Dear Ms. Sawyer,
This letter is to follow up on your letter dated December 4, 2007. Below please find my
responses, as well as some requests.
1) Pest control — As stated in your letter of December 4, 2007, we are in compliance.
Pest End Exterminating will continue to maintain the Estate on a bimonthly basis.
Potential foundational entries are being checked on a routine basis by the Estate's
maintenance person.
2) Knowledge and commitment to food safety — The head chef is signed up for a class
scheduled for January 24'x', 2008. Proof of admission will be forwarded once received.
The Estate Director is signed up for the same training.
3) Cleaning Schedule — With the assistance of a new board member, who's expertise is
in the restaurant and hospitality industry, a daily, weekly and monthly cleaning schedule
is in the process of being created and will be forwarded to your offices immediately upon
receipt. As requested, this schedule will be posted in the kitchen facility.
4)Structural issues reviewed by board — Please see closing paragraph below.
5) Identify new and safe locations for storage of catering equipment — The old
unused freezer is scheduled for removal on Friday, January 11'}'. All equipment
has been removed. Room is not being used.
6) Repairs — Gas stove leak has been repaired. Ice machine leak has been repaired
and light installed.
7) Identify location for slop sink and removal of pantry sink — AJ Salemme
plumbing inspected the area and will submit a estimated cost of project. The most
effective location for the slop sink is the closet storing the mops and cleaning
products.
8) Walk in refrigerator — Please advise the timeline in terms of actual days/months
that this issue needs to be resolved.

Dear Ms. Willey,
This letter is a follow-up to our meeting of November 16, 2007. At that meeting we reviewed the
lists previously written regarding the issues at the Steven's Estate at Osgood Hill. We also
discussed the progress that you have made at the Estate and agreed to some further actions
needed by both arties.
You indicated that to date, other than the pest control company, no outside professionals have
been hired to assist in the difficult task of bringing this establishment into compliance.
Subsequently, the current staff is fully responsible for needed improvements. As there are many
tasks to keep track of, the Health Department continues to recommend the hiring an outside
consultant to ensure compliance. The list below is taken from the October 10, 2007 letter to you.
The comments in red found below, signify the current status of the issue, the blue comments
indicate compliance.
1) Pest Control - Pest End has made recommendations to eliminate entry to the building to
the mice. The recommendation was given August 6h. Their report of August 28, 2007
notes that there has been no action taken to seal the foundation openings, cracks etc.
Please continue updating the Health office with progress in this area. The rodent issue is
showing significant improvements, however Integrated Pest Management will be
maintained as a priority to prevent future problems.
2) Knowledge and commitment to food safety — This is a priority due to the condition of the
kitchen in regards to cleanliness as listed in the inspection documentation, as well as to
the concern over the ineffective response to the hazardous situation. It is recommended
that the people in charge immediately sign up for a food safety course and submit proof
of enrollment. No compliance to date. The head chef must be signed up in a Servsafe
class scheduled no later than Feb. 1, 2008. Please forward the proof of admission

All of the above outstanding items must be addressed; however, of the structural items noted in
#4, as found in the Inspection Report dated August 1, 2007, the Health Department identifies
some priorities as listed below. These items do not have to be completed in order, rather a plan,
as previously requested, must be submitted to the Health Office as soon as possible, but no later
than 30 days from receipt of this correspondence.
1) Replace floors and install curved coving throughout kitchen, under stove area, in dish
room and out is wait staff area.
2) Walls in disrepair. Recommend covering kitchen and dish room walls to a minimum of 8
feet in height with non -porous surface such as FRP (fiberglass reinforced panels). They
come in sheets and can be installed easily.
3) Dish room countertops in disrepair. Cabinets and countertops are old and should be
looked at as to their purpose. Most of the shelving is either unpainted wood or painted
and in disrepair. Consider all options.
4) Hand sink in wait staff area does not work for unknown reasons. Leaving this dry is not a
good option. Should be removed or repaired. There should be hand sinks in all areas to
ensure good hand washing practices. BOH recommends 1 hand sink every 20 feet. The
Steven's Estate only has one centrally located. Consider installing one in the dishwashing
area and also fixing the wait staff sink.

