I. CALL TO ORDER
The meeting was called to order at 7:07 p.m.
11, PUBLIC HEARINGS
Ill, APPROVAL OF MINUTES
A. March 24,2.011 Minutes to be presented for signature—The minutes were reviewed and signed by the
Clerk. All were in favor.
IV, OLD BUSINESS
A. 115 Sherwood Drive—continuation to review items previously requested by the Board of Health of
Mr.Canellakis,homeowner,regarding the septic system at his property.
Mr.Canellakis was present and distributed copies of information regarding his septic system. Ms. Sawyer
reviewed a Title 5 report that was submitted this evening, and it looks okay. Mr.Canellakis states that this
is his third time appearing before the Board. His goal is to provide a playroom within the existing footprint
of the home, in the basement. Mr. Canellakis states that he was advised that he needed to upgrade the
septic system. He provided the Title 5 and a statement of cost to bring the system tip to code in terms of
the local regulations. He requests a deed restriction on the property that will limit the home to no more
than 4 bedrooms. Additional rooms will not be allowed without modification to the septic system.
Ms. Sawyer stated that a document needs to be submitted to pursue the deed restriction if that is what the
Board of Health decides. In the Town of North Andover,other properties have been granted variances due
to physical or other types of constraints,but not financial.
Mr.Fixler stated again to the other Board of Health members that they need to be careful in terms of how
to determine what is considered a hardship, Ms. Sawyer stated that most people upgrade their septic
systems because most people do not want a deed restriction on their property,as it is considered a detriment
to the future sale of the property, and a hindrance to future homeowners. The system at 115 Sherwood
Drive was initially installed in 2002.
Motion:
Mr.McCarthy made a motion to accept the deed restriction to limiting the house to a 4 bedroom
house. Mr.Pease seconded the motion. Mr.Fixter was opposed. The majority were in favor.
Mr. Canollakis's engineer will submit a formal copy of the Title 5 Report to the Health Department. Mr.
Canellakis was told that lie needs to work out the form and details of the deed restriction with the Health
Department staff.

Mr,Thomson distributed a plan designed by Green Seal Environmental,Inc.It was noted that Sheet 2
contains the layout of"Existing Conditions-Interior"and Sheet 4 contains the layout of"Existing
Processing Line Layout."
The letter addressed to Gregory C. Wirsen,MSC of Green Seal Environmental, Inc. from Dale T.
Raczynski,P.E.,Principal of Epsilon Associates,Inc. addresses the"Moving of the Cyclone and Fabric
Filter outdoors o1TBK,North Andovoc" The opinion stated im that the hmgmnxe planned 1vhemoved
outdoors will have potential emissions below lqpyufPM and is therefore mdeoubuimu|x(loss than | ton per
year)increase in emissions. Therefore, it should not require a plan approval from MassDEP

Regional Office signed by James B.Belsky,Permit Chief, Bureau oFWaste Prevention,addressed mMr.
William Thompson,fTBI, Inc.re: "Notification of Pcou1t Exemption Application Form BWP AQO I -
Limited Plan Application-Transmittal Number: W155089 which stated that"no plan application is needed
for the proposal described theruiu."
Mr.Thomson described the process of moving the above unit to the outdoors, and the general operation of
the equipment and the assembly line. Outside,they will heremoving the existing asphalt and replacing b

Mr.Thomson provided w short video that was played for the Board of Health members and staff toshow

Dr. Trowbridge stated that lie did not see this information until tonight,as Mr.Thomson did not submit it
beforehand. Mr. Thomson stated that the DEP will complete the full review,and will be looking for any

Dr.Trowbridge asked about the noise factor, Mr. Thomson stated that moving tile unit outside will reduce
the noise inside. The current unit outside is ruiming at 75 horsepower. The new unit will operate at only
15 horsepower.
Dr.Trowbridge asked about the wall which was identified as jersey barriers.It was noted that the barriers
are very close to the entry and exit area for the drop off trucks, Mr. Thomson explained that the concrete
pad will go between bin one and bin two. The grey box will move over to the left. The til-fieline for the
work is projected to be completed and working by this summer. \
The primary reason for these changes to the facility is to increase the amount of the recyclable rate.
Presently,these little pieces of wood are going out as disposable,and the new equipment,using the optical
sorter will be able to blow it out of the general waste and sort it for recycling. The new equipment is
projected to generate a success rate of a about 95%. This will be the first facility in the United States to do
this.
Dr.Trowbridge noted that the Green Seat sent in the current rates for recycling,and TBI is meeting the
requirements as previously specified, It was also noted that the TBI facility has one of the highest
recycling recovery rates anywhere. If items that can be recycled end up being disposed of, there are huge
disposal fees. With the new equipment,TBI will be able to recover approximately 35%of additional
recycling and increase efficiency of the operation,

