HomeMy WebLinkAboutMiscellaneous - Exception (369)Officials say town not liable for errors To the Editor: On Dec. 28, 1992, construction on a building addition at 23 Perry St. in North Andover stopped because the building inspector issued a building permit without a zoning variance that was required because the building was less than 15 feet from the property line on both sides. The Board of Appeals then granted the variance, unless an . appeal was filed within 20 days. An appeal was filed at the Law- rence District Court and the town clerk's office. Someone in that office lost the papers and said none had been filed (they later found them). This is an example of the mistak- es made by the town of North Andover. It is because of this that I was forced to hire an attorney to protect myself and my property. I had to protect myself from the very people who were supposed to pro- tect me. I have asked repeatedly to have my legal fees of over $3,800 reimbursed, and have been refused. Town officials say they are not lia- ble for the town's mistakes. The taxpayers of North Andover should be outraged that the govern- ing body of the town would not only allow this to happen, but refuse to take responsibility for it. Why should I have to pay for mistakes made by the building inspector? If this is what is known as justice for all, it stinks. RICHARD C. HAMEL North Andover
