The North Andover Conservation Department is in receipt of the letter prepared by Epsilon Associates,
Inc., dated 11/22/04, requesting to perform emergency road repairs at the Lucent facility, located at 1600
Osgood Street. On Friday, November 19, 2004, I met with Julie Vondrak of Epsilon Associates,
Christopher Huntress of Huntress Associates and Brian Pendleton of TEC to review the two collapsed
sections of the roadway. Upon review of the site, I agreed that the damaged roadway poses a safety
threat, in addition to an unstable condition, which is contributing to sedimentation into the adjacent
wetland resource area.
The attached Enforcement Order is being issued to allow immediate stabilization activities to prevent
further damage to the roadway over the winter months. All work must be conducted in accordance with
the submitted letter and proposed detail plans. It is anticipated the work will be conducted over a 2-3 day
period. The following conditions must be adhered to as required under this Enforcement Order:
1. Prior to the commencement of work activities, erosion controls consisting of staked haybales and
trenched silt fence must be properly installed at the limit of work.. Upon installation of said
erosion controls, the Conservation Department shall be contacted for a site inspection.
2. Equipment must be staged from the existing roadway pavement only. No machinery or
equipment shall be used beyond the existing paved limits.
3. All removed materials (pavement, concrete, sedimentation) must be removed from the site and
properly disposed of off site.
4. All disturbed bank areas adjacent to the wetland resource areas must be protected with geotextile
fabric to prevent erosion over the winter months.
Erosion controls must be maintained and remain in place until all disturbed areas have been
adequately stabilized.

6. This Enforcement Order permits stabilization activities associated with the collapsed roadway
only. No other activities are allowed at this time and it is anticipated a Notice of Intent will be filed
in the future to address permanent upgrades to the stormwater management system.
Upon completion of work activities, the Conservation Department shall be contacted for a final site
inspection.

This Enforcement Order is being issued to perform emergency road repairs to a collapsed portion of
roadway that accesses the rear of the Lucent building at 1600 Osgood Street. The applicant wishes to
immediately stabilize a portion of roadway that poses a safety threat and source of sedimentation to the
adjacent resource area. This Enforcement Omer is a permitting mechanism to allow the work to
immediately commence without the filing of a Notice of Intent, due to the emergency nature of the
situation. Activities will include removal of collapsed pavement, the concrete spillway and accumulated
sedimentation and will include stabilization of the roadway through the installation of gravel, geotextile
fabric and rio-rao.

The Issuing Authority has determined that the activity described above is in violation of the Wetlands
Protection Act (M.G.L. c. 131, § 40) and its Regulations (310 CMR 10.00), because:

As you-are'aware, Epsilon Associates, Inc., on behalf of.Ozzy Properties, contacted you
last week to review a collapsed portion of roadway behind the Lucent building at 1600
Osgood Street. At our scheduled inspection on Friday, November 19, 2004, we
observed a collapsed concrete slab spillway and two eroded portions of roadway, which
currently serves as a safety threat and contributor of sediment to the adjacent resource
area (see attached photos). We requested- immediate stabilization activities be permitted
under an Emergency Certification, in order to further prevent damage to the roadway
over the winter season. A future filing with the Conservation Commission will address
upgrades to the outdated stormwater drainage system. Upon discussions with
Commission members, it is my understanding that you would Tike to proceed with our
requested emergency stabilization activities under the issuance of an Enforcement Order.
Ozzy Properties has no objection to proceeding in this manner, however we would like
the record to reflect that Epsilon Associates notified the Commission of this issue
because we felt there was an immediate public safety concern relative to the possible
collapse of the roadway. Ozzy Properties has every intention to correct the pro -[em in
an efficient and expedited manner, while at the same time proceeding in a manner
which best minimized the impact to the adjacent wetland resource areas.
Stabilization Activities
Stabilization activities are anticipated to be conducted over a 2-3 day period. Prior to

stormwater.

Thanks for scheduling a last minute site inpsection at Lucent to review the collapsed section of roadway. As we
planned, we will meet at Lucent at 10:15 tomorrow morning. I will be meeting Chris Huntress at the north gate (as
your facing the building, the entrance to the right, near the Haverhill line). You can wait there for us. We can just
drive into the site to the back without clearance. Attached is a picture just to give you an idea of the problem. I
believe someone from TEC will also be on site to discuss the recommended short term stabilization that will
prevent the road from collapsing. Lucent is hoping to possibly proceed with stabilization at this time under an
Emergency Certification. Upon completion of our inspection, I will follow up with a letter describing the proposed
stabilization activities and construction methodology. This is the access road the Fire Department would have to
use and further collapse of the road is a serious issue to Lucent. See you in the morning! Thanks so much .

As you are aware, Epsilon Associates, Inc., on behalf of Ozzy Properties, contacted you
last week to review a collapsed portion of roadway behind the Lucent building at 1600
Osgood Street. At our scheduled inspection on Friday, November 19, 2004, we
observed a collapsed concrete slab spillway and two eroded portions of roadway, which
currently serves as a safety threat and contributor of sediment to the adjacent resource
area (see attached photos). We requested immediate stabilization activities be permitted
under an Emergency Certification, in order to further prevent damage to the roadway
over the winter season. A future filing with the Conservation Commission will address
upgrades to the outdated stormwater drainage system. Upon discussions with
Commission members, it is my understanding that you would like to proceed with our
requested emergency stabilization activities under the issuance of an Enforcement Order.
Ozzy Properties has no objection to proceeding in this manner, however we would like
the record to reflect that Epsilon Associates notified the Commission of this issue
because we felt there was an immediate public safety concern relative to the possible
collapse of the roadway. Ozzy Properties has every intention to correct the problem in
an efficient and expedited manner, while at the same time proceeding in a manner
which best minimized the impact to the adjacent wetland resource areas.
Stabilization Activities
Stabilization activities are anticipated to be conducted over a 2-3 day period. Prior to
the commencement of work, erosion controls consisting of haybales and silt fence will
be installed at the limit of work (see attached detail sheets). The existing chain link fence
will be temporarily removed during the stabilization activities. Construction machinery
consisting of either a backhoe or excavator will be staged on the existing pavement.
Damaged pavement will be sawcut and removed. The broken concrete slab will also be
removed by machinery. Sediments from the undermined road will be removed by
machinery. All removed materials will be loaded onto a dump truck and will be
disposed off-site. Damaged areas will be filled with gravel overlain by geotextile fabric
to prevent erosion of the fines. Rip -rap will be installed over the geotextile fabric. Upon
