Dear Mr. Long:
The Board of Appeals held a hearing on Monday evening, June 10,
1985 upon the application of Coolidge Construction Co., Inc..
The hearing was duly advertised in the North Andover Citizen on
May 23, and May 30, 1985 and all abutters were notified by re
gular mail. The following Board members were present at the pub-
lica hearing and again on June 26, 1985, when the Board renderdd
its decision: Frank Serio, Jr., Chairman; Alfred E. Frizelle, Esq.,
Vice -Chairman; Augustine W. Nickerson, Walter F. Soule, and Ray-
mond Vivenzio, Esq.
The Petitioner .seeks a Special Permit under Section 4, Paragraph
4.133 of the .Zoning By -Law so as to permit the construction of a
dwelling within 100 feet of a tributary to Lake Cochichewick on
the premises, .located at the south side of Dale Street, known as
Parcel 2B, Lot 3A, Dale Street.
Mr. Joseph Cushing of Kaminski Associates, Project engineer, made
the presentation on behalf of the Petitioner.
The Plan for development of the area: was previously before the
Board and have received Special Permit for 2 lots from the Plan-
ning Board and an order of condition from the Conservation Commis -
tion. The dwelling will be tied into the sewer and run along the
shoulder of Dale Street to Marbleridqe Road. The Petitioner has
placed the dwelling on the plan to achieve the maXimum distance
from the 100 -foot setback line. The.Plan shows a dwelling 28' by
68' with the driveway on the side within the 100 -foot area.
A letter received from Ethel and Hannah Stork and Mary Hart voiced
opposition to the proposal. Mr. Rene Fugere also voiced opposition.
On a motion by Mr. Frizelle seconded by Mr. Vivenzio, the Board
voted unanimously to grant a Special Permit under Section 4, Para-
graph 4.133 of the Zoning By -Law subject to the following condi-
tions:
1. The dwelling be reduced to 28' by 44' and the
driveway be located in the front of the dwell-
ing and not on the East side as shown on the
Plan. Tt is the intent not to show a "dog leg"
type drive, but a direct entrance to the dwell-
ing from Dale Street.
2. The sewer line on Dale Street must be installed
and completed with certification from the Board
of Public Works that all work for the sewer line
to the dwelling has been completed prior to the
issuance of a building permit for the proposed
dwelling.
3. The Plan be -revised to show the conditions set
forth herein.
The Board finds -that the provisions of Section 10.31 have been
satisfied by granting the Special Permit with conditions The
Board has attempted to keep the dwelling as far from the tribu-
tary as possible. The fact that the dwelling will be tied to
the town sewer has influenced the Board, keeping in mind the re-
cent Town Meeting action and the pending environmental study of
the Lake.
