North Andover Conservation Commission Meeting Minutes
April 11, 2018

Small Project
NACC #93, 660 Great Pond Road Rolling Ridge
The Administrator states that this request is for the annual renewal of a small project permit for
farming at Rolling Ridge located at 660 Great Pond Road.
Emily Strong, Giving Garden at Rolling Ridge, gives a brief description on what is grown and the
distribution of the produce and fruit.
Ms. Feltovic inquiries about the condition of the bee hives.
Ms. Strong states that the last report since the winter is that both hives are still alive.
Mr. Saal asks if all products are grown organically.
Ms. Strong confirms that yes everything is organically grown.
Ms. Feltovic questions if the organic products used are certified organic.
Ms. Strong states that they have not gone through the certification process but that no products
exempt limestone and compost are used on the produce.
Mr. Manzi questions if the expansion area will be tilled.
Ms. Strong states that no tilling will take place on that section.
Mr. Manzi asks if any abutters are present. (There is no response). Mr. Manzi declares no abutters
present.
A motion to approve the renewal of NACC #93 for one year is made by Mr. Mabon, seconded by Ms.
Feltovic.

Request for Determination of Applicability
177 Salem Street Ridgewood Cemetery
The Administrator states that this request is for the restoration of a historic building at the Ridgewood
Cemetery part of the project is to lift the existing structure and replace the foundation.
Joe Pelich and James LaFond, representing Ridgewood Cemetery, states that the existing foundation
will be removed using compressed power shovels or a very small excavator.
Mr. Lynch asks what type of concrete will be used, block or poured, to construct the new foundation.
Mr. Pelich states that it will be a poured concrete foundation with a cut stone exterior veneer.
Mr. Lynch asks what type of protection will be installed to protect the wetland resource area.
Mr. Pelich states that a stilt sock has already been installed on-site.
The Administrator states that the silt sock was installed over the winter and will need to be inspected.
Mr. Lynch asks what the building will be used for after the restoration.
Mr. Pelich states that the building was d for
storage and it will remain a maintenance storage building.
Mr. Lynch asks if it will be used to store any fuels, pesticides, herbicides or oils.
Mr. LaFond states that no nothing of the sort will be stored there.
Mr. Mabon asks what the approximate dimensions of the building are.
Mr. LaFond and Mr. Pelich state that it is approximately 30 feet by 15 feet.
There is discussion amongst the Commission and the Administrator as the conditions for the Negative
Determination and the current site conditions.
Mr. Manzi asks if any abutters are present. (There is no response) Mr. Manzi declares no abutters
present.
A motion by Mr. Mabon to issue a negative determination #3 for work in Buffer Zone with special
conditions for no soil stockpiling, erosion controls, no concrete washing, monumentation of the
resource area per the Conservation Administrator and for a pre and post construction inspection
seconded by Ms. Feltovic

Notice of Intent (NOI)

The Administrator states that this project was before the Zoning Board of Appeals last night, Tuesday
April 10, 2018 for a variance, no decision rendered at that meeting due to the outstanding waiver
approval still needed from the Board of Health. The Variance request has been continued until the
next regularly scheduled meeting on May 08, 2018. The Administrator states that revised plans were
updated today with soil stocking information, construction access & dewatering. Still missing from
the plan is the monumentation.
T.J Melvin, Christiansen & Sergi, is here on behalf of the owners Sirius Development regarding the
proposed project. Mr. Melvin would like the Commission to review the revised plan submitted today
and determine what if anything is missing or that still needs to be address on the plan.
The Administrator gives the Commission background information on the property and the existing
in comparison to what is being proposed by the new project and the increased
distance to the Ephemeral pool habitat.
Mr. Lynch questions if this has received approval from the Board of Health.
Mr. Melvin states that the Board of Health approved the plan this morning and that a letter will be
sent out next week.
Mr. Lynch clarifies that the existing home is non-compliant and that the new proposed home will still
need waivers is more conforming and an improvement.
The Administrator and Mr. Lynch are discussing the need for the waiver and for monumentation of
the resource area.
The Administrator recommends some planting restoration on this property.
Mr. Mabon would like to see something more permanent as monumentation of the resource area
versus the proposed 4x4 posts.
Mr. Melvin proposes to the Commission 2x2 foot stone wall as monumentation.
The Commission and the Administrator discuss the need for permanent monumentation of the
resource area with a stone wall and plantings.
Mr. Manzi asks if any abutters are present. (There is no response) Mr. Manzi states there are no
abutters present.

