Enclosed herewith is a copy of an Assignment of an Arlington Trust
Company Passbook from Robert A. and Jane S. Watson to Andrew Circle
Realty Trust. This assignment, in the amount of $15,936.18, is subject
to prior rights of the Town of North Andover to secure the faithful
performance of the rights granted by Special Permit for the removal
of earth material on Sharpners Pond Road.
This assignment effectuates Condition Number 2 of°the Board's November
27, 1979 approval of Petition #30-479 and I believe the Board will find
it satisfactory for its purposes.
If there are any questions or concerns with respect to this matter,

I have the following comments to make on petitions to be
heard by your Board:
1. Richard DiCarlo: Building permit refused because the proposed
addition was less than the required distance from the lot line.
2. Steven Broderick: Was refused a building permit because the pro-
posed conversion requires a special permit from the Board of Appeals.
3. Arlington Trust Co.: The proposed addition is closer to the lot
line than_is�allowed by the Zoning By -Law.
4. Andrew Circle Realty Trust: recommend renewal of the earth
rem permit so as to allow th� completion of the operation and use
of the land' fur_
r -widen ial purposes.

5. Evelyn DiGaetano: In my opinion, the Zoning Board of Appeals does
not have jurisdiction in this petition. The applicant's plan shows a
lot with no frontage at all. The applicant does not own land having
frontage on Marbleridge Road but has only an easement over the land that
is owned by someone else. The Zoning By -Law defines a lot as a parcel of
land in one ownership.

Sec. 1 APPLICATION FORM
Every application for action by the Board shall be made on a form approved by the Board.
These forms shall be furnished by the clerk upon request. Any communication purporting
to be an application shall be treated as mere notice of intention to seek relief until
such time as it is made on the official application form. All information called for by
the form shall be furnished by the applicant in the manner therein prescribed.
Every application shall be submitted with a list of "Parties in Interest" which list
shall include the petitioner, abutters, owners of land directly opposite on any public
or private street or way, and abutters to the abutters within three hundred feet of he
property line of the petitioner as they appear on the most recent applicable tax list,
notwithstanding that the land of any such owner is located in another city or town, the
Fiaining Board of she city or town, and the Planning Board of every abutting city or town.
Every application shall be submitted with an application charge cost in the amount of
525.00. In addition, the petitioner shall be responsible for any and all costs involved

ULTIMATE LAND USE OF 'GRAVEL' SITE
It is the intention of the Petitioner to utilize the site in con-
formance with the residential zone in which. the property is located.
Accordingly, a preliminary subdivision. plan for 13 Form A Lots,
utilizing the entire 90 -acre site, has been drawn up and submitted
to the North Andover Planning Board, rejected by that Board, and
is now the subject of litigation in the Essex County Courts. In
the meantime, pending the outcome of such litigation, site prepara-
tion for such house lots is continuing.,
It is proposed that the leveling of the topography which has
been rendered somewhat unsuitable for development as a result of
the gravel removal operation previously conducted on the site will
make the property more amenable to development for housing, In
addition,, the shaping and grading of the banks of the central pond
will be both aesthetically pleasing and beneficial to the surroun-
ding houses to be constructed.. The ways constructed and the lot
lay -outs will be done in such a manner as to maximize the use of
the pond and also preserve as much as possible of the remaining
woodlands. It is the belief of the petitioner that the plan .
submitted, creating extremely large lots and low density of housing
on the site, will help to preserve the natural beauty of the
property, enhance the appearance of the pond area, and create an
asset to the Town of substantially more value than the property
has been for many years.
In connection with the grading and leveling of the property,
excess material will be removed from this area and taken to the
continguous land of the Petitioner at the corner of Ingalls and
Salem Streets for use in construction of the roadways for the
approved subdivision known as Ingalls Crossing II. Although the
material to be removed from this area is being used on continguous
land of the same owner, it is necessary to transport the material
over certain Town roadways, the necessity of which occasions the
Petitioner's request for an extension of the Earth Removal Permit.

ULTIMATE LAND USE OF GRAVEL SITE
It is the intention of the Petitioner to utilize the site in cmn-
formance with the residential zone in which the property is located.
Accordingly, a preliminary subdivision plan for 13 Form A Lots,
utilizing the entire 90 -acre site, has been drawn up and submitted
to the North Andover,Planning Board, rejected by that Board, and
is now the subject of litigation in the Essex County Courts. In
the meantime, pending the outcome of such litigation, site prepara-
tion for such house lots is continuing..
It is proposed that the leveling of the topography which has
been rendered somewhat unsuitable for development as a result of
the gravel removal operation previously conducted on the site will
make the property more amenable to development for housing, In
additiona, the shaping and grading of the banks of the central pond
will be both aesthetically pleasing and beneficial to the surroun-
ding houses to.be constructed. The ways constructed and the lot
lay -outs will be done in such a manner as to maximize the use of
the pond and also preserve as much as possible of the remaining
woodlands. It is the belief of the petitioner that the plan
submitted, creating extremely large lots and low density of housing
on the site, will help to preserve the natural beauty of the
property, enhance the appearance of the pond area, and create an
asset to the Town of substantially more value than the property
has been for many years.
In connection with the grading and leveling of the property,
excess material will be removed from this area and taken to the
continguous land of the Petitioner at the corner of Ingalls and
Salem Streets for use in construction of the roadways for the
approved subdivision known as Ingalls Crossing II. Although.the
material to be removed from this area is being used on continguous
land of the same owner, it is necessary to ti_a.nsport the material
over certain Town roadways, the .necessity o,•: which occasions the

We hereby request the renewal of the Earth Removal Permit on the
property abutting Salem Street and the ABM Site on Sharpner's
Pond Road in the Town of NOrth Andover, Massachusetts.
As recent purchasers of this property from Robert A. and Jane S.
Watson, we are requesting_ a renewal of the permit which has been
outstanding for a number of years, and we would request that the
plan as presently on file by you be authorized as a plan required
under Section 5, Paragraph 5.3, Subsection 2 of the North Andover
Zoning By -Laws.
You will find enclosed a check in the amount of $100.00 constituting
the filing fee for the permit renewal, and a statement encompassing
the proposed ultimate use of the land as required under Section 5,
Paragraph 5.3, Subsection 3. As has been stated in past applica-
tions, the proposed use of this property -is the development of
single family home sites in conformance with the residential zone
in which the property is located. You will find enclosed a state-
ment of the ultimate land use, together with a complete list of
current abutters and an operating schedule as required under
Section 5, Paragraph 5.3, Subsection 5.
