HomeMy WebLinkAbout1974-05-13Monday - May 13, 1974 Regular Meeting & i Hearing The BOARD OF APPEALS held its regular meeting on Monday evening, May 13, 1974 at 7:30 P.M. in the Town Office Building meeting room. The following members were present and voting: Frank Serio, Jr., Chairman; Dr. Eugene A. Beliveau, Clerk, Louis DiFruscio and Associate Members Alfred E. Frizelle, Esq. and James D. Noble, Jr. There were 20 people present for the meeting. HEARING: Joseph Quartaroneo Dr. Beliveau read the legal notice in the appeal of Joseph & Marilyn ~Quartarone requesting a Special Permit under Sec. 4.122 (1~) of the Zoning By-Law so as to permit the conversion of an existing structure into a three family dwelling; on the premises located at the corner of Middlesex St., Herrick Road and Chapin Road and known as 150 Middlesex Street. ~ Mr. Quartarone, Sr. spoke for his son, who was also present. He feels that this is a good thing for the town and for the neighbors in the area. He said the building was erected by Mr. Rockwell and used as a young men's club for many years; then the American Legion used it for meetings, etc.; other organizations used it and it was rented for weddings and parties. Recently it was a private school for youngsters until there was a fire in 1973. Mr. Quartarone purchased the property on May l, 1974 with the intent to convert it into a three family dwelling, which seems to be the most economical and feasible use of the structure. This lot contains 30,980 sq. ft.; 12,500 sq. ft. is required. It could be divided into two lots and each lot could have a two family dwelling without having to obtain a special permit but they feel this is the best use of the building. The building is structurally sound. There were be no exterior changes, only new windows and doors. There would be two two-bedroom apartments and one one-bedroom apartment. Richard Schafer, an immediate abutter to the rear, spoke in favor of the conversion. It would be an asset to the neighborhood and would conform to other homes in the area. Blain Saunders, ChapinRd., directly across the street, was very much in favor of the conversion for the same reasons. Building Inspector Charles Foster said that this area has had problems in the past in the uses that had been put to it. Some use should be made of the structure because of the fire, rather than leave it to deteriorate; it is still structurally sound. Mr. Serio read the letter from the Planning Board which stated they felt the con- version was a good use of the property. Discussion was held as to the previous uses of the building and if it could legally be called a dwelling. There is plenty of parking area to meet parking requirements. Mr. Foster said the conversion would have to meet all building requirements, fire walls, fire protection, etc. There was no opposition to the petition. Dr. Beliveau made a motion to take the petition under advisement; Mr. Noble seconded the motion and the vote was unanimous. May 13, 1974 - cont. HEREFORD CORP. Dr. Beliveau read the notice that was sent to all abutters upon the request of Hereford Corp. to amend their special permit for earth removal so as to allow a crusher to operate in the pit in Order to dispose of the large stones. Atty. John J. Willis appeared for the petitioner. Mr. Valente~was also present. Mr. Willis said there is a question that there was actually a need to go about it this w~y but Mr. Valente feels that the people in the neighborhood should be aware of what is going on. A stone crusher is a part of an earth removal operation. There are large stones in the area. Mr. Valente has tried to clean up the area since he took over the operation. He is under bond so that there is control by the Board. They will work under any limitations theBoard wishes to set as to time, etc. This could be done on a trial basis. Rental of the equip- ment is expensive. Mr. Valente said the minimum rental time is for ~ months at $12t000 per month. Harry Thomas, an immediate abuttert had many questions and was very concerned as to blasting, drilling, dust~ noise, etc. Mr. Valente said the crusher would be 2,000 feet in off the road. Everything will be processed at once to make gravel. Several residents and abutters were present and complained about the noise that would be connected with the operation and the possible length of td~e*c~ the~ operation. They said this was supposed to be a residential area but it would now become heavy industry with the use of such equipment. Those speaking were; John Murphy, Norman Tardie, Mr. Sztucinski, Mrs. Donovan. Bldg. Insp~ Foster said Mr. Valente has been rurnuing a good operation; better than anyone did before him. Chairman Serio explained that this operation is a year to year thing.when they come in for renewal and they have to operate it properly or the Board will not renew it. Highway Surveyor William Cyr asked if a notice of intent would have to be filed for filling and dredging. Atty. Willis doesn't think wetlands would be involved. He is not filling in any wetland or altering the flow of water. The Board took the matter ~nder advisement and will get a ruling from Town Counsel as to the use of the stonecrusher. TREMBLY BROS., INC. - Decision The Bo~rd discussed the Trembly petition for which a hearing had been held last month. They compared the current petition with the petition for the special permit that was granted for the new service station. Lengthy discussion was held. Dr. Beliveau made a motion to send a letter to the petitioner allowing him to withdraw without prejudice and submit documents to prove that one lot was in separate ownership from the corner lot at the time of the original application, including all transfers of land, deeds, etc. And to apply under the proper sections of the by-law, including Section 6.1. Also, correct the plot plan to show the ownership of the lots. Mr. Frizelle seconded the motion and the vote was unanimous. May 13, 197~- cont. LETTER FROM BOARD MEMBER WM. SALF~E: A letter was received from Appeals Board member William Salemme stating his views relative to iow income housing and the petition of the Archdiocese of Boston. Chairman Serio read the letter to everyone present. ~. Frizelle made a motion to accept the letter; Dr. Beliveau seconded the motion and the vote was bU~OUS. NOTICE OF HOUSING APPEALS COMMITTEE HEARINg: Member Atty. Alfred Frizelle informed the Board that the Housing Appeals Committee set a preliminary date for the appeal of the Board's decision by the Archdiocese of Boston. The hearing will be held on May 22~ 1974 at 10:30 A.M. at 141 Milk Street, Boston. MISCELLANEOUS: A letter will be sent to Town Counsel for legal advice on the following three problems: 1. Ask whether a stonecrusher can be used in an earth removal operation. 2. Advice as to the town's security on the$15,000 bank book being held on the Watson earth removal operation. 3. Does the Board have the authority to a conversion if it is not adwelltug or should a variance be given from the word "dwelling". The meeting adjourned at 10:30 P.M.  ~~ .......