The Administrator advises the Commission that the plans have been revised and submitted to include
the requested items.
Ann McMenemy, Hancock Associates, presents the plan changes on behalf of the owner Jonathan
Bonny, 25 Hesper Street LLC. She updates the Commission on the items that were missing and or
requested by the Commission at the March 28, 2018 meeting. Two flags were field tape measured and
added to the plan per the Administrator-Disturbance zones were
added to the plan as well a note regarding the annual mowing with specifications as to the time for the
mowing to occur due to the potential of ground bird nests. Another note was added regarding the
hand removal of all debris and trash within the wetland and buffer zones.
Mr. Manzi asks if any abutters are present. (There is no response) Mr. Manzi declares no abutters
present.
A motion is made to grant the waiver to remove an existing shed and revegetate with-
Disturbance Zone to a Bordering Vegetated Wetland by Ms. Feltovic, seconded by Mr. Lynch.

retaining wall was not built will not matter now that the new Order will permit a connection to sewer.

Jack Sullivan, Sullivan Engineering Group on behalf of the owner Matthew Bolduc, states this project
is being filed under the Local Bylaw only. There is an isolated Wetland to the rear of this property
approximately 1400 square feet flagged by Williams & Sparages. All work is proposed outside the
No-Build Zone of the Isolated Wetland. The owner is seeking to demolish the existing breezeway
and single car garage and construct a new breezeway and three car garage as well as relocation of the
driveway for Salem Street to English Circle. A portion of the breezeway and garage will be with the
such the runoff drainage cannot go into the public way and must be maintained onsite. Due to this a
crushed stone infiltration trench is proposed on the low side of the driveway. When English Circle
was constructed, a natural swale was formed that feeds the Isolated Wetland. In order to maintain the

installed under the proposed driveway. There will be some sapling tree growth removed as part of
this proposed project. A soil stockpile area is

Mr. Sullivan states that it is not enclosed that it is an open breezeway.
Mr. Mabon would like some clarification on the plan for the culvert.

The Administrator states that this address was before the Commission in October and received an
OOC for DEP #242-1718 for the replacement of a failed septic system. The work for the septic
system is done but the site has not stabilized due to the timing of the project just before winter.
Greg Hochmuth of Williams & Sparages presents on behalf of the owner Mr. Mukherjee. Mr.
Hochmuth reminds the Commission that as part of the prior filing 242-1718 Peter Breen had to create
a temporary access way to get down to the bottom of the property. Some slope stabilization was done
in the prior filing and the owners would now like to stabilize the remaining portion of the slope,
which is failing. There has been several attempts over the years to stabilize it with pieces of rebar
being driven into the slope, boulders, rocks everything rolls down the slope. The slope is settling: the
consensus is that materials were not removed before the fill was placed in the back of the property,
due to this, the deck that was built in the back of the house has settled over a foot and has had to be
jacked up. The project design is to give the owners a useable space behind the house that is somewhat
level and grade it down to as manageable a slope as possible, the areas in green on the plan would be
no steeper than 2:1 in some locations, 3:1 where possible which can be vegetated, the area noted in
gray on the plan is a steeper grade 1.5:1 as a result we are proposing to hog it out put in a silt fence
keyed into the top and then put down stone and flat boulders packed in to make it a boulder slope.

