Taking by the Town recorded with the Essex North Registry of Deeds in Book 1170, Pages 335 and 336, such portion
being shown as "Lot A" on a sketch plan entitled "Central Fire Station High School Property", prepared by Sullivan
Engineering and dated February 7, 2014, is no longer needed for school purposes, and a notice of this determination
shall be given to the Board of Selectmen pursuant to Section 15A of Chapter 40 of the Massachusetts General
Law. Mr. McDevitt seconded the motion. The motion passed 5-0 on a roll call vote, Ms. Burzlaff, Mr. Gross, Mr.

Date: March 6, 2014

Present: Members Burzlaff, Gross, Limpert, McDevitt and Warren. Also present Assistant
Superintendent Gilligan.
Call to Order
At 7:00 pm Chair Limpert called the meeting to order.
Public Comment
There was no public comment.
Superintendent's Report
Assistant Superintendent Gilligan updated the Committee on events in the schools including Read
Across America and the upcoming New England Percussion Championship to be held at NAHS. He
stated that at the next School Committee meeting the Committee would be recognizing middle school
students who worked on the BRC commercial.
Chair Report
Chair Limpert thanked the schools for the Committee's invitations to attend Read Across America
events.
Consent Agenda
Mr. Gross moved to approve as presented the minutes of January 30, 2014. Ms. Warren seconded the
motion. The vote was 5-0 Ms. Burzlaff, Mr. Gross, Mr. Limpert, Mr. McDevitt and Ms. Warren.
Full Day Kindergarten (FDK) Program
Dr. Judy Rogers gave a presentation to the Committee on the proposed full day kindergarten program.
She discussed the FDK grant and criteria, the benefits to students of FDK, the increased expectations of
the curriculum frameworks and the process to be used next year for the transition to FDK. She
reminded the community that kindergarten information night is March 11. In response to questions
from the Committee, Dr. Rogers reviewed the concerns raised by some parents regarding the FDK
program and the options available to parents including the transition year. In response,to a question
from the Committee Dr. Rogers discussed technology use in kindergarten classrooms.
The Committee discussed the need to have a plan should there be a need for additional classroom space
due to enrollment increases.
NAHS Curriculum Overview
Dr. Scuzzarella discussed the work of the high school staff to put together curriculum overviews for each
subject area and essential standards documents for each course. The essential standards documents
include information regarding content standards, grade level/course benchmarks and essential
vocabulary. She stated that the overviews and the essential standards documents will be available for
parents to view on the website in the near future. She discussed the work teachers have done on
creating unit summaries for each course including common assessment information. She stated that
those documents are working documents for the teachers. Dr. Scuzzarella reviewed two sample course
documents.
2"d Reading Increase of Athletics Revolving Account
Ms. Burzlaff moved to approve changes for the FY14 athletic budget as outlined in the School
Committee packet. Mr. Gross seconded the motion. The vote was 5-0 Ms. Burzlaff, Mr. Gross Mr.
Limpert, Mr. McDevitt and Ms. Warren.
2nd Reading — Surplus Land for the Proposed Fire Station
The Committee discussed the Town's plan for a new fire station to be located on school department
land that is no longer needed for school purposes. In response to concerns raised by the Committee,
Chair Limpert stated that Mr. Mealey would serve as the point person to bring to the Town Manager any
concerns or questions the Committee may have as abutters during the design and construction phases.

