This letter is prepared in support of your proposed Eagle Scout project to replace the pedestrian
bridge at the Reynolds Field off of Johnson Street. This piece of property is Town owned and this
letter serves to give you permission to access the land for the purpose of the bridge replacement. The
Department of Public Works will look to assist you with this project through the permitting and
construction of the bridge. In meeting you to discuss this project, I have found you to be highly
professional, well organized, and extremely detailed in your approach to replacing the bridge.
This project will require a building permit and conservation approval prior to any demolition or
construction activity. The Building Inspector and Conservation Administrator for the Town will look
to provide you guidance in filing the necessary permit applications to move this project forward.

RE: ENFORCEMENT ORDER- Pedestrian Bridge at Reynolds Field, off
Johnson Street, North Andover, MA
Dear Ben:
The North Andover Conservation Department is in receipt of your proposal to replace the
dilapidated pedestrian bridge at Reynolds Field, off Johnson Street. It is our understanding that
the purpose of this project is to fulfill your Eagle Scout requirements. The project consists of
removing the existing 30 -foot pedestrian bridge, in order to construct a new 5'8" x 30' bridge
over Mosquito Brook. The majority of the work will be done by hand; with the exception of
minor machine work within the limits of bank associated with Mosquito Brook to remove the
base of the bridge. Based upon the information provided and the CAD drawings you prepared,
as well as my observations from a recent site inspection, the bridge will be constructed in
kind. As such, this Enforcement Order is being issued to you as a mechanism to perform the
above-mentioned work. The North Andover Conservation Commission (NACC) hereby
mandates the following conditions:
➢ The Conservation Department shall be contacted at least two (2) business days
prior to the commencement of any work activities.
➢ Prior to the commencement of any work, a detailed construction sequence shall be
submitted to this department, which should include anticipated start and end
date: The Conservation Commission had questions relative to the removal of the four
(4) existing wooden posts that are anchored into the streambed. The construction
sequence should reflect this removal process. In addition, Conservation staff shall be on
site to oversee this removal of these posts.
➢ This department is aware that the majority of the work will be done by hand. However,
given the current site conditions and the proximity to the resource area, temporary
erosion control measures will be needed to ensure that migrating soils do not enter

Mosquito Brook. Prior to the removal of the two (2) existing utility poles, silt fence
(trenched 4 — 6" into the ground) should be installed at the toe of slope / bank.
Said erosion controls shall be maintained and in securely in place throughout the
construction process.
➢ The Department of Public Works (DPW) has informed this department that they will be
removing the utility poles by means of chains and a backhoe, in addition to assisting
with the construction of bridge, if needed. Since this work will take place along the
bank of the brook, all heavy equipment (i.e., backhoe) must be situated in an
upland area, at a minimum of 15 -feet away to minimize bank disturbance to the
maximum extent feasible. Please contact this department prior to the removal of
these poles, so that we can oversee the removal process.
➢ If disturbance of the existing bank or associated resource areas occur during
construction at any time, the Conservation Department shall be contacted
immediately. The Conservation Department reserves the right to require
mitigation measures to any disturbed resource areas. Any required mitigation
shall be addressed separately in coordination with the Conservation
Administrator.
➢ Construction activities shall be performed during low -flow conditions. It is our
understanding that work is anticipated to start work during mid - late August. This
should be a suitable time to build. All work shall be completed by no later than
September 2, 2005.
➢ As soon as the bridge is constructed, please contact this department so that we
may conduct a follow up inspection. Upon a satisfactory inspection, all temporary
erosion controls can be removed and disposed of properly.
On behalf of the NACC, this department is extremely supportive of this project, as it will
improve the existing bridge condition and provide access to both soccer fields once again.
Please do not hesitate to contact the Conservation Department should you have any further
questions or concerns in this regard or if we can be of assistance to you with this project.

Failure to comply with this Order may constitute grounds for additional legal action. Massachusetts
General Laws Chapter 131, Section 40 provides: "Whoever violates any provision of this section (a)

more than two years, or both, such fine and imprisonment; or (b) shall be subject to a civil penalty not
to exceed twenty-five thousand dollars for each violation". Each day or portion thereof of continuing
violation shall constitute a separate offense.

An Enforcement Order issued by a Conservation Commission cannot be appealed to the Department of
Environmental Protection, but may be filed in Superior Court.

Per your recent request, our firm has performed a courtesy review of the proposed renovation to the
Reynolds Field Pedestrian Bridge relative to issues concerning structural adequacy, safety and compliance
with the Massachusetts Building Code.
Our review involved but was not limited to the items noted below:
1. Review of the drawings and sketches of the proposed renovations drafted by S. Novello.
2. Review of the current conditions at the bridge's location (per a site visit on 8/11/05).
3. Review of the applicable sections of the Massachusetts Building.
4. Performance of structural evaluation calculations.
5. Preparation of sketches and details of suggested modifications.
Our comments are as follows:
1. The design sketch provided by S. Novello indicates a clear span of 30'-0". According to our
structural evaluation, the timber built up support beams made up from 4-2x8's fastened
together over a clear span of 30 feet, as proposed, do not meet the allowable stress and
deflection criteria for this type beam for a 30 foot clear span. From review of the existing
site conditions, however, the current bridge has two additional supports, one at each
approximate third point of the span as shown on the attached photos. We believe that the
proposed renovation should incorporate these additional supports and that the proposed
drawings should show the support locations.
2. Section 1021.0 of the Massachusetts Building Code limits the opening sizes in guard-rails.
Consequently, the design sketch prepared by S. Novello may require additional members (for
safety reasons) such as balusters, horizontal intermediate rails etc., to prevent passage through
the side rails of the bridge. We believe that with these modifications, the design as presented
by S Novello may provide a viable solution to the renovations proposed for the subject
pedestrian bridge.
To this end, attached please find additional sketches and details which, we believe, simplify the
construction process and may reduce material expenses associated with this effort.