Sparages, dated 03/15/2018). Mr. Hochmuth notes that a Geotechnical Engineer will inspect the
excavation before the fabric is placed to insure stability. Peter Breen has been contracted again for
this project.
Mr. Lynch asks what type of fabric is being used is it jute or a geotech.
Mr. Hochmuth states it will be a geotech fabric below the stone.

edge that the plan calls for Mr. Breen plans to bring in large rolled hay bales placed on their sides to
prevent anything rolling down the slope the larger hay bales will be there to protect the Wetlands.
The Administrator states no waiver is required for a retaining wall if there is no alternative. There is
discussion around whether this is a structure or just a boulder slope.
Mr. Hochmuth states that no tree removal is proposed under this project and only some shrubs on the
slope that will be removed.
Mr. Mabon asks if all the disturbance is going to happen out the 25 foot NoDisturb Zone.
Mr. Hochmuth states that yes it is outside the 25 foot No-Disturb Zone.
Mr. Lynch asks when the Geotechnical Engineer will be consulted.
Mr. Hochmuth states that the timing will have to be worked out with the Contractor.
Mr. Lynch has concerns about the soils on the property and that the Boulder Slope weight load could
cause further settling to happen.
Mr. Hochmuth states that when excavation for the new septic system was done they found that before
the fill was dumped on the site the top layers were not removed and the belief is that the foot
settlement that has already happened was due to the layers compressing.
Mr. Saal asks if there is ledge on either side of the house and if ledge was taken out to construct the
house.
Mr. Hochmuth states that there is ledge on either side but it is unknown if ledge was removed to
construct the house.
Mr. Saal asks if any test pits were done to determine what is under the property.
Mr. Hochmuth states that no test pits were done. It will be a boulder slope open to the elements.
Ms. Feltovic questions what will replace the wooden fence that is being removed.
Mr. Hochmuth states that nothing is currently being proposed to replace it, there is a steep slope that
drops down to the Wetland.
The Administrator states that currently the trees on the other side are monumented with placards and
that the rest of the trees could be monumented with placards as part of this project.
Mr. Manzi asks if any abutters are present. (There is no response) Mr. Manzi declares no abutters
present.

The Administrator reviews the proposal with the Commission which is for culvert replacement under
the train tracks.
Kyle Fair, Fair Dermody Consulting Engineers, is representing Keolis for this project. Mr. Fair
directs the Commission to look at Exhibit C photos of the site.
Mr. Fair states that this is a small box style culvert, various parts of rail for the roof structure. The
Railroad is looking to open cut this to remove the existing stone masonry and both head and wing
concrete pipe which will be imbedded the railways standard 6 inches to provide a substrate bottom.
The Administrator discusses the project with the Commission. The Administrator also notes that the
location is no longer listed as priority habitat.
Mr. Lynch asks if the location of the construction access point will be from the rail bed itself.
Mr. Fair confirms that the access point will be from the rail bed.
Mr. Mabon asks if the new pipe is more flow area or less.
Mr. Fair states that it is slightly more than what is currently there the old is 1632 square inches the
new pipe will be 1679 square inches.
Mr. Mabon asks if this will be done in a day.
Mr. Fair states that is the plan due to the area being shut down and the cost to run busses around.
Mr. Manzi asks if any abutters are present. (There is no response) Mr. Manzi declares no abutters
present.
Mr. Lynch asks is Keolis is doing the work on their own or are they contracting out the work.
Mr. Fair states that the work does get contracted out.
Mr. Lynch states that the Order of Conditions should be made part of the contract for the work.
Mr. Fair states that yes it would be made part of the contract.

