Said premises affected are property with frontage on the West side of Methuen Avenue within the R-4 zoning district. Legal notices were sent to all names on the abutter's list and were published in the Eagle -Tribune, a newspaper of general circulation in the Town of North Andover, on February 27 & March 6, 2006. The following voting members were present: Ellen P. McIntyre, Joseph D. LaGrasse, Albert P. Manzi, III, David R Webster, and Daniel S. Braese. The following non-voting members were present: Richard J. Byers, Thomas D. Ippolito, and Richard M Vaillancourt Upon a motion by Joseph D. LaGrasse and 2nd by Daniel S. Braese, the Board voted to grant a Special Permit from Section 4, Paragraphs 4.122.14.b & 4.122.14.1; and Section 10, Paragraph 10.3 of the Zoning Bylaw in order to construct a two-family dwelling on a conforming lot. Voting for the motion: Joseph D. LaGrasse, Albert P. Manzi, III, and Daniel S. Braese. Voting against the motion: Ellen P. McIntyre and Daniel R Webster. The Board finds that the motion for the Special Permit petition failed to receive the required concurring votes from four members of this five -member board, per Mass. Gen. L ch. 40A §9 & § 15. The Board finds that the applicant did not satisfy the requirements of 4.14.1.a.3.i & ii. The proposed new structure does not complement and reinforce the design features of this neighborhood nor achieve compatibility with architectural features in that most of the dwellings in the neighborhood emphasize horizontal lines, while the proposed new structure emphasizes vertical lines, per photographs submitted by a direct abutter. The square footage of the proposed duplex is greater than the square footage of any direct abutter, single or two- family dwelling, per charts submitted by a direct abutter. The proposed building meets the font, side and rear zoning set back requirements. Access from Sutton Street is on the private way known as Methuen Avenue. Methuen Avenue may be used as access and frontage pursuant to M.G.L. c. 183 sec. 58 which says that "persons who acquire land bounded by a street or way.... The title runs to the center of the way.... And carries with it the right to use the way along its entire length." Brennan v. DeCosta 24 Mass. App. Ct. 968 (1987). As an additional note, any fence across Methuen Avenue may be removed pursuant to M.G.L. c. 86 sec.5 without interference from abutters. 2.
