to grant the continuance of the Special Permit for Earth Removal operation
renewal as listed in permit granted on Nov. 8, 1976.
This renewal of permit is retroactive to September 1978 and annual review
to'be held at the September 1979 meeting.

RE: Robert A. Watson/Earth Removal Permit
Salem, Forest & Ingalls Street
The Conservation Commission has reviewed its file, and
additional available information, concerning the above
referenced site. It is our conclusion that the referenced
site is in violation of the "Wetlands Protection Act" (M.G.L.
Chap.131, s.40, as amended).
The earth removal at this site has been a recurring item
for the Conservation Commission since 1969. Our records show
that this operation has hot compl,ted1iiith the "Wetlands
Protection Act" since 1972. Please note the enclosed "Request"
which was precipitated by your request.
Thus, it is the recommendation of the Conservation
Commission that an Earth Removal Permit not be issued until
such time that the alleged violation of the "Wetlands
Protection Act" be clarified or rectified to the satisfaction
of the Conservation Commission.
Thank you for any consideration given to this recommendation.

Filling, dredging and altering of areas subject to the Act.
The North Andover Conservation Commission has investigated the site
described above and has determined that a "Notice of Intent" will
be required to be submitted as required under the "��Ietlands Protection
Act".
Required forms and plans as listed in the Regulations under the Act
shall be filed with the Conservation Commission, and no work shall
be performed until a public heaving has been held and an "Order of
Conditions" issued to re-ulate the �,!.d work.
The parson in possession of the property, his agents and perinittees
and all other persons shall take all reasonable steps to prevent
unlawful activity on the site. Unlawful activity will result in
the issuance of a "Cease and Desist Order".

P: Watson Earth Removal Permit
Dear Frank:
I have no objections in general to any earth removal from this
area so long as there are conditions agreeing that no material will
be hauled over our rural roads during any winter thawing periods or
during March and April when the frost is leaving the ground. We have
encountered serious damage to our rural roads in this area during the
past couple of winters due to the removal of material from Lacy Street
and Watsons earth removal operation on Sharpners Pond Road. Our roads
in this area were not constructed to accomodate this type of constant
heavy hauling and unless we control hauling during the thawing periods
the road maintenance cost in this areaawill be a constant drain on the
Highway Dept. budget.
I hope we can work something out in this regard, not only on exist-
ing earth removal permits but also special permits. I feel these per-
mits have been abused and not used in the manner originally intended
when they were inserted into the bylaw, and in addition the excessive
amount of material that has been hauled from these special permit oper-
ations.
In closing I would like to comment on the fact that if all earth
removal operations were operated in the manner of Mr. Reals operation
on Rea Street, earth removal would not be a problem to this department.
Mr. Rea has never hauled out of his pit when the described road condi-
tions exist.

This Board has no objections to a legitimate gravel
pit operation that has some tom supervision and control.
We recently experienced considerable difficulty
with five or six lots in the Olympic Circle, Salem St., Laconia
Circle area when the developer removed gravel from lots on which
septic system designs had already been approved. We understand
the situations are not relevant and merely wish to alert your
Board as to what did happen in the general area.

Earth Removal Permit
On behalf of my clients, Robert A. and Jane S. Watson,
we hereby request the renewal of the Earth Removal Permit on
the property abutting Salem Street and the ABM site in the
Town of North Andover, Massachusetts.
Once again we are requesting a renewal of the permit
which has been outstanding for a number of years, and we would
request that the plan as presently on file by you be authorized
as a plan required under Section 5, Paragraph 5.3, Subsection
2 of the North Andover Zoning By -Laws.
You will also find enclosed a check in the amount of
$100.00 constituting the filing fee for the permit renewal, and
a statement encompassing the proposed ultimate use of the
land as required under Section 5, Paragraph 5.3, Subsection 3.
As the proposed ultimate use has not changed since last years
submission you will find attached a copy of the ultimate land
use as.submitted last year. I would however, like to inform
you that the ultimate use of this land is approaching fruition
as we are presently negotiating concerning this property and
it may be developed in the near future.
Also enclosed, you will find a complete list of current
abutters and an operating schedule as required under Section 5,
Paragraph 5.3, Subsection 5.

OPERATING SCHEDULE
Very little gravel has been removed in the past year, and
the gravel that has been removed has been taken primarily from
the front section of the site adjacent to the missile site road-
way. As we requested and were granted a waiver of the five -
acre requirement, the operation of the pit has not been such
that a detailed operating schedule may be filed. The owner
will be happy to explain at a view and at the meeting itself
which areas have been worked and to what extent.
Future operation of the gravel pit will continue as in the
past with the active areas of operation as have been shown on
the plans filed with the Board of Appeals in prior years. No
modification of the operating areas is contemplated at this
time.

ULTIMATE LAND USE OF GRAVEL SITE
It is the intention of the Petitioner to utilize the site in
conformance with the residental zone in which the property is
located. As such, it.will be necessary at some future time when
the gravel operation has been terminated to apply for sub-
division approval of the property establishing suitable ways
and lot lines in conformance with the Town's 'zoning By -Law. It
is proposed that the levelling effect of the gravel operations
will make the property more amenable to development for housing.
The central ponding, it is felt, will add a central focus to
such a development which will be both aesthetically pleasing
and beneficial to the surrounding houses to be constructed.
The ways constructed and the lot lay -outs will be done in such
a manner as to maximize the use of the ponds and also to pre-
serve as much as possible the remaining woodlands. It is the
belief of the petitioner that when this is accomplished the
property will be even more of an asset to the community than
it is at present.