242-231, COC Request, 492 Sutton Street, Hangars (Stantec) (Lawrence Municipal Airport)
Randy Christiansen, Stantec Consulting Services is here on behalf of Lawrence Municipal Airport.
He states the COC requests before the commission tonight go back as far as 1984, 1989, 1997. This
COC request is for the North Ramp hangars which was filed by the North Andover Hangar
Association this Association has decreased in uniformity, attendance and size, as a result of this Mr.
Miller the Airport Manager and the Airport Commission has requested Stantec complete the request.
Mr. Christiansen states that the project was
on or near the North Side of the Airport. The four hangars were constructed but no As-Built plan or
Certificate of Compliance was ever filed. Attempts have been made to obtain the original survey data
from the office of Richard Kaminski but were unable to do so. A new survey was done based on the
plan that was on file in the Conservation filing. So the survey that was conducted by Stantec is in red
and superimposed on the plan of record and that is what is on the plan. Substantial Compliance was
found with the hangar locations and the edge of pavement relative to the old Wetland boundary
however upon a field inspection with the Conservation Administrator a new Wetland Delineation was
requested due to the Delineation was from 1984. In doing so the new Wetland Delineation as shown
in red is closer to the Hangars on an average of 10 to 15 feet comparative to the old boundary. Based
on the old setbacks when the Hangars were permitted and constructed the Hangars meet those
requirements set forth in the Order of Conditions. The old flags and data were not able to be found.
Photos with location descriptions were added to the plan. The updated plan has been signed and
stamped by David Rich a registered professional engineer, however David Rich was not the original
engineer on the project, but he did oversee the survey and the remaking/updating of the plan and
oversaw the comparison of the old plan and the new data, which is the best that could be done in this
situation with the project occurring thirty plus years ago.
The Administrator states that only one item is left outstanding which is the letter from the engineering
stating that the work was in substantial Compliance with the Order of Conditions.
Mr. Christiansen states that David Rich is willing to confirm this information in a letter to the
Commission if requested.
The Commission is discussing the merits and reason behind potentially having a letter from Mr. Rich
or not.
The Commission agree that a letter is not needed for this filing based on the fact that Mr. Rich is not
the design engineer.
Mr. Lynch asks if the new Wetland line is for informational purposes only or if it is needed for
something else.
The Administrator and Mr. Christiansen state that the delineation was needed for this filing and for
another filing that had a restoration requirement.

242-491, COC Request, Taxiway E Construction (Stantec) (Lawrence Municipal Airport)
Randy Christiansen, Stantec Consulting Services, is here on behalf of Lawrence Municipal Airport to
request a COC for Taxiway E which goes along the East side of the cross wind runway. This Notice
of Intent was filed in response to an Enforcement Action by the Conservation Commission and was
an after the fact filing for the construction of Taxiway E whereupon it was discovered that there was
impact to the Wetlands due to sedimentation from the Taxiway construction. As part of the Orders of
Conditions restoration was required. Upon review of the project file no mention of an inspection of
the restoration site was noted therefore a site inspection was done by Mr. Christiansen and the
Administrator and at that time a delineation was done. In the area of where the restoration was
supposed to be approximately 1245 square feet. Upon inspection of that area a restoration of 1335
feet was found. The planting plan called for 200 cattails. The site it is now covered in native shrubs
and ground cover.
Mr. Lynch asks if due to its location to the runway if the area will be subject to pruning and cutting.
Mr. Christiansen states that -between.
The Administrator states that only one item is left outstanding which is the letter from the engineering
stating that the work was in substantial Compliance with the Order of Conditions.
The Commission agree that a letter is not needed for this filing also because Mr. Rich is not the
design engineer.
A motion to close and issue a Certificate of Compliance for 242-231 is made by Ms. Feltovic
seconded by Mr. Mabon.

as-built plan because it reflected the existing condition of Taxiway B post construction. The plan
showed full compliance on the taxiway location but the drainage was found to slightly off.
The Administrator states that this project does have the Engineers letter of Certification.

The Administrator gives a brief background on this project request. The Administrator states that after
the project was approved by the Conservation Commission it required a land disturbance permit from

which were mainly for the roof drainage have over flows. Both lots have additional stormwater
structures on them mostly LID type to handle single family house drainage.

The Administrator states that they are both outside the 100 foot in the front of the homes.