Educator Hall of Fame
After a discussion regarding concerns about appointing two nominees to the Hall of Fame this year, the
Committee agreed that they should revisit the procedure for Educator Hall of Fame selection process in
the fall, prior to advertising for nominations. The Committee discussed the two outstanding candidates
to the Hall of Fame, Kathy Callagy and Anne Erickson.
Mr. Gross moved to accept the nominations of Kathy Callan and Anne Erickson to the Educator Hall
of Fame. Ms. Warren seconded the motion. The vote was 5-0 Ms. Burzlaff, Mr. Gross, Mr. Limpert,
Mr. McDevitt and Ms. Warren.
The Committee congratulated the nominees.
Multi -Use Trail Proposal
The Committee discussed the Town Planner's multi -use trail proposal. After discussion,,it was agreed
that Mr. Limpert would bring to the next meeting a draft letter of support for the project which
addresses the concerns raised by the Committee regarding signage, any legal fees incurred not being
taken from the school budget and repairs for any damage to school property during the construction of
the trail.
School Committee Goal Mid -Cycle Review
Community Relations
• After discussion the Committee agreed that liaisons would reach out one more time to the PTOs
to offer to attend a meeting if they would like.
• Ms. Burzlaff discussed the School Committee FAQ she is drafting for the website and for
distribution to parents. She noted public comment guidelines and an explanation on why
members do not respond to group emails as examples of the type of information that would be
included in the FAQ document.
• Ms. Burzlaff stated that she will be meeting with the Superintendent soon to go over the survey
results.
Strategic Planning and Financial Management
Mr. McDevitt stated that he would be scheduling a meeting with Mr. Mealey to move forward on this
goal.
Operations
Chair Limpert discussed Mike Grant's outstanding work in technology and stated that the
Superintendent's Advisory Committee will continue to work with Mike.
Governance
Facilities Use - Mr. Gross stated that he continues to meet with Mr. Mealey on this policy.
School Safety - Ms. Warren stated that she will be meeting regarding school safety policy.
Curriculum - Ms. Warren stated that she has had several meetings with Mr. Gilligan regarding the
curriculum policy.
Bullying Policy— policy has been updated
Social media policy — the Committee agreed that it will be difficult to produce a balanced policy and that
the issue requires the focus of the Committee
Public Comment
There was no public comment.
School Committee Comments
In response to a question from the Committee, Mr. Limpert stated that the Superintendent's mid-cycle
evaluation will be on the next agenda but no written documentation is needed from the Committee.
The Committee expressed best wishes to the NAHS wrestlers, DECA team and the robotics team. The
Committee reminded the community that Mr. North Andover is Friday night and the Youth Center event
is Saturday night.

At 9:10 pm Mr. Gross moved to adjourn. Ms. Warren seconded the motion. The vote was 5-0 Ms.

re: PROPOSAL FOR GEOTECHNICAL SERVICES
PROPOSED CENTRAL FIRE STATION
PRESCOTT STREET @ CHICKERING ROAD

UTS is pleased to provide this proposal to complete a geotechnical study at the referenced project.
PROJECT OVERVIEW/ OBJECTIVES OF STUDY
The project site includes a level athletic field. The project will include a new Central Fire Station.
Limited Plans were available at the time of this proposal. Part of the building is to have a full
basement level. Minor grade change is expected given the level site contour.
The purpose of the geotechnical investigation will be to define the nature and character of the
subsurface conditions underlying the proposed building area. This information will be evaluated
with respect to the design and construction of a technically feasible foundation. A Geotechnical
Report will be submitted which provides soil engineering parameters for the structural design of the
foundation system and earthwork considerations. The report will address geotechnical requirements
per the Massachusetts State Building Code. The report will address bearing capacity, settlement,
seismic parameters, groundwater issues, building pad preparation, lateral earth pressure and other
relevant geotechnical issues pertinent to foundation design and construction. We will also review
site conditions for others as part of the proposed storm water management plan.
PROPOSED WORK SCOPE
We propose a subsurface exploration program involving about 3-4 test borings around the new
building. The borings will be advanced to depths of z20-25 ft unless shallow refusal is encountered

or if questionable soils require additional exploration. During advancement of the test borings, soil
samples will be retrieved at 5 ft intervals with a 2 inch diameter split -spoon sampler. Standard
Penetration Tests will be performed at the sampling intervals in general accordance with ASTM
1586. The subsurface exploration program will be directed by an Engineer who will record the
visual classification of soil samples, penetration resistance, groundwater depths, depth to refusal and
other pertinent data on Test Boring Logs.
We will also review and log test pits for site design purposes. We can complete percolation tests or
infiltration tests as required for design. An excavator will be provided by others to dig the holes and
re-establish the turf.
Data obtained during the subsurface exploration program will be evaluated with respect to
foundation design considerations and earthwork activities. The results will be provided in a report
which summarizes the exploration program, the subsurface conditions encountered, and our
recommendations for foundation design and construction. The report will include the Test Boring
Logs as well as a plan showing their location.

