First and foremost,the size of the building needs occupy the space without adversely affecting the existing homes. Currently the lot in question is located in the very center of the Chatham Crossing complex. Our property, Lot#4,directly abuts Lot#5 on Chatham Circle. We have several serious concerns in regards to the two family dwelling being proposed for construction on Lot#5 by Ray Von Realty Trust(Ray Cormier,Trustee). 1. When we purchased our condominium from Ray Von Realty Trust in 2003,we were told that a single family residence was planned for Lot#5 with reasonable space between our unit and the single family home to be constructed. This was confirmed by the town documents from 2003, copies of which I have provided for you. A two-family building will be significantly larger and take up much more of the open space directly in front of our unit and cause more blockage from the street. This will not only obstruct our views but cause a devaluation of our property value. 2. We currently have water runoff and drainage problems from Lot#5 when it rains. Water flow from Lot#5 pools up in front of our unit and drains down across our driveway just in front of our garage as shown in the photographs. During winter,the water in front of the garage freezes causing hazardous footing and making driving in and out of the garage risky. My husband had a serious fall one winter,injuring his back. Fortunately,he has since recovered,but we walk very carefully to get our mail in winter. 3. We have a finished basement and we have had to install some special drain pipes and a sump pump in our basement due to the high water table and the drainage problems. 4. In examining the drawings of the proposed new two-family dwelling,it appears that the walkout basements will require substantial re-grading of Lot#5 in a manner that will cause the lot,which is currently relatively flat,to have a significant downhill slope toward our unit making the water drainage and runoff problem substantially worse.(Again,as shown in the photographs I have provided.) I 5. Since the documents provided to the town(and to us)do not show topographical information and elevations,it is not possible to evaluate the severity of this problem,and how it will be addressed. 6. We recognize that Mr.Cormier's plan appears to satisfy the setback requirements; however,the plan does not adequately address the water runoff and drainage issues, nor the placement of the building in relation to the existing homes. 7. If all of these concerns were resolved,and a proposal to build was to move forward,we would like to make this final statement.,A home on this last lot in the development should be consistent in quality of construction,architecture,and landscaping. Proper landscaping is extremely important to ensure sufficient privacy for the residents. Retaining the existing trees that line Lot #5 and providing additional trees for screening would enhance privacy and aesthetics. It shall be the developer's responsibility to assure the proper placement of the driveways regardless of whether individual lots are sold. The Planning Board requires any driveway to be moved at the owner's expense if such driveway is at a catch basin or stone bound position. e) If a sidewalk is to be constructed in front of the lot,then such sidewalk must be graded and staked at a minimum 8) Prior to the fmal release of security retained for the site by the Town,the following shall be completed by the applicant: a) An as-built plan and profile of the site shall'be submitted to the DPW and Planning Department for review and approval. b) The applicant shall petition Town Meeting for public acceptance of the street.Prior to submitting a warrant for such petition the applicant shall review the subdivision and all remaining work with the Town planner and Department of Public Works. Care must be taken to establish who will do the site work on lots once released and that the two remaining lots will be further stabilized during this site work. I also offer the following comments: 1. The present stabilization plan calls for grass whereas a more deep-rooted shrub or tree in places may hold the slope better. Grass holds topsoil only. On steep, saturated slopes, whole sections of topsoil may slough off exposing the subsoil to erosion. Deeper-rooted plants get down into the subsoil. 2. hay bales have not been placed around the loam pile and grass has not yet germinated 3. rip-rap driveway entrances must be minimum 6"minus stone in a trench w/design submitted to DPW for approval. 4. silt needs to be removed from stilling ponds behind lots 1 &2 and the d-pond forebay. 5. some seeded areas have still not germinated. Irrigation is needed. 6. lot 3 needs loam and seeding on back side. Chatham Crossing Subdivision: I recommend no lot releases be given until drainage is properly connected to the municipal system with the designed stormwater management in place. First and foremost,the size of the building needs occupy the space without adversely affecting the existing homes. Currently the lot in question is located in the very center of the Chatham Crossing complex. Our property, Lot#4,directly abuts Lot#5 on Chatham Circle. We have several serious concerns in regards to the two family dwelling being proposed for construction on Lot#5 by Ray Von Realty Trust(Ray Cormier,Trustee). 1. When we purchased our condominium from Ray Von Realty Trust in 2003,we were told that a single family residence was planned for Lot#5 with reasonable space between our unit and the single family home to be constructed. This was confirmed by the town documents from 2003, copies of which I have provided for you. A two-family building will be significantly larger and take up much more of the open space directly in front of our unit and cause more blockage from the street. This will not only obstruct our views but cause a devaluation of our property value. 2. We currently have water runoff and drainage problems from Lot#5 when it rains. Water flow from Lot#5 pools up in front of our unit and drains down across our driveway just in front of our garage as shown in the photographs. During winter,the water in front of the garage freezes causing hazardous footing and making driving in and out of the garage risky. My husband had a serious fall one winter, injuring his back. Fortunately, he has since recovered,but we walk very carefully to get our mail in winter. 3. We have a finished basement and we have had to install some special drain pipes and a sump pump in our basement due to the high water table and the drainage problems. 4. In examining the drawings of the proposed new two-family dwelling, it appears that the walkout basements will require substantial re-grading of Lot#5 in a manner that will cause the lot,which is currently relatively flat,to have a significant downhill slope toward our unit making the water drainage and runoff problem substantially worse. (Again,as shown in the photographs I have provided.) 5. Since the documents provided to the town (and to us)do not show topographical information and elevations,it is not possible to evaluate the severity of this problem,and how it will be addressed. 6. We recognize that Mr.Cormier's plan appears to satisfy the setback requirements; however,the plan does not adequately address the water runoff and drainage issues,nor the placement of the building in relation to the existing homes. 7. If all of these concerns were resolved,and a proposal to build was to move forward,we would like to make this final statement:A home on this last lot in the development should be consistent in quality of construction,architecture,and landscaping. Proper landscaping is extremely important to ensure sufficient privacy for the residents. Retaining the existing trees that line Lot #5 and providing additional trees for screening would enhance privacy and aesthetics.
