MINUTES
June 24, 1999
Mr. Osgood called the meeting to order at 7:05 p.m.
MEMBERS PRESENT:
Gayton Osgood, Chairman, Francis P. MacMillan, M.D., Member, John S. Rizza,
D.M.D.,Member, and Sandra Starr, Heath Administrator.
MEADOW VIEW POOL
Attorney Carmen Casaro spoke on behalf of the Board of Trustees for Meadow View. A
complaint was filed on June 11, 1999 by some residents of Meadow View stating that
there was not a lifeguard on duty at all times. Attorney Casaro was under the impression
that pool attendants were allowed, but Susan Ford, Health Inspector, informed them that
was not the case. They would like to get clarification on pool openings, unsupervised
swim with passkeys, and if a certified pool operator will be allowed to fill in for
lifeguards in case of emergencies. Mr. Osgood has strong concerns about these matters.
Mr. Osgood would like to take some time and discuss this with Mrs. Ford, other Health
Departments, and others before making any decisions in the matters that were brought up.
Dr. MacMillan would like the Trustees to have a plan in motion to train other people
whom might fill in in CPR and should show the Board documentation. Further
discussion and a decision on these matters will be held at the next meeting on July 22,
1999.
299 DALE STREET - SEPTIC REPAIR VARIANCE
Mr. Les Godin appeared to request a waiver to the requirement for an alternative
technology system in the watershed. He stated that on this site there are no wetlands, and
all the set back requirements are met.
On a motion by Dr. MacMillan, second by Mr. Osgood the motion was granted
under NA Section 6.03 to waive the requirement for alternative technology.
CHRIS ADAMS - 1591 OSGOOD STREET - GREASE TRAP
Mr. Phalen spoke regarding the review Port Engineering made about the grease trap plan
of Mr. Adams. The first item from the review is the grease trap is to be separate from
everything but the kitchen flow. Mr. Osgood spoke of the elevations. Mr. Phalen
believes the elevations are adequate to do the job; he does not have a problem with the
elevations. Mrs. Starr agreed with Mr. Osgood that the Board could have our consultant
go to 1591 Osgood and inspect the work. Mr. Adams implied he called every single
contractor for an estimate on the grease trap installation and not one contractor will do

the job. Mrs. Starr told Mr. Adams she would call a couple of contractors for him. Mr.
Adams became irate at Mr. Osgood's suggestion that partial rental income be put in
escrow to help with paying the contractor. Mr. Adams would like permission from the
Board to rent his place. Dr. MacMillan told Mr. Adams that nothing will be discussed
until a contract has been created by his attorney and signed by him that provides for an
escrow account for funds to install the grease trap, or the grease trap is installed.
1601 SALEM STREET - N.E. ENGINEERING - SEPTIC REPAIR VARIANCE
Ben Osgood, Jr. spoke on the following variances, to allow the use of a poly barrier in
lieu of a concrete wall with a reduction in the slope and length of fill extension, to allow
separation to groundwater to be 3 feet instead of 4 feet, to allow the leach field to be
designed for 330 gallons in lieu of 440 gallons per day. Mrs. Starr stated that no
additions, nor increase in square footage to the house can be done because of the Title V
variance to groundwater, and a deed restriction for additional flow must be filed.
On a motion by Dr. MacMillan, seconded by Dr. Rizza, the variances were granted.
1779 GREAT POND ROAD - HEARING -N.E. ENGINEERING
Mr. Desmond spoke concerning the property. He stated that he, with others, held an
easement for a sewerline to be tied into French Farm. He offered to allow Mr. Sarre,
owner of 1779 Great Pond Road, to use the utility easement, stating that perhaps a 6"
pipe could be installed instead of a 3" pipe. Mr. Desmond suggested this would be an
easier solution than having a substandard septic system. Mr. Gayton Osgood asked
whether something had to be done quickly. Sandra Starr responded that the Sarres are
under a mandate of an extension which the Board of Health gave them in which they
have to have this repaired by June 30, 1999. Ben Osgood, Jr. explained that he feels the
easement was for a specific home on Great Pond Road, not necessarily this home. Mr.
Ben Osgood, Jr. believes they do not have the right to complete the job because there are
too many other people involved. The pipe size is irrelevant; it's the amount of flow.
Ben Osgood, Jr. would like the Board to extend Mr. Sarre's time for an additional 6
months. The parties would like to come back for the next Board meeting, July 22, 1999.
On a motion by Dr. MacMillan, seconded by Dr. Rizza, an additional six-month
extension was granted.

15 FOREST STREET - N.E. ENGINEERING - SEPTIC REPAIR VARIANCES
The following variances were put to the Board:
1. Reduction in distance of leach field to property line from 10 feet to 7 feet
2. Reduction in distance from leach field to wetlands from 100 feet to 70 feet
3. Reduction in leach field sizes 900 square feet to 600 square feet.
4. Use of poly barrier in lieu of concrete wall.
5. Reduction from edge of leach field to well from 100 feet to 53 feet.
The septic system sits in front of the house; there are wetlands in the rear. The abutter is
Mr. & Mrs. Martin. Mrs. Martin brought a letter into the meeting stating they did not
have any objections. The septic system will be built on the side of the house. Mrs. Starr
recommends that the fifth requested variance, distance to a well is denied because there
is a possibility there could be contamination to the other wells in the area. Ben Osgood
stated if the well variance is denied the owner will fill the well.
On a motion by Dr. Rizza, seconded by Dr. MacMillan, the Board agreed to grant
the variance request on all the variances except the fifth variance.
DISCUSSION - MINUTES
Approval of the minutes on May 27, 1999
On a motion by Dr. Rizza, seconded by Dr. MacMillan, the Board approved the
minutes of May 27, 1999.