We will contact your office should cohesive soils (soft clay), peat, loose sand, uncontrolled fill
and/or other concerned soils be encountered which may warrant additional explorations or laboratory
testing for geotechnical evaluation. The cost of such testing is considered to be above and beyond
the quoted budget. Based on our experience in the area, we expect to penetrate such materials for
geotechnical evaluation.
DIG SAFE will be provided by others for the project. UTS can not be responsible for private site
utilities not maintained by DIG SAFE. The property owner should understand this and inform UTS
of any private utilities in this respect. We will review the Existing Conditions Plan with utility
locations if available for the project.
This quote does not include costs for landscape repairs and other incidental damage that may occur
during the drilling operations such as rutted or tracked lawns. We will fill and cold patch all test
holes made in pavement areas and fill and rake all holes in lawn areas. UTS will take all necessary
precautions to minimize site damage during the drilling operations.
This quote does not include increased costs for Prevailing Wage. Prevailing Wage, for the drilling
contractor, will be $700/day.
The quote includes a $300 surcharge for ATV access given the snow covered field. ATV access is
necessary for areas where a truck can not safely travel.
We can complete percolation tests and/or infiltration tests as determined by the Site Engineer. We
can perform tests as time permits (z6 field hours).
We have included costs for a - 15 ft observation well (or piezometer) to be located in the proposed
basement footprint. The well will have a secure road box, bentonite seal, locking expansion plugs,
filter sand, etc. We have also included costs for 2 subsequent visits to monitor the well as
determined by others (presumably a few days after the well installation and during likely ESHGWT).
Our services will be provided in accordance with the attached Terms and Conditions.
SCHEDULE
We could commence work on this project within 4-6 days upon receipt of a signed contract. We
expect to submit our Geotechnical Report within 5-8 days thereafter.

