The Board of Appeals held a public hearing on h:-)nday evening,
"november 19, 1984 upon the application of John McLay. The hearing
was advertised in the North Andover Citizen on November '1 and 8,
1984 and all abutters were notified by regular mail. The
following members were present and voting: Frank Serio, Jr.,
Chairman; 1.4illiam J. Sullivan; Augustine 1. Nickerson; and
Associate Members Walter F. Soule and Maurice S. Foulds.
The petitioner seeks a variance from the provisions of Section 7,
Paragraphs 7.1, 7.2, 7.3 and Table 2 of the.Zoning By Law so as to
permit -relief from the required,,lot area, frontage, and setbacks
to allow the division of a lot into two lots and to allow the
construction of a dwelling on premises located at 200 Middlesex
Street in the R-4 zoning district.
The petitioner testified that the parcel has leen in his family
for over 60 years. His mother occupies the e;.isting dwelling at
200 Middlesex Street and his daughter wishes to construct a
dwelling on the proposed lot on Norman'Road, k:own as Lot 6. The
pro, lot will consist of 4,500 square ,fec : with 50 feet of
frontage. The proposed dwelling will require ...variance from the
side setback requirement of 15 feet on one Pid The rear setback
requirement of: 30 feet will be met and thr fent setback of 15
feet is greater than the average. of the dwellir. is within 250 feet
of the ocorosed dwelling, as allowed under the Zoning By Law.
Treece are several similarly sized. -lots in the neighborhood.
No opposition was voiced at the hearing.

Upon a motion made by Mr. Foulds and seconded by Mr. Soule, the
Board voted unanimously to grant the variance as requested with
the following conditions:
1. That only a single family dwelling may be .:onst.ructed on the
new lot.
2. That the plan be revised to show suitab= a .-ff street parking.
In granting the variance, the Board finds that S, -action 10.4 of the
Zoning By Law has been satisfied. In particular, the Board finds
that a literal enforcement of the By`Law would create a hardship
to the petitioner and that desirable relief may be granted without
nullifying or substantially derogating from the intent and purpose
- ------ - of. the Zoning By Law. Due to the .makeup of the neighborhood of
smaller lot sizes, said variance will not create a detriment to.
the neighborhood.

Sec. 1 APPLICATION FORM
Every application for action by the Board shall be made on a form
approved by the Board.These'forms shall be furnished by the clerk
upon request. Any communication purporting to be an application
shall be treated as mere notice of intention to seek relief until
such time as it is made on the official application form. All in-
formation called for by the form shall be furnished by the applicant
in the manner therein prescribed.
Every application shall be submitted with a list of "Parties in
Interest" which list shall include the petitioner, abutters, owners
of land directly opposite on any public or private street or way,
and abutters to the abutters within three hundred feet of the property
line of the petitioner as they appear on the most recent applicable
tax list, notwithstanding that the land of any such owner is located
in another city or town, the Planning Board of the city or town, and
the Planning Board of every abutting city or town.
* Every application shall be submitted with an application charge cost
in the amount of $25.00. In addition, the petitioner shall be respon-
sible for any and all costs involved in bringing the petition before
the Board. Such costs shall include mailing and publication, but
are not necessarily limited to these.
