Mr. Bellavance,
Thank you for the response to my email. Please consider this a formal, written request to have my home re -inspected per
your letter. I canil be reached at 978-662-0532 to arrange for this inspection.
Below I've outlined issues I'd like examined at my home in North Andover. Where I've found a reference, I've noted the
section of the building code I believe to be relevant.
r"1361.8.4 Approval and Acceptance of HVAC, 1305.2.2 Calculation of Heating and Cooling Loads, J4.4.2
`Calculation of heating and cooling loads
No documents exist that show the heating and air conditioning equipment is adequate. I believe the upstairs furnace is
inadequate for the required heating and cooling loads. This was confirmed by a licensed heating and air conditioning
contractor.
1305.2.6 Ventilation, J3.3.1 Ventilation
The furnace airflow is also inadequate. I was told that the furnace was designed for a 2 -ton system. A 3 -ton coil and
condensing unit are being used.
3607.3.2 Weather -resistant sheathing paper, 1405.6.6 Building paper
Trim board was used on the front of the house. Tyvek paper was not used underneath. Litchfield claims in writing that it
had to be glued directly to the fiberboard. The manufacturer recommends nailing it.
3604.1.3 Drainage
The finished grade around the perimeter of the home is poor. Water is not draining away from the foundation, but towards
it.
1813.7 Site grading
In the driveway/garage area, I have photographs showing apx. 12" of standing water during a rain storm. This is a focal
point for drainage from our home and the neighbors.
1405.3.10 Flashings
Flashing is missing at various exterior openings and at the rear deck.
1405.4.2 Waterproofing
Entry points of the refrigeration lines into the home were inadequately sealed.
Unknown
Light switch to basement stairs placed behind frame, on door hinge side. This is a serious safety hazard.
1305.2.4:1 Temperature Controls
Programmable thermostats were not installed.
L 1305.2.8 -Duct and Plenum Insulation and Sealing
I believe the duct insulation in the basement is illegal (not at least R-5), per inspection from a licensed HVAC contractor.
1305.3.3 HVAC Equipment Performance Requirements
9/5/2006
I have reason
o belreve that the low -efficiency condensing units were not newly purchased, but rather stockpiled prior a
change in building code. Builder should provide invoices that show these were newly purchased and not stock -piled to
avoid the change in building code.
Unknown
Carbon -monoxide detectors were not installed anywhere in the home. 1 was told by this HVAC contractor that these
should have been hard -wired at furnace locations. Some of the homes on the street have them, some don't.
Thank you for your help in this matter.

Dear Inspector Brown:
In response to the copy of the email you forwarded to me sent from Mr. James Simpson,
280 Gray Street (Lot 1), dated Sunday, September 3, 2006, I want to assure you that we
are in the process of addressing all issues raised We have had contact with our HVAC
sub -contractor, Miller Mechanical, and asked him to research and respond to the items
relating to his contract. He is extremely confident that other than a need to make some
minor fan speed or balance adjustments or perform some other punch list type
corrections, that he is well within all building codes with regard to the mechanical
systems installed in the home. We have a meeting set up with him on Tuesday,
September 12, 2006 here at our office to review his data. It should be noted that he has
made numerous offers to return to the home to make such adjustments and the Simpsons
have refused access. As well, we are in the process of contacting the other sub-
contractors whose work is questioned here and we will review any such issues with each
of them.
It is interesting to note that as recently as Friday, September 1, 2006 the Simpson's met
with Ed Mangini from Pro -Home (our third party warranty management company) to
review their warranty repair items and many of the items listed in the email were not
mentioned as issues by the Simpsons to Pro -Home.
We will have a written response to you on each and every item mentioned no later than
September 15, 2006. We intend to resolve any issues that you feel warrant further
attention on our AarL /

which is gluing.
• Drainage: Upon inspection, it has been noted that two areas around the home
(under rear deck and front of house by garage) may need some re -grading to
maintain a positive slope of 1/2" per foot for a distance of six feet away from the
foundation. These two conditions will be remedied.
• Site Grading: A drain was installed in the corner of the driveway along with a
swale which runs between Lot 1 & Lot 2 to take water from the driveway. Both
the drain and swale were functioning properly at closing. It is possible that the
drain may need cleaning and we will check on that. We plan to top -coat their

driveway in the next few weeks and will shoot grades on the driveway with our
paving contractor and make any necessary adjustments to insure that the driveway
water flows to the swale and away from the garage doors.
• Flashings: Siding was removed and Mr. Simpson was shown the flashing of the
rear deck. A photo is enclosed.
• Waterproofing entry points of refrigeration line: Siding was replaced in this area
and these entry points should have been re -sealed. This will be remedied.
• Basement Light Switch: This is the first time this has been brought to our
attention. The Simpson's did an extensive electrical walk-thru with the electrician
prior to his beginning work. If it was not put in the designated location or is a
safety hazard, it will be remedied.
• Temperature Controls: Programmable thermostats are an upgrade item and were
not purchased by the Simpson's. This is not a building code requirement.
• Duct & Plenum Insulation: Miller Mechanical has installed the same insulation in
over 2,500 homes throughout 20 different communities in Mass. and NH, over the
20+ years in business. He is not aware of it being "illegal".
• HVAC Performance Requirements: Miller Mechanical installed brand new
equipment in the home. It was purchased and installed in 2005. On 1/1/06
manufacturers were no longer able to make l OSEER units; however, contractors
were allowed to purchase and install the l OSEER units until the supply was
exhausted.
• Carbon -monoxide Detectors: This was not a code requirement at time of closing
on 8/29/05. Some homes on the street may have them due to the fact that they
were built after the code change on 11/1/05.
Attached is a letter from Miller Mechanical on 4/24/06 with regards to the HVAC issues
and his willingness to take care of any homeowner concerns. He has not been allowed to
return to the home. Also attached is a letter from Mr. Simpson's HVAC consultant
which states that the second floor unit is in fact adequate to heat the second floor.
We have a formal "Builder Warranty Program" which is utilized in dealing with all
warranty claims. If the process is followed and the items claimed are legitimate we are
always willing and anxious to take care of them. However, in some cases, issues can
require more extensive review. Please advise us as to how you would like to proceed.
Sincere]