computer services, mileage charges, expenses, and time spent traveling in
the interest of work will be assessed in accordance with the attached rate
schedule.
INVOICES: Invoices will be submitted either upon completion of services
or on a monthly basis. Invoices are due and payable within thirty (30) days
after the billing date. If CLIENT objects to all or any portion of an invoice,
CLIENT shall so notify UTS within fourteen (14) calendar days of the
invoice date, identify the cause of disagreement, and pay when due that
portion of the invoice, if any, not in dispute.
SUBSURFACE EXPLORATIONS: CLIENT should be aware that some
damage to the terrain, vegetation, structures, or equipment on the site may
occur in the normal course of work. CLIENT will not hold UTS liable for
such damages and will make compensation to UTS if UTS is required to
restore the land to its former condition. UTS will take reasonable
precautions to limit damage to the site and to any subterranean structures.
UTS will not be held liable for damages or injury, including consequential
damages such as the loss of use or profit, resulting from interference with
subterranean structures which are not called to our attention or are
incorrectly located on plans furnished by CLIENT or others in connection
with the work to be performed.
HOLDING HARMLESS: CLIENT understands that "holding UTS
harmless" as referred to above and elsewhere in these Terms and Conditions,
would, among other thing require CLIENT to compensate UTS for any time
spent or expenses incurred by UTS in defense of any claim for which
CLIENT has agreed to indemnify UTS, in accordance with UTS's prevailing
fee schedule and expense reimbursement policy relative to recovery of direct
project costs.
SAMPLES: Soil, rock, and water samples obtained from the site which
have not been consumed in testing become the property of the CLIENT,
once the project account has been paid in full. Such samples will be held for
thirty (30) days after payment, and will be disposed of thereafter unless
delivery to CLIENT is requested in writing.
DOCUMENTS All documents generated by UTS in the course of rendering
service to CLIENT will remain the property of UTS. CLIENT agrees that
all documents and/or plans provided by UTS in connection with services
rendered will be utilized solely by CLIENT for their intended purpose. UTS
will not intentionally divulge documents or information regarding its
services to parties other than CLIENT unless requested in writing by
CLIENT.
CLIENT also agrees to compensate UTS for the additional cost of working
to protect employees' and the public's health and safety. In addition,
CLIENT waives any claim against UTS, and agrees to defend, indemnify
and save UTS harmless from any claim or liability for injury or loss arising
from UTS's discovery of unanticipated hazardous materials or suspected
hazardous materials
DISCOVERY OF UNANTICIPATED CONDITIONS OR HAZARDOUS
MATERIALS: UTS and CLIENT agree that the discovery of unanticipated
conditions or hazardous materials constitutes a changed condition
mandating a renegotiation of the scope of work or termination of services.
Further with regards to hazardous materials, it may be necessary for UTS
to take immediate measures to protect health and safety. UTS agrees to
notify CLIENT as soon as practically possible should unanticipated
hazardous materials or suspected hazardous materials be encountered. In the
event the project site is not owned by CLIENT, CLIENT recognizes that it
is CLIENT'S responsibility to inform the property owner of the discovery of
unanticipated hazardous materials or suspected hazardous materials.
FAILURE TO ENCOUNTER HAZARDOUS MATERIALS: CLIENT
understands that UTS's failure to discover hazardous materials through
appropriate and mutually agreed- upon sampling techniques does not
guarantee that hazardous materials do not exist at the site. Accordingly,
CLIENT waives any claim against UTS, and agrees to defend, indemnify
and save UTS harmless from any claims or liability for injury or loss arising
from UTS's failure to detect the presence of hazardous materials through
techniques commonly employed for the purpose.
MONITORING OF CONSTRUCTION: CLIENT agrees to retain
ENGINEER to monitor construction, and UTS agrees to assign to the
monitoring function persons qualified to observe and report on the quality
of work performed by contractors, et al. Provision of construction
monitoring by UTS is not insurance, nor does it constitute a warranty or
guarantee of any type. In all cases, contractors, et al., shall retain
responsibility for the quality of their work and for adhering to plans and
specifications. Should CLIENT for any reason not retain UTS to monitor
construction, or should CLIENT unduly restrict UTS's assignment of
personnel to monitor construction, or should UTS for any reason not
perform construction monitoring during the full period of construction, UTS
shall not have the ability to provide a complete service. Should UTS for any
reason not have the ability to perform a complete service, and thus not have
the capability for adequate control of implementation of the complete
engineering function, CLIENT waives any claim against UTS, and agrees to
indemnify, defend and save UTS harmless from any claim or liability for
injury or loss arising from problems during construction that allegedly result
from findings, conclusions, recommendations, plans or specifications
developed by UTS.
RESPONSIBILITY TO NOTIFY UTS: CLIENT herebywarrants that, ifhe
knows or has any reason to assume or suspect that hazardous materials may
exist at the project site, has done his best to inform UTS of such known or
suspected hazardous materials' type, quantity and location.
LIMITATION OF LIABILITY: CLIENT agrees to limit UTS's liability to
CLIENT and all third parties arising from UTS's professional acts, errors or
omissions, such that the total aggregate liability of UTS to all those named
shall not exceed $50,000 or UTS's total fee for the services rendered on this
project, whichever is greater. If CLIENT wishes to discuss higher limits and
the charges involved, he should speak with UTS. CLIENT further agrees to
require of the contractor and his subcontractors an identical limitation of
UTS's liability for damages suffered by the contractor or the subcontractors
arising from UTS's professional acts, errors or omissions. Neither the
contractor nor any of his subcontractors assumes any liability for damages
to others which may arise on account of UTS's professional acts, errors or
omissions, except as otherwise stipulated herein.
WARRANTY: UTS strives to perform professional services in accordance
with generally accepted engineering practices.

In accordance with Massachusetts General Law c. 149, 2713, a true and accurate record
must be kept of all persons employed on the public works project for which the enclosed rates
have been provided. A Payroll Form has been printed on the reverse of this page and includes all
the information required to be kept by law. Every contractor or subcontractor is required to keep
these records and preserve them for a period of three years from the date of completion of the
contract.
In addition, every contractor and subcontractor is required to submit a copy of their
weekly payroll records to the awarding authority. This is required to be done on a weekly basis.
Once collected, the awarding authority is also required to preserve those records for three years.
In addition, each such contractor, subcontractor, or public body shall furnish to the

