In brief, pursuant to Section 8.9, s.10 "Guyed towers, lattice towers and monopoles in existence at the time of adoption of Section 8.9 of the by-law may be reconstructed, altered, extended or replaced on the same site by Special Permit, provided that the Special Permit Granting Authority (SPGA) finds that such reconstruction, alteration, extension, or replacement will not be substantially more detrimental to the neighborhood and/or the Town than the preexistent non conforming structure". I am of the opinion that pursuant to the referenced section the SPGA can not allow a "sister tower" within the site. Zoning Interpretation Dear Mr. Nicetta, At the suggestion of town officials, I am writing to you for an interpretation of the current Wireless Service Facility Bylaw located at section 8.9 (page 129) of the North Andover Bylaws. I Back rg oun'd As you may be aware, SBA Inc. owns the 153 -foot telecommunications tower located at 300 Chestnut Street, North Andover. Recently, multiple carriers seeking space on this facility have approached our company. However, the tower as it currently stands cannot adequately accommodate these carriers, nor anticipated future carriers, without expansion of some type. As a consequence of this current carrier demand, SBA, Inc., in cooperation with three separate telecommunications carriers, prepared two alternative expansion proposals that it wishes to bring before the Town. II.Proposals The first option is for SBA, Inc. to install a 153' sister tower within the same site compound while simultaneously enhancing the existing tower. The second proposal is to dismantle the existing tower altogether and replace it with a new 190' structure on the same site. In both cases, SBA, Inc. proposes expanding the existing ground space to accommodate the cabinets and equipment of the future carriers. Upon review of the site and upon a previous discussion with you and Richard Hogan, GLSD Executive Director, I agree that the installation of the sensors in the locations as proposed could result in an emergency situation if not installed immediately. The attached Enforcement Order is being issued to allow the excavation of 5 test pits at the approved locations for the installation of the sensors along the pipe. Although, it is my understanding that only 3 of the 5 test pits are within 100' of a protected resource area and that the closest test pit to a resource area is approximately 40 feet. In as such, all work must be conducted in accordance with the submitted letter, memorandum, and plans. It is anticipated that the work will be conducted over a 2-3 day period. In addition, the following conditions must be adhered to as required under this Enforcement Order: 1. Prior to the commencement of work activities, erosion controls consisting of staked haybales and trenched silt fence must be properly installed around each test pit area which falls within the 100 -foot buffer zone to a protected wetland resource area. Upon installation of said erosion controls, the Conservation Department shall be contacted for a site inspection. The flagging was located by CDM's professional wetlands scientist (PWS) yesterday. Attached to the drawings is a CDM memorandum, dated November 18, 2004 that covers the environmental protection measures that will be used during test pit excavations for the installation of the acoustic sensors. The test pits are located along the side of our access roadway in the grassed shoulder and will measure approximately 5' by 5' by 5' deep. Each test pit will only be open for 1-1/2 days each and all test pits will be completed with a two week period. Hay bales with silt fences will encircle each test pit location and no excavated soil will be stored at the test pit location. We deo have some leeway in the locations of these test pits, so if you request any test pit location to be This evaluation is critical to establishing the existing condition of this pipeline. The following precautions will be taken for environmental protection during the work: ■ No excavated soil will be stored within the limits of the work, soil will be stored off site in a controlled area of the GLSD WWTP facility and covered with a secured plastic sheet; ■ A silt/ sediment fence and hay bales will be installed at the limits of the work and will not be removed until all disturbed areas are stabilized; Vehicles will not be maintained or refueled within any wetland resource area or 100 -ft buffer zone; and ■ A supply of "speedy dry", and oil absorbent pads will be maintained with the excavation equipment at all times in the event of accidental release of petroleum products during the field work. ■ Covering all staged, excavated soil with a secured plastic sheet if the soil will be stockpiled for more than four hours; and ■ Existing contours will be restored to the extent possible and disturbed areas will be reseeded or repaved as appropriate. Although it is unlikely that dewatering will be necessary, in the event that high groundwater is encountered during excavation, water will be discharged to adjacent upland areas after removal of sediment through a Baker tank. Also submitted with this request letter was a Memorandum from Keith Poulin of Camp Dresser & McKee (CDM) outlining specific environmental measures to be followed during related work activities and associated plans entitled, "Greater Lawrence Sanitary District Water Pollution Abatement Facilities", showing the locations of the test pits and the resource areas. On Friday, November 19, 2004, I conducted a site inspection with yourself and a representative of CDM to review the route and to determine further additional conditions necessary for work to proceed under this emergency nature. Upon review of the site and upon a previous discussion with you and Richard Hogan, GLSD Executive Director, I agree that the installation of the sensors in the locations as proposed could result in an emergency situation if not installed immediately. The attached Enforcement Order is being issued to allow the excavation of 5 test pits at the approved locations for the installation of the sensors along the pipe. Although, it is my understanding that only 3 of the 5 test pits are within 100' of a protected resource area and that the closest test pit to a resource area is approximately 40 feet. In as such, all work must be conducted in accordance with the submitted letter, memorandum, and plans. It is anticipated that the work will be conducted over a 2-3 day period. In addition, the following conditions must be adhered to as required under this Enforcement Order: Prior to the commencement of work activities, erosion controls consisting of staked haybales and trenched silt fence must be properly installed around each test pit area which falls within the 100 -foot buffer zone to a protected wetland resource area. Upon installation of said erosion controls, the Conservation Department shall be contacted for a site inspection.
