HomeMy WebLinkAbout2001-05-24 Board of Health Minutes BOARD OF HEALTH MINUTES May 24, 2001 Gayton Osgood called the meeting to order at 7:10 p.m. MEMBERS PRESENT: Gayton Osgood, Chairman, Francis P. MacMillan, M.D., Member; John Rizza, D.M.D.; Sandra Starr, Health Director; Susan Ford, Health Inspector. HEALTHY COMMUNITIES Ron Beauregard from Healthy Communities appeared at the meeting to be sworn in as deputy. Nancy Smith, also of Healthy Communities, was to be sworn in. On a motion by Dr. Rizza, seconded by Gayton Osgood the Board voted to deputize Nancy Smith and Ron Beauregard as the Board of Health's agents for purposes of tobacco compliance from Healthy Communities. HEALTHY COMMUNITIES SURVEY AND RECOMMENDATIONS Ron Beauregard gave the Board a copy of the survey that was given to the residents of North Andover as to how they felt about smoking in restaurants and having a 100% smoke free regulation. 43% of the citizens who eat out at restaurants really prefer a smoke free place to dine out in North Andover. 462 surveys came back to Healthy Communities which represents 32% of the total that was sent out which was 1443. 88% already request non-smoking when they go out to eat. People who request a smoking section are 5%. People who prefer 100% smoke-free were 73%. 69% said they would eat out more if there were smoke-free places. 93% would go out more often or the same if there were smoke-free restaurants. Mr. Osgood said there were very few places that still allow smoking in North Andover. Concerning the proposed regulations Ron Beauregard spoke on the private clubs. If a private party were going on it would be up to the party, but if the club was holding a function that was open to the public it would not. Mr. Osgood stated that they told the "99" for instance around 5 years ago that if they had a ventilation system put in they could have smoking in the bar area and now we come along and say sorry we changed our mind. Mr. Osgood believes ultimately everything will become smoke-free, but he is not sure banning every place right now is the right thing to do. The Board will read the proposed regulations and the survey and respond about at the next meeting. The Board has given Healthy Communities permission to publicize the survey. Page Two May 24, 2001 NEW FEE SCHEDULE New fee schedule will be discussed at the next Board meeting. Ms. Starr spoke regarding the septic fees for the consultant stating that these fees need to voted on so that the consultant can begin work. The Board voted to accept the septic fees as written in Ms. Starr's proposal. On a motion by Dr. Rizza, seconded by Dr. MacMillan a motion was made to approve the fees as written with additional administrative fees for the department for the septic. Ms. Starr spoke on the fee structure for the food establishments. Base fee for retail on size of the establishment from$50 - $250. As you look at the different operations the fee would depend on the operations of the establishment. PERSONNEL ANNOUNCEMENTS AND ISSUES Sue Ford will be leaving as the Health Inspector. Karen Springer also left as the Food Consultant. Ms. Starr is putting together another RFP for the Food Consultant. There will be an advertisement going into the newspaper for a Health Inspector. The Board wished Ms. Ford well and expressed sorrow at her leaving the Town. APPROVAL OF MINUTES On a motion by Dr. MacMillan, seconded by Dr. Rizza a motion was made to accept April 26, 2001 minutes. COLONIC IRRIGATION Ms. Starr spoke regarding the issue of colonic irrigation. An establishment licensed for massage in town wanted to be able to do this in her massage establishment. Ms. Starr gave the Board a packet pertaining to colonic irrigation. Dr. MacMillan is against having anyone do this in Town. He believes it poses a high risk for fecal contamination; is very dangerous to do in that a client might have a blockage or other serious problems that Page Three May 24, 2001 could be made worse, and that this is a medical procedure. Dr. MacMillan states this is unacceptable and motioned to ban it outright in massage establishments in North Andover. On a motion by Dr. MacMillan, seconded by Dr. Rizza, the Board voted not to allow colonic irrigation in this Town because of the potential harm it could cause.