Brett Donham and Chris Logan, Donham & Sweeney Architects, and Brian DeFilippis, PMA
Consultants, presented preliminary site plan options for the proposed new fire station. These
plans are preliminary and there is not yet a preferred option. These site plan options were
completed using a survey that was done when the High School was being constructed. The
Town has commissioned a site survey plan. There are a series of steps that will have to take
place over the next several months for the lot presented to be created as a parcel of land and
for it to be deeded back to the Town for municipal use as opposed to its' current standing as
allowed for school purpose use. The design for each option has the apparatus exiting onto
Chickering Road and returning via Prescott Street. The building presented is a two story
building housing offices and firefighters' quarters with bays attached for the apparatus. The
bays for the apparatus are "thru-drive" so there will not be any need to back-up into the bays.
Employees and the public will enter from Prescott Street and exit onto Prescott Street. A Zoning
Analysis, dated December 30, 2013, was reviewed. Brett stated that this analysis was vetted
with Jerry Brown in draft form and the 30 December document reflects his comments and
agreement.
J. Hughes: There is a drainage swale that runs parallel to Chickering Road located between the
lot line and Chickering Road. This swale has wetland vegetation. The Commission would be
interested in knowing where it drains to. Also, there appears to be wetland vegetation on the
adjacent lot. It would be up to the lot owner to allow the Conservation Department to look at
it.
G. Willis: Advised that DOT should be contacted to determine if there is preclusion for distance
from an intersection for a new curb cut. The emergency access way that currently runs from
the High School to Prescott Street is proposed to now stop at the exit driveway onto Chickering
Road. This access way is currently used by students that use the cross walk at the Prescott
Street/Chickering Road intersection as well as the students that are dropped off/ picked up on
Prescott Street. There is no sidewalk along Prescott Street or Chickering Road.

A. Maylor: Suggested a walkway within the site would be a better option than having people
drop off/pick up in front of the proposed Fire Station. Parents may be coming into the parking
lot to drop off. A connecting path to the emergency strip for those walking from the crosswalk
or being dropped off by a parent should be explored.
B. Leathe: A municipal building in the Residential 2 Zoning District requires a Special Permit
from the Zoning Board of Appeals (ZBA).
J. Tymon: This project will require a Site Plan Review Special Permit from the Planning Board.
The Planning Board will look at stormwater management design, lighting, landscaping,
architectural renditions and elevations, pedestrian access, traffic and parking. The ZBA Special
Permit should come first. A Traffic Impact and Analysis Study will likely not be required.
EJ Foulds: Also expressed concern about the number of students that currently use the
emergency access path as a walkway to and from Prescott Street before and after school. An
alternative walkway should be considered so that these students are not walking along
Chickering Road. Expressed that Rt. 125 can get very busy at times and it is often used as an
alternative commuting route when there is an accident on a nearby highway. There should be
some type of linked signalization between the apparatus and the traffic lights at the
intersection.
S. Sawyer: Health will be involved at a later stage.
A. Melnikas: Has had preliminary discussion related to the fire alarm design. Requested that
the design group determine how much of a variance would be required to have a pitched roof
as opposed to a flat roof on the two story building that houses the firefighters and offices.
Once that number is calculated a determination as the whether a variance should be applied
for can be made.
R. Santilli: The funding for construction will be requested at the Annual Town Meeting.

At the SPECIAL TOWN MEETING held Monday evening June 15, at 8:00 P.M., the follow-
ing was voted:
ARTICLE IA. VOTED that $400,000.00 is appropriated for acquiring, by purchase, em-
inent domain or otherwise, for school purposes, the following described parcels of
land, which are a part of the area described by the Article:
Description of land in North Andover, Massachusetts, to be acquired from the es-
tate of heirs of Marion P. Rockwell: Beginning at a point in the easterly line of
Chickering Road at land now or formerly of Caroline S. Rogers; thence running
northerly by said easterly line of Chickering Road 190 feet more or less to a•point
in the southerly line of Prescott Street; thence turning and running easterly by
said southerly line of Prescott Street 160 feet more or less to a point which is
200 feet from the intersection of the said southerly line of Prescott Street with
the westerly line of Osgood Street; thence turning and running southerly by land
of said heirs or estate of Marion P. Rockwell 770 feet more or less to a point in
a stone wall at land of Caroline S. Rogers which point is 402.4 feet from the inter-
section of this wall and the westerly line of Osgood Street; thence turning and run-
ning westerly as the wall stands and by said land of Caroline S. Rogers 200 feet
more or less to a point; thence turning and running northerly in part by a stone
wall and by said land of Caroline S. Rogers 648 feet more or less to the easterly
line of Chickering Road and point of beginning. Containing 3.83 acres more or less.

