility of the
homeowners at Peachtree Farm Condominiums.
•e• Upon completion of the tree removal, all disturbed areas shall be properly stabilized.
•o• The applicant shall notify this department immediately following completion of work for a
final site inspection.
•v Areas within 100 -feet of wetland resource areas shall remain in a natural state and no further
vegetation shall be removed without the prior approval of the Conservation
Department/ Commission.

RE: Selective cutting of several dead and dying trees within the buffer zone to wetland
resource areas.
This is a follow up letter pertaining to your request to remove several large dead and/or dying
trees that are within the buffer zone to a wetland resource area at Peachtree Farm
Condominiums located on Rea Street in North Andover, MA. An initial site visit was conducted
