NAME: Michael Quinn d/b/a Dunkin Donuts DATE: 12/10/97 ADDRESS: 982 Osgood St. PETITION: 038-97 North Andover, MA 01845 HEARING: 12/9/97 The Board of Appeals held a regular meeting on Tuesday evening, December 9, 1997 upon the application of Michael Quinn, d/b/a Dunkin Donuts, 16 Golden Meadow Rd, Hampstead, New Hampshire, 03841, requesting a Special Permit (party aggrieved) for said premises located at 982 Osgood St., North Andover, MA from the requirements of Section 6.6 (D) , Paragraph 2, for a sign permit of the Zoning Bylaws. The following members were present: William J. Sullivan, Raymond Vivenzio, Scott Karpinski, Ellen McIntyre, John Pallone. The hearing was advertised in the Lawrence Tribune on 11/4/97 and 11%10/97, and all abutters were notified by regular mail. Upon a motion made by Raymond Vivenzio, and seconded by Ellen McIntyre, that the Board uphold the decision of the Building Commissioner and deny the party aggrieved based upon the findings that the current bylaw restricts identification signs to 25 sq. ft. on any modification. Voting was unanimous: William J. Sullivan, Raymond Vivenzio, Scott Karpinski, Ellen McIntyre, and John Pallone. Upon a motion made by Raymond Vivenzio, and seconded by John Pallone, the Board of Appeals granted a Special Permit to allow the existing sign height, and a new sign with the total allowed of 55 square feet, 36 square feet allowed to the gas station. That the sign not be internally illuminated, and the sign be externally lighted in conformity with the current lighting requirements for external illumination. That the remaining 19 square feet can be divided up according to the owner of the lot and his lease with tenants. On the condition that all other signs cin the lot, not otherwise allowed by the Bylaws as determined by the Building Commissioner be removed. Voting in favor. William J. Sullivan, Raymond Vivenzio, Scott Karpinski, John Pallone. Opposed: Ellen McIntyre. The petitioner has satisfied the provision of Section 10, paragraph 10.4 of the Zoning Bylaw and that the granting of these variances will not adversely affect the neighborhood or derogate from the intent and purpose of the Zoning Bylaw. Note: The granting of the Variance and/or Special Permit as requested by the applicant does not necessarily ensure the granting of a Building permit as the applicant must abide by all applicable local, state and federal and building codes and regulations, prior to the issuance of a building permit as _ requested by the Building Commission.