S. Rogers: Beginning at a point in the easterly line of Chickering Road at land of
Marion P. Rockwell; thence running southerly in part by a stone wall and by said

ning easterly as the wall stands and by said land of Marion P. Rockwell 200 feet to
a point; thence turning and running southwesterly 700 feet more or less to a point
in a ditch; thence turning and running southerly in part by said ditch 700 feet
more or less to a point; thence turning and running southwesterly 220 feet more or

Murray Howe et ux at land of Caroline S. Rogers said point being 422 feet north-
westerly of the westerly line of Osgood Street; thence running southwesterly 580
feet more or less by said land of A. Murray Howe et ux to a point in the northeast-
erly line of the New England Power Company right of way said point being r00 feet
more or less northwesterly of the westerly line of Osgood Street as measured along
said northeasterly -line of the New England Power Company right of way; thence turn-
ing a running northwesterly by the said northeasterly line of the New England Power
Company right of way 400 feet more or less to a point at land of Caroline S. Rogers;
thence,turning and running easterly as the wall stands and by said land of Caroline
S. Rogers 653 feet more or less to the point of beginning. Containing 2.25 acres
more or less.
Description of land in North Andover,°Massachusetts, to be acquired from New
England Power Company. Beginning at a point in the easterly line of Chickering
Road at land of Caroline S. Rogers; thence running southeasterly by said land of
Caroline S. Rogers and land of A. Murray Howe et ux 1470 feet more or less to a
point in the westerly line of Osgood Street; thence turning and running southerly
by said westerly line of Osgood Street 87.38 feet more or less to land of J. P.
Stevens Company, Inc., thence turning and running northwesterly.by land of J. P.
Stevens Company, Inc., and land of the Village Land Company and by a line parallel
with and 82.5 feet southwesterly from the first mentioned course 1460 feet more or
less to a point in the easterly line of Chickering Road; thence turning and running
northerly by said easterly line of Chickering Road 96.16 feet more or less to a
point at land of Caroline S. Rogers and point of beginning. Containing 2.79 acres
more or less.
Description of land in North Andover, Massachusetts, to be acquired from the
Village Land Company. Beginning at a point in the easterly line of Chickering Road
at land of the New England Power Company; thence running southeasterly by said land
of New England Power Company 590 feet more or less to land of J. P. Stevens Company,
Inc., thence turning and running southwesterly by said land of J. P. Stevens Comp-
any, Inc., and by land of the Town of North Andover and by a portion of the north-
erly end of Wayne Street 362 feet more or less to a point at land of Mangano
Realty Trust; thence turning and running westerly by said land of Mangano Realty
Trust 276.18 feet more or less to a point in the easterly line of Chickering Road,
thence turning and running northerly by the said easterly line of Chickering Road
460 feet more or less to land of the New England Power Company and point of begin-
ning. Containing 3.80 acres more or less.
and that to raise this appropriation the Treasurer, with the approval of the Se-
lectmen, is authorized to borrow $400,000.00 under Chapter 645 of the Acts of 1948
as amended; and that the Board of Selectmen is authorized to take all action neces-
sary to acquire such land by purchase, eminent domain or otherwise. The vote:
AFFIRMATIVE 481. NEGATIVE 234. A two -third majority.
ARTICLE 16 and 1C. Stricken from the Warrant.
ARTICLE 2. VOTED that $6,500,000.00 is appropriated for constructing and origin-
ally equipping and furnishing a new high school building; that to raise this ap-
propriation the Treasurer, with the approval of the Selectmen, is authorized to
borrow $6,500,000.00 under Chapter 645 of the Acts of 1948 as amended; and that
the School Building Committee is quthorized to take all action necessary to carry
out this vote.
The vote: AFFIRMATIVE 691. NEGATIVE. 268. A two -third majority.
ARTICLE 3. VOTED to ADOPT the Article.

