RE: Selective removal of three (3) trees and pruning of six (6) trees within the buffer zone
of a wetland resource area.
This is a follow up letter pertaining to your request to remove several trees at your home at 60
Hillside Road. The trees were identified by Mr. Shin during a site visit by the Conservation
Department on May 12, 2014. It was determined that several of the trees are located within the
25' No-Disturbance Zone pursuant to the North Andover Wetlands Protection Bylaw (C. 178 of
the Code of North Andover). Removal of vegetation, including pruning and cutting, is
prohibited within the No-Disturbance Zone except in rare circumstances, such as safety. Several
of the trees identified are damaged and/or dying and are in close proximity to and are leaning
towards. the house and/or driveway posing a safety hazard. The trees which are permitted to
be removed or pruned are identified in the attached photos.
*Determination of property ownership is the responsibility of the homeowner.
Due to the potential danger imposed by three of the trees, the Conservation Department will
permit their removal to prevent possible injury or property damage, in addition six other trees
are permitted to be .pruned. These cutting/pruning activities shall be limited to the trees
identified and shown in the attached.photographs. The trees which are only permitted to be
pruned must be pruned in a way that preserves the health of the trees.
As discussed with Mr. Shin during the site visit, any concerns about additional trees which are
not included in this letter should be submitted in writing to the Conservation Commission with
details regarding the specific trees and specific concerns. The Conservation Commission may
require a filing to permit the removal of any additional trees.
The approved cutting will be subject to the following conditions:
❖ Prior to the start of the tree work, the trees to be removed are to be marked by brightly
colored tape and the Conservation Department is to be contacted to conduct a pre-cutting
inspection to ensure that only the approved trees are removed.

❖ No machinery shall enter the 25' No Disturbance Zone.
❖ No work shall occur in resource areas.
❖ All tree limbs, brush, and other debris materials shall be taken off site and disposed of
properly.
❖ Stumps of the tree shall not be removed and shall be left in place. Stumps may be ground
down or cut flush with the landscape.
❖ Care shall be taken to prevent damage to surrounding trees during removal of the approved
trees.
❖ Upon completion of the tree removal, all disturbed areas shall be properly stabilized.
❖ The applicant shall notify this department immediately following completion of work for a
final site inspection.
❖ Areas within 100-feet of wetland resource areas shall remain in a natural state and no further
vegetation shall be removed without the prior approval of the Conservation
Department/Commission.

RE: VIOLATION of the Massachusetts Wetland Protection Act(M.G.L. C.131 S.40)
and The North Andover Wetland Bylaw (C. 178 of the Code of North Andover).
Dear Joel:
On April 8, 1998, Susan Ford, Health Inspector, and myself inspected the above
referenced property for a determination of unknown water in the rear portion of your
yard at your request. During this inspection, Bordering Vegetated Wetland (BVW)
"alteration” was observed on site. The term "alteration"e alteration Includes, but is not limited to,
the placement of fill, excavation, or regrading, destruction of plant life, including
cutting and removing of trees and shrubs (Sections II. (b)(c) of the North Andover
Wetland Regulations).
Any work that is proposed in the Buffer Zone of a BVW, or directly in a BVW is subject
to a filing of a Request For Determination of Applicability or a Notice of Intent, through
the North Andover Conservation Commission (NACC)(Sections III and IV of the North
Andover Wetland Regulations).
The following violations were observed on site and warrant mitigation:
1. Pea stone was observed adjacent to the recently planted October Glory Maple.
Please remove this stone.
2. A sand pile was observed directly in front of the recently planted Silver Maple.
Please remove this pile.
3. A large pile of yard waste (i.e. leaves) was observed surrounding the recently
planted Sugar Maple. Please remove this pile.
4. Some trees on site have been cut down. Please be aware that any work within 100'
of a resource area should be brought to the Conservation Department's attention,
and direction will be given at that time if need be. Please do not cut down trees
without consulting.with someone in our department.

5. In addition,please contact our department prior to planting any trees in the subject
wetland area so we may direct you to appropriate trees that will survive in that
area.
6. Furthermore,please remove the bark mulch encompassing the recently planted trees
for bark mulch prohibits vegetative growth.
Also, please be aware that there is an Order of Conditions recorded against your
property dated June ZZ, 1995 (copy enclosed) mandating a No Disturbance Zone and a
No Construction Zone. Also enclosed is a photocopy of the As-Built plan highlighting
where the protected resource area is located on your property and the No Disturbance
Zone.
Please be advised that you are in violation of the Massachusetts Wetland Protection Act,
and the North Andover Wetland Bylaw, and NO FURTHER WORK IS TO BE
PERFORMED without the proper filings. Also, please adhere to a deadline of
Thursday,April 23, 1998. The above must be accomplished by this date. Failure to
comply with the above mentioned deadline will require your attendance at a public
meeting before the North Andover Conservation Commission (NACC), and/or
additional penalties and/or fines.
