All are methods officials said al-Qaida's spinoff group in Yemen has considered for plots against the U.S, accord- ing to an American official who spoke on condition of ano- nymity to discuss the details of the guidance. The CIA recently foiled a bomb plot in Yemen in which officials say a suicide bomber was to have detonated an explosive on a U.S.-bound flight. European votes could be felt in US WASHINGTON (AP) — The elections that drove Nicolas Sarkozy out of power in France and left Greece scrambling to build a coalition government pose. a financial threat to the United States that could undermine President Barack Obama's efforts to cast himself as the agent of a U.S. economic revival. . For Obama, the danger is that any economic turmoil unleashed by the French and Greek elections will spill over to the United States, slow the recovery even more and, ulti- mately, further jeopardize his re-election, adding him to the recent roster of politicians, whose careers have been short-circuited by economic anger. At the, same time it has shifted Europe's political bal- ance to the left and in favor of the type of economic growth policies that Obama has advo- cated both for Europe and for the United States. For Mitt Romney, the all - but -certain Republican presi- dential challenger, the results in Europe underscore how deeply economic unease affects politics. They feed his camp's underlying storyline: that Obama's economic poli- cies would not safeguard the United States from a widening European recession. But as a rejection of auster- ity measures, the European elections also present a cau- tionary tale for the type of belt -tightening that Romney and congressional Republicans have embraced. Calif. eyes ban on gay I therapy SACRAMENTO, California (AP) — A first -of -its -kind ban on a controversial form of psy- ghotherapy aimed at making ay people straight faced a key Vote by a group of California Lawmakers. Supporters -say the leg- Eslation, which is before its final committee, is necessary because such treatments are ineffective and harmful. 'This therapy can be danger- ous," said the bill's author Sen. Ted Lieu. He added the treat- ments can "cause extreme depression and guilt" that sometimes leads to suicide. Conservative religious groups emphatically reject that view of sexual orientation therapy and say the California bill would interfere with par- ents' rights to seek appropri- ate psychological care for their children. Miss kidnap -slaying case widens GUNTOWN, Miss. (AP) — The net widened yesterday in the case of a Mississippi man suspected of killing a Tennes- see woman and her teenage daughter and fleeing with her two younger girls as authori- ties. charged his wife and mother in connection with the abduction. As an intense manhunt for Adam Mayes and the two young girls continued, his wife, Teresa Mayes, and mother, Mary Mayes, were arraigned in a Hardeman County, Tenn., courtroom. Teresa Mayes, 30, was charged with especially aggravated kidnapping and Mary Mayes, 65, was charged with conspiracy to commit kidnapping. 11 4 Place a happy ad in this section to wish a special someone a Happy Birthday, Anniversary, Retirement, Thinking of You, Love You or Just Wish Them a Nice Day. On February 1, 2012, Boston Gas Company ("Boston Gas") and Colonial Gas Company ("Colonial Gas"), each d/b/a National Grid (collectively "National Grid" or "Companies") filed a petition with the Department of Public Utili- ties ("Department") for approval of their Revenue Decoupling Adjustment Factors ("RDAF") for the 2012 off-peak period. This filing was made pursuant to Boston Gas Company/Essex Gas Company/Colonial Gas Company, D.P.U. 10-55 (201 0) and the Companies' Revenue Decoupling Adjustment Clause ("RDAC") tariff, M.D.P.U. No. 5. The Department has docketed this petition as D.P.U. 12-11. On April 23, 2012, the Department approved the Companies' RDAF filing, allowing the proposed rate adjust- ments subject to further investigation and reconciliation. Boston Gas Company/Colonial Gas Company, D.P.U. 12-11 (2012). As a result, a typical Boston Gas residential heating (R-3) customer using 29 therms per month during the off-peak period will see a monthly bill increase of $0.13 or 0.34 percent, effective May 1, 2012. Atypical Colonial Gas residential heating (R-3) customer using 27 therms per month during the off-peak period will see a monthly bill increase of $0.38 or 1.08 percent, effective May 1, 2012. In this phase of the proceeding, the Depart- ment will investigate whether the RDAFs