Dear Ms Conboy
I'm writing you in regards to my mother's status, Mrs Claire Gallant
of 296 Middlsex St in N Andover. As of April 1992 she has been
admitted to the Westford Nursing Home on the grounds that she is
incapable of managing her household. On these grounds in seems
extremely unlikely that she will return to her home. We are presently
beginning the procedure to.qualify her for Medicaid. The Medicaid
office has informed us that we may have to sell the home because it is
presently unoccupied.

In response to a request by Pamela Brown of Elder Services
of the Merrimack Valley, I am witting to apprise you of
conditions which exist at the residence of Clair Gallant, 296
Middlesex Street, North Andover, MA, and request your assistance
in remediating the problem.
Throughout the past year the Board of Health has received
numerous complaints on this property from repair men and a number
of different Town agencies.
The interior of the property does not comply with Chapter
II, The State Sanitary Code, Minimum Standards of Fitness for
Human Habitation (105 CMR 410.000). The following violations
exist .and appear to be a result of the Mrs. Gallant's inability
to adequately care for herself or the dwelling.
All areas inspected are deemed unsanitary. There is a heavy
build-up of dirt on all surfaces (floors, walls, ceilings.)
Furthermore, there is a strong odor of urine throughout the
dwelling and urine stains on the kitchen floor.
The livingroom tile floor is covered with an old rug which
is dirty, buckled over in areas and littered with cigarette
butts, ashes, and old matches etc. A bed has been placed in this
room to facilitate a sleeping area for Mrs. Gallant. The bed has
no sheets, the tile floor under the bed has urine stains and the
room has no operable light fixtures or lamps. Mrs Gallant relys
on a flashlight to see in the dark.
The Refrigerator is filled with .,spoiled food products,
covered with spilt and encrusted food products and emits
offensive odors.
The only bathroom in the house is located on the second
floor. Mrs Gallant admits that she does not use the bathroom as
she is incapable of making the trip upstairs. The toilet is
inoperable

and as other facilities (bathtub, sink) has not been used for
some time.
Mrs. Gallant is voiding in buckets and claims that she is
burying her feces in the backyard, however, no evidence exists to
support this claim.
The Board of Health has been working in cooperation with the
North Andover Council on Aging and Elder Services of The
Merrimack Valley for a year now. Throughout this time conditions
existing on the interior of the dwelling have not improved for
any length of time. Mrs. Gallant's son did put the bed in the
livingroom and purchased a commode, however, the commode sits in
the back hall unused.
Any assistance you can provide in resolving this issue would
be greatly appreciate.

This letter is to inform you of conditions existing at 296
Middlesex Street, North Andover, MA. and request your assistance
in remediating the problem.
This property is owned and occupied by Mrs. Clair Gallant.
The interior and exterior of the residence does not comply with
Chapter II, The State Sanitary Code, Minimum Standards of Fitness
for Human Habitation (105 CMR 410.000). The following violations.
exist and appear to be a result of the owner's/occupant's
inability to adequately care for herself or the dwelling. Please
be advised that only the first floor of the dwelling has been
inspected and it is presumed that conditions in other parts of
the dwelling are maintained in a similar or worse condition.
All areas inspected are deemed unsanitary. There is a heavy
build-up of dirt on all surfaces, (floors, walls, ceiling).
Furthermore, there is a strong odor of urine throughout the
dwelling, fresh urine on the kitchen floor and a pan of old
encrusted baked beans on the kitchen stove.
The kitchen floor tiles are cracked, warped and. dirty or
otherwise missing and the floor itself is littered with empty
beer bottles, trash and miscellaneous debris.
The livingroom also has a heavy build-up of dirt and debris
and contains an old dilapidate mattress and soiled clothes and
linens stored in disarray.
The exterior of the dwelling is dilapidate and the yard has
a buildLup of trash and litter and there is human waste scattered
around the back door of the dwelling and emitting offensive
odors.
Please review the status of Mrs. Gallant's request to your
department for housing and advise me of the standings. Any
assistance you may provide in remediating this situation would be
greatly'appreciated

Dear Mrs. Gallant:
In response to a site visit, conducted by Allison Conboy,
accompanied by Pamela Brown of Merrimack Valley Elder Services,
at your residence this morning, the Board of Health has
determined the following:
1) Conditions noted at your residence today are improved
from those documented on February 26 and March 20,
1991, however, the downstairs areas are not being
maintained in a sanitary manner. The Board of Health
is not prepared to close this case until such time as
we are confident that your residence is being
maintained in a clean and sanitary manner.
2) To aid you in your efforts to improve the current
condition of the premises and continue to maintain a
clean environment once it has been obtained, the Board
strongly encourages you to accept the services of a
Merrimack Valley Senior Aide once or twice a week. By
accepting these services, not only will you find it
easier to improve and maintain your living conditions,
but the Board will feel confident that your premises
are not deteriorating again.
This letter is being copied to Pamela Brown of the Merrimack
Valley Elder Services so that services of a Senior Aide may
resume. The Board of Health is requesting that Pamela Brown
notify them of conditions at the premises and of any refusals for
assistance which you display.

Ms. Conboy presented to the Board photos of a case she
continually gets called out on and stated that she doesn't seem
to be getting anywhere on it. She stated that the police & fire
department have called her in on this case. Ms. Conboy stated
that she sent an order letter and recommends that Mrs. Gallant's
children come before the Board next month and inform them that
the Board can take this to court if compliance is not secure.
Mr. Osgood stated that no judge would remove someone from their
own home and stated that he wants nothing to do with putting
someone out_ --of their own home.
Ms. Conboy stated that elder services opened the case again and
Mrs. Gallant is refusing services.
Ms. Conboy stated that Mrs. Gallant is incontinent, empties feces
in the backyard, smokes and has butts all over the floor, and
lives in unsanitary conditions.
The Board stated for the record that Mrs. Gallant's behavior is a
potential health hazard.
Ms. Conboy suggested that at the next meeting bring Clare Gallant
in with one of her children along with Pam Brown from Elder
Services and say the the conditions are unsafe and unsanitary and
this could be taken to court.
Dr. MacMillan suggested to send a letter asking them to please
come before the Board for a discussion on how to resolve this
situation, if they choose not to, then inform them that a
reinspection will take place and court action will follow.
