MEMORANDUM
TO THE BOARD OF APPEALS
TOWN OF NORTH ANDOVER
We the undersigned, hereby request that the variance
requested by Mrs. Elizabeth Bilodeau to construct a pair of
duplexes on each of the two parcels located on Martin
Avenue be denied. The construction of these oversized
buildings on only 75% of the allotted space is squeezing
too much out of the land. They will detract from the
overall appearance of the neighborhood, as well as lowering
the value of the other single family houses in the area.
We feel that if this variance is allowed, then the other
underdeveloped lots in the area will also be able to put up
duplexes. There is presently one newly constructed duplex
on the street already and this structure has caused nothing
but problems to the neighborhood. Some of the problems
are:
1) Trash removal: Town trucks do not travel down the
Easterly portion of Martin Avenue because of road
conditions. Even if Mrs. Bilodeau were to repair
that part of the street in front of her property,
the trucks would still not be able to travel down.

be very unbecoming to the Town of N. Andover, not
to mention a health hazard.

The hardship specified in the attached memo sites

According to the Zoning Laws, Section 40A§ 10, "Financial
Situation";

(1928) 160 N.E. 312, 262 Mass. 451.
Developers in the past have constructed houses and have
had no concern for proper water drainage. Homeowners have,
in the past, taken contractors to court for the water
problems they have left behind and we would like to see
this matter addressed, whatever the outcome of this appeal
may be.

The Board of Appeals held a public.hearing on April 14, 1987 upon the application
of Elizabeth M. Bilodeau requesting a variance from the requirement.Section 7,
Paragraph 71, 7.2 and ,Table 2 of the Zoning ByLaw so as to permit construction
of a duplex dwelling on each 9,000 square foot lot on premises known as Lots 147,
148, 149 and 150 Martin Avenue. The following members were present and voting:
Frank Serio, Jr,., Chairman, Alfred.Frizelle, Vice-chairman, Augustine Nickerson,
Clerk and Walter Soule.
The hearing was advertised in the North Andover Citizen on March 26 and April 2,
1987 and all abutters were notified by regular mail.
Attorney Marsha K. Elias represented the petitioner stating that they wanted to
build a duplex dwelling on each parcel,.but that the petitioner was more than
willing to abide by any'conditions set forth by the Board of Appeals.
Upon a motion made by Mr. Frizelle and seconded by Mr. Nickerson; the Board VOTED
to GRANT the varianceas requested subject to the following conditions:
1. 'Only a single family dwelling allowed on each lot.
2. Prior -to the,issuance of a building permit, drainage plans for
dwelling must be .submitted to the Board of Appeals for review.
Vote was unanimous, with Ms. O'Connor abstaining.
The Board finds that the petitioner has satisfied the provision of Section 10,
Paragraph 10.4 of the Zoning ByLaws and the granting of this variance will not .
derogate from the intent and purpose of the Zoning.ByLaw nor will it adversely
affect the neighborhood.