currently in effect are consistent with the RDAC tariff and D.P.U. 10-55. The Department will conduct a public hearing to receive comments on June 6, 2012 at 2:00 pm at the Depart- ment's offices, One South Station, 5th Floor, Boston, Massachusetts. The public hearing will be immediately followed by a procedural conference. Any person interested in commenting on this matter may appear at the public hearing or submit written comments to the Department no later than the close of business (5:00 p.m.) on June 6, 2012. Any person -interested in participating in the evidentiary phase of this proceeding must file a written petition for leave to intervene no later than the close of business (5:00 p.m.) on May 22, 2012. 1A petition to intervene must satisfy the timing and substantive requirements of 220 C.M.R. § 1.03. Receipt by the Department, not mail- ing, constitutes filing and determines whether a petition is timely filed. A late -filed petition may be disallowed as untimely, unless good cause is shown for a waiver under 220 C.M.R. § 1.01(4). Pursuant to 220 C.M.R. § 1.03(1), a petition must satisfy the standing requirements of G.L. c. 30A, § 10 to be allowed. All credits must be issued in duplicate within three business days from vendor notification. B. Buy American Provision Grocery vendors must offer, to the maximum extent practicable, domestic commodities or products for use in meals served in each participating School District in compliance with the "Buy American" provision under Section 104(d) of the William F. Goodling Child Nutrition Reauthorization Act of 1998 (Public Law 105-336) which added a new provision, Section 12(n) of the NSLA/National School Lunch Act (42 USC 1760(n), requiring SFAs/Food Service Directors to purchase for their districts domestically grown and processed foods, to the maximum extent practicable. Section 104(d) of the NSLA defines "domestic commodity or product" is one that is produced and processed in the United States substantially using agricultural commodities that are produced in the United States. "Substantially" means that more than half or 51% of the final processed product consists of agricultural commodities that were grown domestically. Two situations which may warrant a waiver to permit purchases of foreign food products include: 1) the product is not produced or manufactured in the U.S. in sufficient and reasonable available quantities of a satisfactory quality; and 2) competitive bids reveal the costs of a U.S. product is significantly higher than the foreign product. It is required by 7 CFR 3016.36(b) (2) to monitor vendor performance to ensure compliance with this "Buy American Provision". Therefore, we ask that all vendors certify that the percentage of U.S. content on all domestic commodities or products bid, to the maximum extent practicable, be "substantially" processed in the U.S. For this purpose, a column will be provided on the Grocery Vendor Bid Form for vendors to add a check mark next to each product bid, which they certify meets this provision. If the item bid does not meet the "Buy American" provision and the vendor feels it may warrant a waiver, please attach the argument for such and any relevant documentation for review. Furthermore, the SFAs/Food Service Directors will be examining all product packaging, as the Nutrition Labeling and Education Act of 1990 mandates that the country of origin for both domestic and imported food products is identified on the product labels. 6. Minimum Criteria Each submission must demonstrate and document that it meets the following minimum criteria: A. Company has been in the business of providing the listed cafeteria food, supplies and services for a minimum of three (3) years. B. Company shall submit references of a minimum of three (3) Massachusetts school districts who are current major customers for the past two (2) years. References must include contact names, telephone number, and a general description of goods purchased. C. Unit prices quoted shall remain firm for the specific period of the contract. Town of North Andover IFB Page 6 of 21 Cafeteria Food, Supplies & Services D. Submission of required statements and forms. 