F INTEROFFICE MEMORANDUM TO: Mark Rees DATE: Town Manager FROM: Ray Santilli Assistant Town Manager SUBJ: Hillside Road January 6, 2011 Several months ago, the Town of North Andover was approached by representatives of Property Management of Andover to discuss obtaining the small discontinued strip of Hillside Road adjacent to Route 114. Property Management of Andover serves as Managing Agent for Chestnut Green at the Andover's Office Park. The company wishes to obtain the small strip of land for the purposes of expanding their complex's parking area. The Board of Selectmen directed the Town Manager's office to schedule a meeting with the abutting land owners to solicit feedback and comments prior to deciding what action(s) to take. Letters were sent to the abutters as well as Property Management of Andover to attend a meeting on Tuesday, December 14, 2010 at 6:00 p.m. The only resident attending the meeting was Mr. Edward Hamel of 591 Turnpike Street. Attendees representing Property Management of Andover included Mr. Jim Toscano (President), Mr. Stephen Stapinski (Merrimack Engineering), and Mr. Frank Firicano (Trustee). At the meeting, I explained the legal process the Town would need to follow in order to sell the parcel of land, including Town Meeting approval. I also informed the group of the Site Plan Review Special Permit required from the Planning Board if a commercial entity constructs five or more parking spaces. Property Management of Andover showed the proposed plans for ten additional parking spaces for the area. The plans show a minimum of nine feet from the property line to the closest parking space. They are aware that there is a difference in elevation between the parcel and the existing parking area and are prepared to install a retaining wall. They are also willing to install any type of shrub/tree buffer/barrier. Mr. Hamel's property would be most affected by any changes to the parcel of Hillside Road. He commented that he is greatly concerned about the noise that would emanate from car doors slamming throughout the day. He states that the bedrooms of his home face the parcel in question. He also stated that he does not want the view from his deck blocked by any buffer/ barrier, etc. He objects to the Town selling the parcel of Hillside Road. At the end of the meeting, Mr. Hamel stated he was placing his property up for sale and asked if Property Management of Andover would be willing to purchase it in order to expand their parking even further. Mr. Toscano responded they might consider it once the property was on the market and based on the asking price. Based on the above information, the Board of Selectmen will need to decide whether they wish to pursue selling or leasing the small discontinued strip of Hillside Road adjacent to Route 114. If the Board of Selectmen votes affirmatively for either option, this office will work with Town Counsel to formally issue an invitation for bid on the parcel. This includes having the parcel appraised for the purpose of creating parking spaces and placing a minimum bid value on the property. Subsequently, an article will be presented at May's Annual Town Meeting for final approval. I-ato - ` .. The purpose of Site Plan Review is to review the impact of such construction on adjacent properties; impact on public services; impact on the environment; and impact on community character. Depending on the project the Planning Board may ask the applicant to address such issues as landscaping, public safety access to buildings, stormwater management and lighting. The Special Permit process involves an application to the Planning Board with application fees, direct notice to abutters and a public hearing, A Site Plan Review Special Permit cannot deny the use of a property but can only address the impacts of that use. I also met with Stephen Stapinski, an engineer hired by the management company. In an initial discussion at a prior meeting, the Board of Selectmen decided to proceed on the request by referring the matter to the Town Manager's office to schedule a meeting with abutters. I have been in contact with representatives of Property Management of Andover that manages the property and have obtained a list of five direct abutters to the parcel. I plan on scheduling the meeting on Tuesday evening December .71n I am seeking some guidance from the Board of Selectmen in terms of the meeting. My initial plan is to first outlining the process to be followed if the Town decides to proceed. The meeting will then be intended for the abutters to express their views, concerns, etc. Should any other Town representatives be invited to attend?