This item was withdrawn;however, information provided by Mr. Breen was provided to the Board of
Health members for review at his request.
C. Northeast Mosquito Control District—the new Director of the District,Jack Card, and Staff
Entomologist,Esteban Cuebas-Incle,Pbl)will be present to discuss the 2011 mosquito
management plan for North Andover, and any new information available. Health representatives
from file North Andover Public Schools and Brooks School will also be in attendance to ask
questions.
The new Director of the Northeast Mosquito Control District,Jack Card,introduced himself to the Board of
Health members. Mr. Card stated that he and his staff are planning to implement a recycling program for
old tires. Old,unused tires are perfect breeding habitats for the types of mosquitoes that the mosquito
control district is targeting for eradication.
If tile Town of North Andover is interested,his group can collect tip to 250 tires per Town. In about
another month,there won't be a lot of time to pull tires out, as they will start monitoring and treating areas
where the mosquitoes breed. The cost is approximately$4.00 per tire. Al this point in time,they would
need the Town to coordinate drop,off coordination to have them taken by his group for recycling.
It was suggested that as DPW workers travel around Town that they note where unused tires are located,
and notifies the Mosquito Control District,then that would be the start of a system for notification and
disposing of tires. Tile cost of the tire recycling program would be borne by the current fee that is paid to
the Mosquito Control District,
Last year,there was an issue of West Nile Virus(WN✓)down near the DPW building. There is still an
issue in that area with beaver dams,which causes stagnant water and results in the breeding and hatching of

mosquitoes, From behind the fitness area and bank on Chickering Road,to the edge of the DPW towards
the condominiums(Millpond)and Stevens Pond,there are four beaver dams,
Dams ftoi ►the DPW to Osgood Street(near the access to the high school),will hold water at a certain
level. As spring progresses and the vegetation blooms,there may be more breeding in that area as well.
Ms. Sawyer noted that the current management of beaver dams,which utilizes various methods of control.
This includes using water flow devices or trapping. If there is a request for trapping,those permits are
issued through the Board of Health. If there is another request,such as installing a water flow device,
permits are handled through the Conservation Department,,
Ms.Sawyer noted that Mike Callahan of Beaver Solutions would be a good contact to follow tip with
regard to beaver dams and resulting issues, Mr. Card notes that a flow device would be helpful if the whole
dam cannot be removed.
Ms. Sawyer stated that the approved elevation of beaver dams should be detennined. Once the vegetation
comes tip, it blockages are formed,and access is more difficult. Of note,if the dams are not breached,it
makes it difficult for the fish to travel as well. The upper section of the DPW is of the most concern.
Ms.Sawyer will contact Mike Callahan to see if he can come and view the beaver,dam issues. There was a
story in the paper last year about the beavers near Route 114 who found the water flow devices and blocked
it tip.
Mr.Card stated that the spray exemption requests will be entered into the truck spray system fit the event
that this treatment will need to take place. When the MCD receives a request,they have to physically go to
the site and have it plugged into the laptop. With regard to marking out an area, it is large,or a corner lot,
the homeowner needs to mark the boundaries and where the corners are. Legally,the homeowner is the
one responsible for marking their own property. Homeowners may use a pie plate or something around the
house,such as a little flag.
There were 10 requests for non-spraying this year, and there were 105 last year. The deadline was April I"
for homeowners to request,in exemption for mosquito spraying. If a resident requests to opt out of the plan
this season, it is tip to the Board of Health members to make the decision to allow them to,but a deadline is
put into place to allow the MCD a reasonable amount of time to mark out property boundaries,so that
should be considered.
Each homeowner is responsible for following tip on the issues that are of concern to them, and last minute
requests should not be taken lightly out of consideration and reasonableness for all that are involved, In the
interest of public health,many residents objected to the spraying because of fear without a rational
understanding of what was going on,
Dr,Trowbridge agreed that eve do not want the chaos of last year. When a property is exempt,the MCD
cannot conduct any treatment,even a catch basin that would require larviciding. Mr.Card notes that
spraying would most likely be done if there is a virus issue,