In conjunction with the above, a cleaning schedule identifying daily, weekly and monthly
jobs must be generated, posted and maintained to ensure tasks are identified and carried
out regularly. No compliance to date. A daily, weekly, monthly cleaning schedule
must be submitted.
4)
Identify a date that the board will review the structural issues. Submit a timeline for
proposed correction of structural issues. No timeline received. S. Sawyer will provide
additional priority list to assist the Steven's Estate board and management see
below.
5)
Identify new/ safe and acceptable location for storage of catering equipment and set time
for corrective action. In compliance. Items in this room have been relocated. Future
room use is being evaluated. Old unused freezer should be removed

Our company performed the weekly service for pest control at
Stevens Estate on Friday, September 7, 2007. During this service
the technician removed 5 mice from traps and rebaited rodents
boxes. The mice are still eating the bait in the boxes which means
they still have a rodent problem. In regards to the repairs: 1 door
has been fixed and a few areas have been sealed on the floors.
There is still alot of repairs needed and the technician met up with
the maintenance man and showed him what needed to be done.

Our technician inspected and treated the above property today. The findings
are as follows, there were alot of new droppings in the basement. It appears
that the old droppings were cleaned up. The bait boxes were rebaited. Most
of the bait was consumed which means the rodents have been feeding on the
bait. He also removed 5 mice in. our ketchall traps.
It did not appear any repair work has been performed to the foundation or
floors. Also, the areas around the windows and sills still need to be repaired.
While the technician was at the property he met with the maintenance
person and explained that these repairs need to be done and he said he was
,ware of that. l also called Kiln at Stevens Estate and left a message on the
answering machine that their service needs to be increase. If you have any

Cour technician inspected and treated the above property today. The findings
are as follows, there were alot of new droppings in the basement. It appears
that the old droppings were cleaned up. The bait boxes were rebaited. Most
of the bait was consurned which means the rodents have been feeding on the
bait. fie also removed 5 "nice in our ketchall traps.
It did not appear any repair work has been performed to the foundation or
floors. Also, the areas around the windows and sills still need to be repaired.
While the technician was at the property he met with the maintenance
Person and explained that these repairs need to be done and he said he was
aware of that. I also called Kim at Stevens Estate and left a message on the
answering machine that their service needs to be increase. If you have any

I am sending this letter as a follow-up to my visit to Stevens Estate last friday Aug Las requested
by you.
Upon inspection of this property I found the following problems which are a contributing factor
to the high number of rodents in the building.
o The basement floor has decayed. and. lifted in some areas allowing rodents to gain access.
1'he basement walls have holes in them where the mortar has given way allowing access for
rodents.
♦ There are openings in the sill area around the foundation allowing access for rodents.
My recommendation is to have these points of entry repaired ASAP. The foundation can be
pointed using hydraulic cement to prevent entry and the openings along the sill can be stuffed
closed using expanding .foam. The floor can have the buckled areas filled with cement as well.
would also recommend the service to this facility be increased to every other week until this
problem is resolved. Please call my office to authorize the increase in service intervals.

On August 10, 2007 the Health Department personnel conducted a
re -inspection at the request of the operator/manager, Kim Willey. The
walk-through was conducted with George Peters, a trustee of the estate.
Conditions that were found are as followed.
Old rodent droppings on several of the shelves above the ice
machine
Rodent droppings on the counter in the dish room.
Rodent droppings throughout the basement.
Opened contaminated linens in the basement.
Floors under all equipment and shelving units throughout the
facility have not been vacuumed and cleaned/sanitized
thoroughly.
Old equipment is still in place.
Mr. Peters has offered to voluntarily shut down the Stevens Estate for
the next several hours. Mr. Peters has enlisted a professional cleaning
company to come in and clean/sanitize the kitchen, dish room and the
service area, floors walls and equipment.
In the interest of public health and safety, a re -inspection of the
facility will be conducted at the end of the day, August 10, 2007, to
ensure that the proper cleaning procedures have been completed.