7. Evaluation of Bids Bids will first be examined for their responsiveness to what is requested in this IFB. Responsibility of the bidder will then be ascertained. Finally, the aggregate price for the products offered and installed by each responsive and responsible bidder will be calculated for the period of the proposed contract. The Town is required to award the contract to the lowest responsive responsible bidder. ■ Responsiveness Bidders must completely fill out and submit the bid form and all other required forms. All supplies that are the subject of the bid must meet the minimum standards and specifications set forth including the standards by which the procurement officer will determine acceptability as to quality, workmanship, results of inspections and tests, and suitability for a particular purpose. ■ Responsibility Bidders must demonstrate that they meet the following measures of responsibility. The School Department will not award a contract to any bidder who cannot furnish satisfactory evidence of his ability and experience in this type of work and that he has sufficient plant and capital to enable him to prosecute and furnish the supplies as outlined. The School Department may make such investigations as it deems necessary to determine the above and a bidder shall furnish any information requested in this regard. In the event of a discrepancy between the unit price and the total price, the unit price shall govern. All costs not listed on the bid price sheet will not be considered part of the contract and therefore will not be paid. The North Andover School Department will not be charged fuel surcharges or administrative fees as part of any contract entered into as a result of this IFB. Additionally the North Andover School Department will not be charged late fees unless payment is not made within sixty (60) days of the receipt of invoice. The North Andover School Department is a tax exempt entity so no sales tax will be assessed to any purchases made under this proposed contract. 8. Rule for Award Contract(s) will be awarded on an item -by -item basis to the responsive and responsible bidder(s) offering the lowest price for each item listed. I added in a column for 'Total Price' and reformatted the pages so they are all consistent. I also renumbered the items leaving off any blank lines from the numbering system. Please review and let me know if anything needs to be added/ deleted/changed. There are still some numbers that you need to provide: Item 55 — what is the product/pack size Items 221-224 — product size is 4 oz, what is the pack size Item 241— product size is 3.75 oz, what is the pack size Items 302-303 — what is the product/pack size Items 329-332 — what is the projected annual usage Items 429-434 — what is the projected annual usage Items 546 & 547 — needs clarification or further breakdown Item 604 — product size is 1 oz, what is the pack size We will finalize the IFB by Monday afternoon and it will be ready for publication on Tuesday, May 8th at 11:00a Thanks Ray Santilli Assistant Town Manager Town of North Andover 120 Main Street North Andover, MA 01845 Phone 978.688.9516 Fax 978.688.9556 Email rsantilliCo)townofnorthandover.com Web www.townofnorthandover.com 0 rtOV Ty 4 b Please note the Massachusetts Secretary of State's office has determined that most emails to and from municipal offices and officials are public records. Do you want to make one award per category or can multiple vendors be awarded various items in each category? For instance, do you want to give the entire 'Baking Products' award to one vendor or can one vendor get some items and other vendors get other items. 2. What does the symbol # mean? 3. When you list pack size as '4/1 gallon' and then list annual usage as '5', does that mean a total of 5 gallons or 20 gallons? Similarly, when you list for bottled water pack size as'24/20oz' and annual usage as '600', is that really a total of 14,400 20oz bottles of water? 4. In the 'Beverage' category, you twice list both 'Sports Drinks — 24/20oz' and 'Sports Drinks— 24/12oz'. Reason? 5. Item 99 — Clorox Disinfecting Wipes: how many wipes in each pack? 6. Item 115 — Stainless Steel Polish: what is the bottle/can size? 7. Item 121— Ground Beef, 80/20: what does the total of 45 for the year mean? 8. Item 135 — Fully Cooked CN: are those chicken nuggets? What does the total of 500 for the year mean? 9. Item 144 — Chicken tenders: what does total of 30 for the year mean? 10. Why do you have bottles of water both in 'Beverage' (items 56-58) and also in 'Groceries' (items 301- 305)? 