ARTICLE 6. VOTED that Section 12A of Article IV of the Town's General By -Laws be
amended to read as follows:

s Section 4.9 IN PROFESSIONAL OFFICE DISTRICTS: Buildings for use as Medical Offic
Dental Offices, Legal Offices, Banking Facilities, Real Estate Offices, Insurance
Offices, Financial Offices, Business Offices, Governmental Offices, Medical Clini
Laboratory or Professional Offices, and by adding the following new section.
Section 6.72 Any yard space or area required to be kept open and unbuilt upon on
•such lot may, nevertheless, be used for off-street automobile parking, if otherwi
lawful, except that a green strip not less than ten (10) feet wide on which to gr
grass, bushes, flowers or trees shall be maintained open and green unbuilt on, un
paved and not parked on, all along each side of rear property line of such lot
wherever it abuts land residentially zone. There shall be• provided three parking
spaces per 1000 square feet of net floor area (excluding storage area.) and by
adding the following new Section 7.6 In Professional Office Districts there
shall be provided on each lot an open yard space of not less than one hundred (10
feet depth all along the frontage and fifty (50) feet along the rear and each sid
property line of such lot, except as may be permitted otherwise (but only as to
front yards and side yards) by the Board of Appeals, on petition of the property
{ owner concerned, after a public hearing thereon, with due notice given. and by
adding the following new section: 8.6 In Professional Office Districts no build
' ing shall exceed sixty (60) feet in height.
The amendments to the Zoning By -Laws set forth above were adopted by the Meeting
by a vote of AFFIRMATIVE 212 1NEGATIVE 93.
ARTICLE 73. To amend Section 22 of the Building By -Law entitled "Permit Fees" by
{ striking therefrom Section 22 and inserting in its place the following:
"Permit Fees -- Section 22: Based upon estimated costs of construction, the perm
fees shall be as follows: $3.00 per thousand on estimated costs of construction
with a minimum fee of $6.00 per permit. Building permit fees shall not be re-
quired for municipally -owned buildings or structures. Estimated costs shall b
3� based on $15.00 per square foot." Petition of the Building Code Committee.
VOTED TO ADOPT the article.
ARTICLE 74. To amend Section 11 of the Building By -Law entitled "Building Departm
by striking therefrom said Section 11 and inserting in its place the following:
"Building Department - Section 11: The Selectmen shall annually in April, appoin
a Building Inspector and an Assistant Building Inspector, each of whom shall hold
office for the term of one year or until such time as his successor is appointed
and qualified. The Selectmen shall have the power to discharge either inspectc
for failure to perform his duties, and to fill any vacancy in either office.
Petition of the Building Code Committee. VOTED TO ADOPT the article.
ARTICLE 75. To see if the Town will vote to recommend to the school committee in
accordance with Section 6A of Chapter 71 and Section 6 of Chapter 76 of the Genet
Laws of the Commonwealth of Massachusetts as amended April 27, 1970 that it waive
the payment of tuition for students who are members of the North Andover ABC
Program. Petition of Jonathan Griggs and others. VOTED TO ADOPT the article.
ARTICLE 76. To see if the Town will vote to clarify its action under Article lA c
the Warrant for the Special Town Meeting of June 15, 1970, by voting to authorize
and direct the Selectmen to acquire for school purposes, by purchase, eminent do-
main proceedings, or otherwise, the five parcels of land designated as "areas of
taking" on Plan No. 6279, recorded with North Essex Deeds, they being substiantia
{ identical with the five parcels designated by the vote of the Town under said
Article 1A, and to ratify and affirm all actions heretofore taken by the SeleCtme
in proceeding with the authority vested in them by said prior vote, as hereby
clarified, and also to ratify and affirm all other parts of said prior vote.
Petition of the School Committee and the School Building Committee. It was VOTE
unanimously to ADOPT the article.
ARTICLE 77. To see if the Town will vote to raise and appropriate the sum of $63C
to be expended under the direction of the North Andover School Committee for the
purpose of providing payment for services rendered, or to be rendered, by the
{ Greater Lawrence Mental Health Center, for or in behalf of some of the children c

