This letter will confirm our telephone conversation in response to your memorandum of
November 12, 2004.
With regard to your first question, we would concur with the clarification from Mass.
Housing that in order to satisfy the requirement for 25% affordable units, 8 market rate units and
3 affordable units are required, for a total of 11 units.
With regard to the question of the ownership of Marengo Street, Merrimack Engineering
has represented that Marengo Street is a private way. In order to confirm the status of this street,
we would advise that you request that the developer provide the legal documents relied upon to
establish Marengo Street as a private way. Documentation should also be provided regarding the
rights of abutters and others to use of the private way.
When you have received this information, you may forward it to us for review.

A. Ciampa, PC for Highview LLC's Chapter 40B project in North Andover called
Aaron Gornstein
Waverly Oaks. As you are aware, Citizens' Housing and Planning Association (CHAPA)
is the monitoring agent for Waverly Oaks.

MassHousing will be conducting the review of the cost -certification audit of this project.
This review was one of the oversight responsibilities originally delegated to CHAPA
under the monitoring services agreement for this project. Upon CHAPA's request, on.
September 1, 2006, MassHousing took over this role as the Project Administrator.
We have forwarded your cost -certification audit and all attachments to Gina Dailey,
Manager of Comprehensive Permit Programs at MassHousing. MassHousing staff will be
in contact with you and Frederick A Ciampa regarding the audit review process.
