Definitions: 4.1 Acceptance: All Contracts require proper acceptance of the described goods or services by the Town of North Andover. Proper acceptance shall be understood to include inspection of goods and certification of acceptable performance for services by authorized representatives of the Town to insure that the goods or services are complete and are as specified in the Contract. The Contract documents are complementary, and what is called for by any one shall be as binding as if called for by all. The term includes one who furnished material worked to a special design according to the Drawings or Specifications of this work, but does not include one who merely furnishes material not so worked. 4.7 Work: The services or materials contracted for, or both. 5. Term of Contract and Time for Performance: This Contract shall be fully performed by the Contractor in accordance with the provisions of the Contract Documents on or before December 31, 2011, unless extended pursuant to a provision for extension contained in the Contract documents at the sole discretion of the Town, and not subject to assent by the Contractor, and subject to the availability and appropriation of funds as certified by the Town Accountant. PROJECT: Air Duct Cleaning at Stevens Memorial Library. September 14, 2011 Ray, Thank you for this opportunity to submit a proposal for the duct cleaning at Stevens Memorial Library. Mighty Duct has over 19 years of indoor air quality services with the following certifications: ➢ Air Systems Cleaning Specialist with the NATIONAL AIR DUCT CLEANERS ASSOCIATION (NADCA) ➢ Ventilation System Mold Remediator (NADCA) ➢ Certified Ventilation System Inspector (NADCA) ➢ HVAC Technician Certification (EPA) #6420M ➢ Member of the Better Business Bureau and the Milford Chamber of Commerce. ➢ We are fully insured. Mighty Duct uses the most advanced Air Duct Cleaning System available. All air duct cleaning methods will be per NADCA ACR2006 guidelines. To ensure complete source removal, and for future cleaning or inspections, access panels will be installed throughout the systems in accordance with NADCA standard 05-1997 Installation of Service Openings. The electric negitave air machines we use are (NEPA) filtered which have a three stage filter mechanism with a two stage blower system that operates at 5000cfm to capture 99.97% of the dirt and debris from the duct system. The gas powered vacs operate at 7,000 cfm and would be placed outside the building and is not NEPA filtered. At least one of these machines will be attached to the duct system at all times during the cleaning. This will insure that No contaminated air will be released in to the work space as the work is being performed. After each section of duct work is cleaned, we visually inspect to insure all cleaning criteria Has been met. After passing inspection, access panels will be installed throughout the systems in accordance with NADCA standard 05-1997 Installation of Service Openings. As a leader in the industry, we use state of the art power equipment including vacuum trucks and or portable equipment with high output air compressors. In addition, we leverage custom made duct brushes to accompany our Source Removal method of air duct cleaning. Source Removal is the term the National Air Duct Cleaners Association uses for the type of cleaning its members practice. In short, it means all dirt and debris is removed from the system. We do not spray any sealers or chemicals into the ductwork as a cleaning method. The value of chemical treatments for air ducts is debatable and the application of products classified as "sanitizers" or "disinfectants" require that the applicators be licensed with the state and that companies carry specific insurance coverage. If any contractors are proposing the application of chemicals in your air ducts you should obtain paperwork for those chemicals that include specific directions for use in air ducts and you should ask to see their license. With our custom duct cleaning equipment, after cleaning the ducts will be visibly clean. The whole duct system, not just the branch lines or the parts you can see will be cleaned thoroughly. Armstrong uses and emphasizes visual verification as the prime method of quality control. Armstrong technicians apply cleaning techniques to ductwork until visual verification ensures that the ducts have been thoroughly cleaned. Our standard operating procedures include cutting openings in the ductwork to connect our power vacuum equipment. We then go to each room and remove the register that is supplying air to that room and run sweeping tools through the duct with the power vacuum pulling at the bottom. The technicians have a full assortment of remote reaching nylon bristle brushing tools and high pressure compressed air snakes at their disposal to accomplish the sweeping activities. The objective is to agitate the duct walls to dislodge clinging debris followed by sweeping of the loose contaminants to the power vacuum hose. This is done to all ducts, supply and return air. The main trunk ducts are also swept and vacuumed out. The access openings are then closed with a sheet metal access plate that is screwed in place and sealed with an aluminum contact tape. Since a 2006 re -registration process performed by the USEPA, there are no sanitizers or disinfectants registered for that effect inside of HVAC ducts. Armstrong does not perform chemical cleaning of any kind beyond the use of evaporator coil cleaner on AC coils. Commercial contractors proposing to apply EPA registered chemicals, or unregistered chemicals advertising the ability to kill microorganisms are required by law to hold Pesticides Applicator Licenses and have specific insurance coverages for this activity. All disinfecting chemicals that kill micoorganisms have some degree of toxicity (toxicity is a relative term that always has a context, such as the LD50 rating). Completely non-toxic substances can't kill microorganisms. It should be noted that no antimicrobial products are approved for application on porous materials inside of HVAC systems, such as internal fibrous glass insulation. No antimicrobial products approved by the EPA for use inside of air duct systems have the strength or persistence to "prevent" microbial growth after an application. There may be smoke detectors mounted on the air duct system. None were seen on the walk-through, however. When duct mounted smoke detectors are present there is a high likelihood that air duct cleaning activities will initiate a false alarm. We strongly recommend consulting with the fire alarm service company to determine whether or not duct mounted smoke detectors are present. If there are duct mounted smoke detectors present they should be deactivated prior to the commencement of air duct cleaning services and reactivated after the completion. This proposal does not anticipate, nor does it include costs for performing this service. This project is calculated using the Sheetmetal Worker prevailing wage rate provided by you. That rate, per worker is $66.42 for wages and fringes. We are presuming that this work will have to be scheduled for off -shift work. This service is projected to take 6 full shifts to complete. For efficiency sake working full shifts (as opposed to half shifts) will need to be scheduled. Otherwise, set up and take-down costs will double. Pricing is contingent upon the accuracy of the mechanical drawings provided, upon walk through, if the actual system differs from the drawings, the pricing may be impacted. Armstrong's usual terms of payment are by cash, check, or credit card at the completion of the service provided. Exceptions to these terms will need to be negotiated prior to the scheduling of the service. This agreement between the Customer and Armstrong shall be construed and governed according to the laws of the State of New Hampshire. Further, the Customer and Armstrong agree that jurisdiction over the parties shall vest in either the Hillsborough County Superior Court or Manchester (New Hampshire) District Court depending on the amount of damages claimed.
