Regular Meeting
The BOARD OF APPEALS held its regular meeting on Monday evening, August 12, 1974,
at ~:30 P.M. in the Town Office Meeting Room. The following members were present and
Frank Serio, Jr., Chairman; Alfred E. Frizelle, Vice Chairman; Dr. Eugene A.
Beliveau, Clerk; William N. Salemme and Louis DiFruscio. Alternate members James
Noble and Walter Jamitkowski were also present.
There were 14 people present for the meeting.
HEP~RD CORP. - HEARING:
The clerk read the notice.
Atty. John Willis represented the petitioner. Mr. Willis noted that this is not
a request for a special gravel permit but just a request for a renewal~permit. The
request was made public by the BOARD to advise the persons in the area. Mr. Willis
stated that the petitioner has a substantial financial involvement for the use of this
~and for a gravel pit and the permit has been renewed since ~70'. The petitioner has
no interest in expanding any operation there, however these boulders cannot be trucked
out and can't be buried. They thought an inherent part of the gravel pit was to
remove these and they would have a right to a crusher to process this stone. The
petitioner has no desire to expand the operation in anyway and he came before this
BOARD with clean hands, said Mr. Willis. If this BOARD says further that the use of a
crusher in the area expands the use of the permit as granted, then the petitioner will
not use it. One alternative is to dig large holes and bury the boulders. Atty. Willis
stated that they are here to renew the permit within its original periphery of ~pera-
tions. It is not a new hearing on an initial permit.
Dr. Beliveau stated that he thought they were waiting for an opinion from the BOARD
as to whether they can operate a stone crusher or not, or do they want to forget about
the stone crusher? John Willis says, if it creates such aa annoymace to the neighbors
then they don't want to do this. They came to find an alternate solution to the pro-
blem.
Mr. Serio asked, how much longer does his client intend to operate this gravel pit?
It depends on what he is allowed to do, stated Mr. Will~s. He offered a solution which
was to let Mr. Valente operate for about4 years and clean everything up. Dr. Beliveau
asked Mr. Valente if he had an address of a stone crusher which was operating somewhere
specifically. The one he had was right in the middle of Logan Airport. He was also
asked how much time it takes to bring it in and take it out. The reply was that it can
be set up in 2 days. The leas~ ~umber of days ~sfinanoially feasible to operate the
crusher is 4 months and they probably wouldn't be able to get one in there until the
late fall.
OPPOSITION:
John Murphy, Harry Thomas, John Sevigny, Norman Tardie and John Wylie all of Boxford St.
spoke in opposition. The neighbors and abutters complained about the noise, large
trucks on a narrow roadway which is dangerous to all the small children in the area,
no fence around the property, etc.
The Chairman read the letters from the Planning Board and the Building Inspector.
Anthony Campagna asked the BOARD what they will do step by step.

A motion was made by Dr. Beliveau to take the matter under advisement and allow
Hereford Corp. to continue thei~ present operation for 30 days. Mr. DiFruscio
seconded the motion and Nembers Serio, Beliveau, DiFruscio and Frizelle voted in the
affirmative and Mr. Salemme voted in the negative.
SONERVILLEPETITION:
Dr. Beliveau made a motion to GRANT the variance under Sec. 6.1 and 6.2 of the
Zoning By-Law with the stipulation that it be used only for the construction of a
single-family home. Mr. DiFruscio seconded and the vote was unanimous.
DIMAURO PETITION:
Mr. DiF~as~o made a motion to GRANT the variance under Sec. 6.1, 6.2 and Table 2
of the Zoning By-Law with the condition that a single-family residence b~ constructed
on the property. Dr. Beliveau seconded the motion and the vote was unanimous.
Fred Arraj asked questions pertaining to the zoning laws %o get his facts straight
and Mr. Serio advisedhim that he has the right to appeal.
NOREN REALTY:
Both bond and permit have expired on the above.
}dr. Serio directed the secretary to set up a file with all bonds we have in existence,
recording information as to name, when they e~ire and in what amount and to advise the
BOARD 60 days prior to expiration.
RO~RT WATSON:
The secretary is to call Town Counsel and request him to review the letter on
Watson dated May 14, 1974.
MISCELLANEOUS 5~TTERS:
The Advisory Board's letter was read pertaining to their elections.
The BOARD has no objection to the secretary also doing some work forthe Conserva-
tion Commission.
The meeting adjourned at 9:30 P.M.