11. Items 338-341— no pack size or projected annual quantities listed 12. Items 439-444 — no projected annual quantities listed 13. Item 512 — Foil Sheets: what does the annual total of 10 mean — rolls, cases, etc? 14. Item 555 — Tablecloth: is that a total of 5 tablecloths for the year? 15. Items 556 and 557: are these two items the same or different? What does 'price with commodities' and 'price without commodities' mean? Since you specify an 18" pizza, you should specify the number of slices per pizza (perhaps 8). Does the projected annual total mean 9,000 pizzas for the year? For instance, do you want to give the entire 'Baking Products' award to one vendor or can one vendor get some items and other vendors get other items. I try to catergorize as best as possible, i.e. one vendor awarded all deli meats, etc. However, if bid pricing within a category is too various then I will line item the product and order/award the lowest bidder. The 'Rule of Award' must be specified in the IFB. The language I typically use is "Contract(s) will be awarded on an item - by -item basis to the responsive and responsible bidder(s) offering the lowest price for each item listed." You can also choose to award an entire category to one vendor. Let me know your preference. 2. What does the symbol # mean? Pound 3. 3. When you list pack size as '4/1 gallon' and then list annual usage as '5', does that mean a total of 5 gallons or 20 gallons? Similarly, when you list for bottled water pack size as '24/20oz' and annual usage as '600', is that really a total of 14,400 20oz bottles of water? 5 cases of 4/1 gallons = 20 total Again, 600 24/20 oz cases = 14,400 Unless there is a requirement for a dispensing machine (such as the size of the soda/water bottles), it is easier for the list to simply include the total quantity needed for the year and ask the vendor to provide the pack size. i)'/In the 'Beverage' category, you twice list both 'Sports Drinks — 24/20oz' and 'Sports Drinks — 24/12oz'. AReason? Error, should only be list once Item 99 — Clorox Disinfecting Wipes: how many wipes in each pack? 35 ct Item 115 — Stainless Steel Polish: what is the bottle/can size? 16 Oz Item 121— Ground Beef, 80/20: what does the total of 45 for the year mean? IV 80/20 is the percentage of meat to fat. We would use 45 cases of 80/20 ground beef crl/ ' How many pounds or patties per case? Item 135 — Fully Cooked CN: are those chicken nuggets? What does the total of 500 for the year mean? CN means Child Nutrition The USDA, Child Nutrition (CN) Labeling Program provides food manufacturers the option to include a standardized food crediting statement on their product label. Labels must be authorized by USDA, FNS prior to use and manufacturers must have quality control procedures and inspection oversight that meet the FNS requirements. Products produced in accordance with the CN Labeling Program are generally purchased by foodservice providers for FNS meal programs. What exactly are you asking for in this item? 9. Item 144 — Chicken tenders: what does total of 30 for the year mean? 30 cases per year How many pounds (or whatever unit) in each case? 10. Why do you have bottles of water both in 'Beverage' (items 56-58) and also in 'Groceries' (items 301- 305)? _I have done this in prior years because my grocery vendor will receive and fill out the entire bid packet, while a company such as Coke will bid only the beverage category. It would appear the water should only be listed in the 'Beverage' category. 11. Items 338-341— no pack size or projected annual quantities listed All should read 6/3# (pound) 12. Items 439-444 — no projected annual quantities listed New product, no history on usage Need to estimate a quantity; remember — you are only providing an estimate, there is no requirement to purchase any quantity. 13. Item 512 — Foil Sheets: what does the annual total of 10 mean — rolls, cases, etc? 4/500 14. Item 555 — Tablecloth: is that a total of 5 tablecloths for the year? 25 ct - 5 cases per year 15. Items 556 and 557: are these two items the same or different? What does 'price with commodities' and 'price without commodities' mean? Since you specify an 18" pizza, you should specify the number of slices per pizza (perhaps 8). Does the projected annual total mean 9,000 pizzas for the year? ,One is specifically round (557) while the other gives the vendor opportunity to bid it's own shape. There are two pricing options available because we are offered mozzarella cheese from the USDA commodity program. I can divert a percentage of this cheese from USDA to an approved pizza vendor to decrease unit cost. This will need to be spelled out in the bid. Can you provide me with some language? Thanks again for your help. Let me know if you'd like for me to update the spreadsheets with the needed information.