July 22, 1999
Mr. Osgood called the meeting to order at 7:07 p.m.
MEMBERS PRESENT:
Gayton Osgood, Chairman, John S. Rizza, D.M.D., Member, and Sandra Starr, Heath
Administrator,Ms. Susan Ford, Health Inspector.
MEADOW VIEW POOL
Meadow View would like to get clarification on pool openings, unsupervised swim with
passkeys, and if a certified pool operator will be allowed to fill in for lifeguards in case of
emergencies. Ms. Susan Ford presented recommendations to the Board and Mr. Gayton
Osgood summarized requested variances. Attorney Carmen Casaro spoke on behalf of
the Board of Trustees for Meadow View regarding these issues. Mr. Osgood said we
should void our regulations or enforce them as written. Attorney Casaro stated state
regulations saying it was ok for supervisor.
On a motion by Dr. Rizza, seconded by Mr. Osgood the motion was granted that
during regular hours Meadow View must have lifeguards. Adults only may swim
with pool locked but must have someone outside of pool during off-hours. A
telephone must be available. Specific variances for Meadow View only.
187 SOUTH BRADFORD STREET—WAIVER TO TITLE V INSPECTION
The owner is selling and would like a waiver to a Title V inspection. The septic system
has been pumped and there are no problems with it. Money will be put in escrow. They
will be tying into the sewer as soon as it is available.
On a motion by Dr. Rizza, second by Mr. Osgood the motion for a waiver to Title V
inspection was granted.
492 SALEM STREET—VARIANCE FOR THREE-BEDROOMS
New home, wetlands in the site, the area that is available can only fit a three-bedroom
home. The owner is going to build a three-bedroom home. The owner needs a variance
to the Towns regulations and also a deed restriction.
On a motion by Dr. Rizza, second by Mr. Osgood the variance was granted for a
three-bedroom home.

815 JOHNSON STREET—VARIANCE FOR TWO-BEDROOM
The owner would like to put in an in-law apartment that was an old barn. A second
septic system was put in on the lot. A design was proposed for a two-bedroom home.
The owner needs a variance to the Towns regulations and also a deed restriction.
On a motion by Dr. Rizza, seconded by Mr. Osgood,the variances were granted for
a two-bedroom home.
LOT 23A 24A EQUESTRIAN DRIVE—VARIANCE TO WETLANDS
Les Godin of Merrimack Engineering spoke to the Board and explained the history of the
lot. It was permitted as two separate lots. With the zoning change they became one lot of
8+ acres. The engineer designed a septic system, which was approved by Title V. The
variance they are requesting is that the distance to the wetlands be 57' instead of 100'.
On a motion by Dr. Rizza, seconded by Mr. Osgood,the variance is granted.
CULPEPPERS—SMOKE EATER VARIANCE
Culpeppers is changing hands and the regulation for the previous owner is that they
would have to isolate the smoking from the non-smoking area and petition it. The new
owner who wants to buy the property would like to have that original variance.
On a motion by Dr. Rizza, seconded by Mr. Osgood, the Board agreed to transfer
the variance to the new owner.
DISCUSSION
SCULLY —GREAT POND ROAD—SEWER TIE IN
Mr. Scully never notified the Board regarding the letter that was sent to him for a sewer
tie in. Mr. Scully is required to tie in to the sewer and he has not notified the Health
Department on when he will be doing that or acknowledged any letter. Property is being
built and when Mr. Scully comes in for a sign off on a Form U the Health Department
will not sign off on the Form U.

DISCUSSION
SCULLY— GREAT POND ROAD—SEWER TIE IN
Mr. Scully never contacted the Board regarding the letter that was sent to him for a sewer
tie in. Mr. Scully is required to tie in to the sewer and he has not notified the Health
Department on when he will be doing that or acknowledged any letter. Property is being
developed and when Mr. Scully comes in for a sign off on a Form U the Health
Department has been directed to refuse Form U approval until the sewer tie-in issues for
the existing Scully homes have been dealt with.
JOHNSON STREET— CATS
The owner has 83 cats and neighbors are complaining. Dr. Atwood would like a letter
sent to the owner asking for proof of rabies vaccinations because he is concerned in case
any scratch or bite complaints occur. Ms. Ford is to call the owner and ask if the cats are
vaccinated and if they are not then a discussion on how they can get vaccinated should be
initiated.
LOCAL FOOD REGULATIONS
Discussion of hand contact with food. Senior Aide is to look for violations at local
restaurants. Dr. Rizza is concerned about long hair and food. A discussion ensued about
zero hand contact and there should be a fine for establishments who do not comply.

On a motion by Dr. Rizza, seconded by Mr. Osgood, the Board approved the
minutes of July 22, 1999.
