Pursuant to G.L. Chapter 40A, § 15, the Board of Appeals was required to act within 100 days. On June 11, 2002, the Board voted to deny the variance and on June 17, 2002 the Board's decision was filed in my office, all of which occurred within 100 days of filing of the application. Eramo to Joyce Bradshaw. The enclosed Board of Appeals decision was dated June 11, 2002 and recorded with the Town Clerk on June 17, 2002. Prior to 1987, Chapter 40A, Section 15 provided that the Board was required to render its decision within 75 days of the filing of the application for variance and the Town's bylaw similarly provided for a 75 -day period. In 1987, Chapter 40A, Section 15 was amended and the 75 days was changed to 100 days. However, the Town's bylaw was not amended to reflect the 100 -day time limit. The applicant's attorney has advised that litigation will be commenced if the Town does not acknowledge that the 75 -day provision in Section 10.4(2) of the Bylaw, has resulted in a constructive approval. The trailer must have the Commonwealth of Massachusetts approved electrical seal and comply with the State Building Code. It is important that the trailer has the third party Massachusetts electrical seal as the Electrical Inspector will not issue the required electrical permit for your necessary electric hookup. 2. Since trailers are not specifically mentioned as an allowed use in the foregoing sections, they are then prohibited. The submitted floor plan of the William Scotsman, Inc. has the following written notation "No toilet —unit does not have to be MA coded". This statement is not corrector truthful, as all trailers and mobile homes must have the Commonwealth of Massachusetts Approval and comply with the State Building Code. The units must have pre -approved and installed Electrical, Plumbing and Rest rooms. M.G.L. 40A, s 3, only allows the use of a mobile home for a period of one year, if the principal dwelling has been destroyed by fire and is being reconstructed. The Mobile home must also have Pre -approved and installed Electrical, Phunbing and restrooms. In both cases the unit must be hooked up to municipal services (or septic service). The only type trailer permitted in North Andover is a construction trailer that meets State regulations and laws.