90 HIGH EFFICIENCY
UPFLOW
GAS FURNACES
The WeatherKing® 90 High Efficiency line of upflow gas fur-
naces are designed for utility rooms, closets, or alcoves.
Because of the low -profile 34 inch height, the 90RJ
model can be used vertically to satisfy most applica-
tions that traditionally call for a horizontal furnace.
The design is certified by the CSA.
Features
■ Low profile "34 inch" design is lighter and easier to handle
and leaves room for optional accessories.
■ Left or right side gas, electric, and condensate drainage
connections.
■ Integrated control board manages all operational functions
and provides accessory hookups for an electronic air
cleaner.
■ A slow -opening gas valve and a specially designed
inducer system make it one of the quietest furnaces on the
market today.
■ Textured galvanized steel cabinet with painted access
doors.
■ Optional indoor or outdoor combustion air. In addition,
combustion air may be piped to either the top or right side
of the cabinet on all upflow models. A special molded fit-
ting is provided to ease installation.
■ Control board diagnostics.
A variety of cooling coils and plenums designed to use with
the WeatherKing 90 gas furnaces are available as optional
accessories for air conditioning models.
M.F.U.E. (Annual Fuel Utilization Efficiency) calculated in accordance with Department of
Energy test procedures.

Re: Raised Panel Application
Land Developers
Quality Home Builders
Date November 3, 2005
James and Dawn, after reviewing, the Massachusetts Code Manual, consulting with the
manufacturer and distributor along with the new Building Commissioner (Gerald Brown)
it has been determined that these panels have been installed properly. The manufacturer's
representative was consulted prior to the installation of these panels and based on this
discussion the panels were glued directly to the sheathing. The supplier Bradco Supply
and the manufactures' of KLEER and Azek have supplied installation guidelines which
included gluing; " For best results, surfaces to be glued should be smooth, clean and in
complete contact with each other. " This should resolve this issue to all parties'
satisfaction.

Re: Simpson Residence Gray ,Street, N. Andover
Y
Gary,
In regards to the fax you sent me from Mr. Simpson, I personally have not
received any calls regarding heating problems at this residence. If there was
any concerns from the homeowner, you know that I would have taken care of
them immediately.
I would like to ask your office to arrange a sight visit, during normal
working hours, for the first week in May so that Mr. Simpson's concerns may
be addressed and then we can ga from there.
I will be seeing the N. Andover Building Inspector this week to bring this
matter to his attention.
Thanks,
Kevin J. Miller

J did the heat load calculations for the second floor of your house ,based on
the print you supplied to me, using Wrightsoft Manual J sof fare.
According to the software your second floor at 1126sq./ft requires o `umt--.vc
c tipu,: 40,1300$TUs, which is what you have now.
With. optinial duct design and the blower in the furnace set at the correct
.v?-r44M tills SiZe sys"ci Aouid LV Sii1. cieiii iL item 'y'titir SCctt[td floor
kequatcly.
Vj'you plan on finishing► the attic you will need to increase the furnace size
to the next bigger size furnace which would be 70,OOOBTU input/
561,0008TU output.
Right now the two biggest problems You hav, are:
(#i)- I believe your furnace is running on too high a fan speed in the heating
mode. That's why, you have cool air blowing out of some of the registers.
(#Z)- The exhaust piping on the downstairs furnace needs to be re -located
from where. it is now because it's blowing right on one the condensers,
which will rot that condenser out in 2 to.3 vears time_
**(The best place fc►r this re -location would be to the right ce your dryer
vera. Which would require an increase in exhuust pipe size to 3 "PVC)
*I feel you should try to resolve these issues with the Builder and the
original Installer while the systems are still within the lyr. warranty
period.
If you can't get resolution through the parties that you are warranded
with, Affordable Heat A Air will be more than glad to make any
improvemen[r you want made to your. heating A air conditioning systems.

You have provided me with an e-mail from James Simpson in which Mr. Simpson states:
"Is it illegal to not comply to building code? If these violations existed when the
certificate of occupancy was issued, you clearly have liability."
I disagree with Mr. Simpson's- conclusion that the Town would "clearly have liability."
Mass. Gen L. ch. 258, The Torts Claims Act, contains several exemptions of municipal liability
for negligence from claims such as:
(e) any claims based upon the issuance, Venial, suspension, or revocation or
failure or refusal to issue, deny, suspend, or revoke any permit, license,
certificate, approval, order or similar authorization;
(f) any claim based upon the failure to inspect, or an inadequate or negligent
inspection, of any property, real or personal, to determine whether the
property complies with or violates any law, regulations, ordinance, or
code, or contains a hazard to health or safety....
Several years ago, the Town litigated a claim by another North Andover landowner that
the Town was allegedly liable for negligently approving an illegal septic system. Without
getting into the merits of the allegations, the Superior Court ruled that the foregoing exemption
