Petition No. 69-'83
The Board of Appeals held a public hearing on Monday eveni-ng,
November 14, 1983 upon the application of Prescott Village
Development Corporation. The hearing was advertised in the
North Andover Citizen on October 27 and November 3, 1983 and
all abutters were notified by regular mail. The following
members -were present -and --voting: Frank Serio, Jr., Chairman;
Richard J. Trepanie'r; Esq., Clerk; William -J. -Sullivan, and
Associate Ilembers Walter -F. Soule and Raymond A. Vivenzio.
The petitioner seeks a variance from the provisions of Section
7, Paragraph 7.-3.and Table 2 of the--Zoning-By Law -to permit re-
lief from -the side setbac-k requirement to -allow the continued
existence of a dwelling (townhouse) which does not meet the
setback requirement of -the Zoning -By Law _on -premises -located
at Lot 1 - Stacy Drive.
The petitioner testified through counsel that the dwelling (unit)
was constructed in the --spring of 1.983 and when an "As Built" plan
was -required the setback violation was discovered.
Upon a motion made -by Mr. Soule and seconded by Mr. Vivenzio, the
Board voted -four to one -to grant the variance as requested.

The Board finds that Section 10.4 of the Zoning By Law has been
satisfied. Specifically,.the Board finds that due to the location
of the townhouse unit --on the premises with its slight -deviation
from the requirements of the Zoning By Law constitutes a hardship
to the petitioner. Said variance, in the opinion of the -Board, may
be granted without nullifying or substantially derogating from the
intent and purpose of the By Law.

The principal points upon which I base my application are as follows;

North Andover Building Inspectors interpretation of the party wall side
line setback zoning requirement indicates that Unit iJo. l violates the
-------------------
side line setback requirement. The structure was built according to a
plan approved by the planning board and was built in accordance with a
_:wilding permit issued.by the building inspector.
A literal enforcement of the provisions of the zoning by-law would result
in substantial hardship, financial and otherwise, to the owner.
The hardship is owing to the shape of the topography and structures
and relief would not adversely affect the public good or the zoning
district in general.
Every application for action by the Board shall be made on a form -----
approved by the Board. -Thes.e 'forms shall be furnished by the clerk
upon request. Any communication purporting to be an application
shall be treated as mere notice of intention to seek relief until
such time as it is made on the offi ci,,4 application form, All in-
formation called for by the form .shall be furnished by the applicant
in the manner therein prescribed.
Every application shall be submitted with a list of "Parties in
Interest" which list shall include the petitioner, abutters, owners
of land directly opposite on any public or private street or way,
and abutters to the abutters within three hundred feet of the property
line of the petitioner as.�hev appear on the most recent applicable
tax list, notwithstanding that the land of any such owner is located
in another city or town, the Planning Board of the city or town, and
the Planning Board of every abutting city or town.
