Regular Meeting
The BOARD C~ APFEAL$ held its regular meeting on Monday evening, January 13, 1~75,
at 7.'30 P.M. in the To~n Office Meeting Room. The ffollowing members were present and
voting~ Frank Serio, Jr., 0~airman; Alfred E. Frizelle, Vice-Chairman; Dr. Eugene A.
Beliveau, Clerk; and William N. Salemme.

The new set of plans were received by the BOAED and showed, as stipulated, the 100 ft.
front setback.
~r. Adams had requested Being on the Agenda Re his Earth Removal operation, but did not
attend the meeting.
These were presented to the BOARD by William N. Saleratus. His letter dated January 13,
1975 w~s rea~l by Ohairm~n Serio. The BOARD and 0harles Foster went over the ,correctiens
and updatings from the original by-law. Basically, the way this new law proposes 'to
handle things is, anyone who applies is allowed to do so up to ~0 cu. FAa,. On a general
permit an operation is allowed up to 40 acres. The initial permit will allow 5 acres
and the permit will not be re-issued ann~lly. Once the operator works the 5 acres and
restores it, then he may come in for the permit for the nex~t 5 acres. Ne must conform to
the operating standards. Anything above th~s has to have the signature of the Chairman
of the ~oard of Appeals. There was controversy over this - the members felt that it
pro~bly should be the whole Board of Appeals rather than just the Chairman. Much dis-
cussion evolved over Bec. 5.1 (5). Mr. Frizelle cited a case on this which could prove
it invalid. The members of the Earth Removal Committee stated that their intent is not
to go retroactive to a pit already being operated before this by-law was enacted. Mr.
Foster thinks this section should be re-worded. The BOARD felt there should be some time
limit on an inactive pit. BOAI~D to make comments and submit to the Committee before the
Planning Board meeting on January 20, 1975. There were 3 major questions: 1 ) how long
the permit should run; 2) planting of trees; 3) how to handle the existing permits.
NOREN ~F~ALTY: Send a letter to see if they will renew their bond.
Mr. Lincoln ~iles, thickening Rd., has prospective tenants on the proposed building. He
desires to erect a medical building now, and wants to know if the BOARD would mind if he
varies the face of the building. Mr, Serio advised him ~o let us know what it entails
and come ~efore the ~D. There will only be one building ~nstead of two.
Dr. Patterson - razing of garages Much discussion took place regarding the proposal from
Arnold ~lislrary to Frank Serio which was that there would be a covenant running with the
land stating that the garage would be razed if and when one or the other of the lots are
sold. A motion was made by Mr. S~lemme that in view of the circumstances, with no petition
before us and as a matter of discussion, if the existing garage should have to stay it
should be presented at a hearing. The covenant as proposed is not acceptable, and the
matter should be referred back to Town Counsel for action. Mr. Frizelle seconded and
the vote was unanimous.
