William Hmurciak, Director of Public Works Heidi Griffin, Community Development Director Lincoln Daley, Town Planner From: Jack Sullivan, Director of Engineering Date: April 20, 2005 Subject: DPW Recommendations Street Layout Meeting — April 25, 2005 The DPW offers the following recommendations for the Street Acceptance and Roadway Acquisition warrant articles for the May 9, 2005 Annual Town Meeting: Article 29, Roadway Acceptances: The DPW offers a favorable recommendation to the Board of Selectmen for roadway acceptance of the following roadways: Coachman's Lane Concord Street Easy Street Highland View Avenue Morningside Lane Russett Lane The Town obtained fee ownership rights in these roadways based on Article 49 of the May 2004 Town Meeting. Now that the Town has ownership of these roadways, we are looking to accept them as Public Ways. Once accepted, I will look to add these roadways to the state inventory of public ways within North Andover to increase our Chapter 90 funding for roadway improvements. -2 - 04/20/05 Article 30, Roadway Acquisition & Acceptance The following roadways receive a favorable recommendation from DPW: Adams Avenue Autran Avenue Bunker Hill Street Douglas Road Glenwood Street Martin Avenue Summit Street These are private ways in which the Town secured funding from past warrant articles to make miscellaneous improvements (utility infrastructure, roadway resurfacing, etc...) to bring the streets to an acceptable Town standard. In the case ofAdams Avenue and Autran Avenue the Town is proposing to install drainage infrastructure and Town Counsel has recommended that the Town must have either obtain an easement along each entire roadway or obtain fee ownership rights in the roadway prior to construction. Therefore, a decision was reached by DPW to acquire these roadways through a taking to avoid a lengthy and costly process of obtaining a grant of easement from each individual property owner. The aforementioned roadways have been laid out by a registered professional land surveyor and all the legal paperwork has been processed. The direct abuttors and mortgage holders to all these roadways have been notified through a certified mailing regarding the taking procedure. Article 31-34, Street Acceptance within the Forest View subdivision Article 31 Anvil Circle Article 32 Amberville Road Article 33 Garnet Circle Article 34 Palomino Drive The aforementioned roadways are part of the Forest View subdivision located off of Route 114. At this time the developer has made the majority of the corrective construction measures and DPW, Planning, and Town Counsel are reviewing the legal paperwork. The developer has stated that all facets of the street acceptance process will be completed prior to Town Meeting. DPW recommends that the Board of Selectmen make their recommendation at Town Meeting. I will provide a follow-up memorandum to the BOS and Planning Board prior to Town Meeting with a final recommendation for this subdivision. It is imperative that applicants, attorneys and engineers review, understand and follow these procedures, especially as to documents required and deadlines, in order to eliminate confusion and delay to all parties. Final approval of the Form C plan does not constitute the laying out or acceptance by the Town of streets within a subdivision, nor entitle the streets to such acceptance. Street acceptances within a subdivision are the financial and legal responsibility of the applicant. A. PROCEDURE SEQUENCE I. After all subdivision improvements have been installed and inspected by the Department of Public Works the applicant shall compile the engineering and legal documents required for street acceptance and shall submit, according to the form and schedule prescribed by the Town Clerk, an Article for the Town Meeting Warrant seeking acceptance of the street by Town Meeting voters. 2. The applicant contacts the Town Clerk's office to find out the deadline for submitting the actual warrant article to ensure their place on the Town Meeting Warrant. A copy of the as -built and layout plans are placed on file with the Town Clerk at the time of submission ofthe warrant article. 3. The applicant should meet with the Town Planner at least 4 months prior to Town Meeting date to review any outstanding issues or missing forms within the subdivision and/or file itself. The applicant shall submit all required documents and materials to the Planning Department (See Section B -Street Acceptance Documentation) and other applicable departments listed below at least 3 months prior to Town Meeting. The applicant sends any legal documentation required (all deeds, easements, conveyance of open space land to the town, certificate signed by the applicant's attorney certifying that all necessary parties have signed all easement instruments, street deeds and open space deeds, etc.) to Town Counsel for review of this documentation, accompanied by a letter explaining what subdivision you are requesting street acceptance on and for Town Counsel to review the enclosed documentation. You must also send a copy to the Staff Engineer at the Public Works Department so they can verify that the deeds and easements match up to those depicted on the as -built plans. Please send a copy of these requests to the Planning Department for both our records and yours. The applicant will be scheduled for a public hearing (prior to Town Meeting) in front of the Board of Selectmen so that they may also make a recommendation to Town Meeting. The applicant can contact the Selectmen's Office to find out when they will be scheduled for their public hearing. 7. Ifthe applicant has received favorable recommendations from DPW, Town Counsel and the Planning Department, the applicant will be placed on the next available Planning Board Meeting (prior to Town Meeting) so that they can receive a recommendation from the Planning Board to be made to Town Meeting. 8. At leasrthirty (30) days prior to Town Meeting, when corrected documents have been required, Town Counsel and the Town Engineer shall complete their final review and file a written report stating approval or disapproval of the documents. 9. The applicant or his representative shall make a motion on the floor of Town Meeting that a vote be taken to accept the subdivision street(s) as provided in the Warrant Article. B. Favorable Action FINANCE COMMITTEE EXPLANATION: Warrant Articles 29 through 36 provide for the 'acceptance' by the Town of certain roadways. Warrant Article 30 provides for the 'acquisition' by the Town of certain roadways. In general, new roads are frequently created by a developer building a subdivision. Those private roads that meet Town standards can be accepted' by the Town from the developer. At that point, the road moves from private ownership to Town ownership. The process of road acceptance includes numer- ous physical and legal requirements and inspections. Once all those requirements are. met, Town Meeting may vote to ac- cept the road for the Town under MGLA, Ch. 82, sec. 23. No appropriation of Town funds is required for the 'acceptance' articles: While 'acceptance' articles apply to those roadways still under the control of a developer, 'acquisition' artides apply to those roadways where the original developer is long gone. For these roadways, the current owner is generally a shell corp) - ration — with no forwarding address. The roadway acquisition articles represent the finishing process of the Unaccepted Roadways Improvement Program ("URIP"). The URIP priori- tizes 'private' roadways, then reconstructs, repaves, installs drainage, etc. in order to meet Town standards. The Town funds the URIP through the Capital Improvements Program. The only practical way, according to Town Counsel, to 'ac- quire' roadways is through an eminent domain taking. The chances of the original developer -corporation demanding compensation are remote (the developer -corporation is cur- rently liable legally for the roadway). As such, no additional appropriation of Town funds is required for 'acquisition' arti- des. Once 'accepted' or 'acquired', the roadway becomes 'public' (.e., Town -owned), and State funds (MGLA. Ch. 90) may be used for paving, repairs, etc. Since State 'Chapter 90 High- way Grants' are based on the number of miles of town roads, each road 'accepted' or .acquired' adds to the Town's share of State aid received, Article 30.