Site Analysis for potential development along Site Frontage
Mr. Santilli,
On March 1, 2013 I conducted a site walk of the Stevens Estate to determine the feasibility of development
along the site frontage of Osgood Street. The majority of the snow cover had melted so I was able to
determine site features such as flowing water bodies, swamp areas, and potential wetland resource areas.
In conjunction with the site walk, I also researched USGS maps, MassGIS aerials, and the Town of North
Andover GIS data. The majority of the site falls within the Lake Cochickewick Watershed. A potential
perennial stream runs along the majority of the Route 125 site frontage ranging 200-300 feet off of the travel
way. The stream may be perennial based on the USGS map showing this stream in "blue". Any work within
200 feet of a perennial stream requires a wetland permit and for this site there would be a 100 foot "No Touch
Zone" from the edge of the stream. Additionally, the local Watershed Regulations have a Conservation zone
of 75 feet from all wetlands which can not be disturbed.
The area from the "Gate House" at the site entrance to the Stevens Estate running northerly along the site
frontage is predominately wetlands ranging from the Right of Way to the stream. There is very little upland

Merrimack Engineering in January of 1995 approximately 250 feet northerly of the Osgood Street/Chadwick
Road intersection that could potentially accommodate a 62' x 90' building with 14 off-street parking spaces. l
reviewed the plan by Merrimack Engineering and it appears that the proposed development could be located
entirely outside the 100 foot inner riparian buffer zone to the stream (this is critical since 0-100 feet from a
perennial stream is a "no disturbance" zone). Proposed Site Work can be permitted within the 100 to 200 foot
Riverfront buffer area thru the local Conservation Commission with conditions.
In order to further evaluate the area referenced by Merrimack Engineering a botanist would need to delineate
the stream bank and the bordering vegetated wetlands. This delineation would need to be survey located and
mapped on a plan to frilly determine site constraints (environmental buffers). At a minimum, this area is
within the Watershed Protection District and it would appear that zoning relief may be needed to perform
work within 75 feet of a wetland (75 feet is the Conservation Zone under the Watershed Regulations which is
basically a "No Touch" zone).

Mr. Santilli,
On March 1, 2013 I conducted a site walk of the Stevens Estate to determine the feasibility of development
along the site frontage of Osgood Street. The majority of the snow cover had melted so I was able to
determine site features such as flowing water bodies, swamp areas, and potential wetland resource areas.
In conjunction with the site walk, I also researched USGS maps, MassGIS aerials, and the Town of North
Andover GIS data. The majority of the site falls within the Lake Coehickewick Watershed. A potential
perennial stream runs along the majority of the Route 125 site frontage ranging 200-300 feet off of the travel
way. The stream may be perennial based on the USGS map showing this stream in "blue". Any work within
200 feet of a perennial stream requires a wetland permit and for this site there would be a 100 foot "No Touch
Zone" from the edge of the stream. Additionally, the local Watershed Regulations have a Conservation zone
of 75 feet from all wetlands which can not be disturbed.
The area from the "Gate House" at the site entrance to the Stevens Estate running northerly along the site
frontage is predominately wetlands ranging from the Right of Way to the stream. There is very little upland
area for potential development. The limited upland area is further comprised by restrictive buffers ("No
Touch Zones") as referenced above.
Therefore, the only area along the Stevens Estate frontage which could be explored for development is south
of the site entrance. There is an area of approximately 220 feet of street frontage with a depth of 450 feet
which could be further explored.

This map also highlights the various environmental features referenced above.

Phase: Concept Plans for Town Meeting Vote
February 22, 2013
This is a proposal for additional professional services
associated with advancing the New Fire Station HQ project for
Town Meeting action.
The process is based on sequential steps, shown in the table
below for the conceptual plan design and presentation. The
purpose of this task is to create updated and more detailed
concept plans for a revised Fire Station HQ at the previously
proposed site at the north end of the High School property,
and an optional site on the Stevens Estate property. The
conceptual plans will show buildings and site improvements
using a graphics program that allows multiple views for
presentation. Confirmation of the preferred alternative may
be determined after the initial public process and Town
Meeting vote. These concepts will be used to determine if
there are reasonable alternatives for the new facility.
Engineering and legal issues will be described by the Town
staff during the task of confirmation of the facility program
for consideration in the conceptual plan development and will
not be otherwise included in the scope of these services.
The process assumes that the Town staff will be available to
review questions and provide direction, and where necessary,
confirmation and approval by the Town's Board of Selectmen.