The following items were to be addressed by Friday 8/3/07.
1) Call your pest control company. Have them come to the sight (today or tomorrow if possible so
they can see the severe problems we all saw) and do an evaluation. Kim was told that we would
like to see that evaluation and their recommendations by Friday of this week. The company
should have no problem with this kind of request. If they do, I would be happy to call them for you.
We often do that for establishments.
2) We recommend that you get as many people as possible to help with the cleaning or if you
choose you may hire a professional cleaning company. We suggested that possibly each area
could be designated to various staff. There is the dish area, the walk-in/ storage area, the main
kitchen, the wait staff area, the lower level storage area and the laundry room (the equipment
storage area will be discussed at a later time)
- Each room must cleared out of unnecessary items; recyclables, boxes, unused
equipment, contaminated linens, furniture etc. (there is presently too much clutter to clean
properly)
- All areas must be vacuumed and/ or swept. Then floors must be cleaned thoroughly
- All counters, shelves, equipment must be scrubbed down and sanitized.
- Clean or remove any easily moved accessory equipment such as dirty fans or old items
not needed
- All dishes and glassware must be run through the dish machine at the end of the
process
Since condition found cannot assure the Health Department that safe food can be served out of
the Steven's estate kitchen.

Dear Ms. Willey,
This letter is a follow-up to your letter of January 4, 2008. The Health Department has received
the updates on the progress made regarding the Pest control, Food Safety Training and, although
it is not completed to date, the anticipated cleaning schedule. The final paragraph requested that
the Health Department advise in regards to structural issues with "actual timelines in terms of
days/weeks/months and the actual priority of each item." The following is our correspondence
over the past six months.
The Health Department originally documented violations to the MA Food Code and the Federal
Food Code during a health inspection conducted on August 1, 2007. The seriousness and critical
nature of the violations caused this office to order immediate action or face shutting the kitchen
down until corrections were made. Most of the immediate critical violations were corrected that
month and since that time the Health Department has been communicating and meeting with you
in regards to the outstanding violations of this facility.
On August 30, your letter stated, "I will work with the Board Member, Ray Santilli and The
Stevens Estate staff to more forward in addressing the remaining violations". A month later a
letter from the Health Director dated October 10, 2007, noted that Steven's Estate must "identify
a date that the board will review the structural issues. Submit a time line for proposed correction
of structural issues?" An example of an excel spreadsheet plan of action was provided to you as
guidance at that time.
We met in November and additional discussion led to my correspondence of December 4, 2007
in which assisted by prioritizing items as requested and noted that "These items do not have to be
completed in order, rather a plan, as previously requested, must be submitted to the Health Office
as soon as possible, but no later than 30 days from receipt of this correspondence".

Rather than requiring a ty�ica130 day time of correction, our office has repeatedly requested that
you consult with the Osgood Hill Board Members and that a timeline be put together as to the
anticipated dates that completion would be expected. As general practice, once such a plan is
received, the Health staff can determine whether it is acceptable or if modifications to the plan
must be made in the interest of public health.
The requested timeline plan due on January 4, 2008 was not received; rather a request that the
Health Department produce a date that each violation must be corrected by was submitted by
you, therefore, the Health Department is requiring the following. This correspondence is an
official Board of Health Order letter.
Please be advised that all violations noted on the previous communications must be completed
by February 29, 2008. Failure to comply with this Order could result in the suspension of the
permit to Operate a Food Establishment. If you wish to request modification or revocation of this
order you have the right to request a hearing before the North Andover Board of Health. Please
submit a request in writing within seven (7) days and you will be placed on the agenda of the
next available Board of Health meeting. At that meeting you will be able to bring forth evidence
as to why this Order should be modified or revoked.

I ani sending this letter as a follow-up to my visit to Stevens Estate last Friday Aug 3 as requested
by you.
Upon inspection of this property 1 found the following; problems which are a contributing factor
to the high number of rodents in the building.
o The basement floor has decayed and lifted in some areas allowing rodents to gain access.
0 7'he basement walls have holes in them where the mortar has given way allowing access for
rodents.
There are openings in the sill area around the foundation allowing access for rodents.
My recommendation is to have these points of entry repaired ASAP. The foundation can be
pointed using hydraulic cement to prevent entry and the openings along the sill can be stuffed
closed using expanding foam. The floor can have the buckled areas filled with cement as well.
would also recommend the service to this facility be increased to every other week until this
problem is resolved. Please call my office to authorize the increase in service intervals.
