Labelina Guide for Pack o
What foods require labeling?
All packaged foods offered for retail sale must comply with state and federal labeling regulations.
Packaged foods are foods that are bottled, canned, cartoned, securely bagged or securely wrapped.
Exemptions: Foods in a carry-out 'box or other non-durable container used to protect the food during
service and receipt by the consumer. "Penny Candy" does not require labeling.
What is rewired can the label? (See back for Examples)__
Name: Common or usual name of the product
Ingredients: List of all ingredients
Allergen Foods containing Milk, Fish, Egg, Crustacean, Shellfish, Peanuts, Tree Nuts, Soybeans,
listing: or Wheat must include listing of allergens on label. Two options for listing:
,ption 1: Include the common or usual name of the food source, followed by the name of
the allergen in parentheses. For example: Ingredients: Flour (wheat), whey (milk).
Option 2: After the ingredient statement, place the word, "Contains:"followed by the name
of the food alllergen. For example: Ingredients: Flour, whey. Contains. Wheat, Milk,
Business: Name and address of manufacturer, packager or distributor

Quantity: Net quantity in terms of weight
Dating: Perishable foods must have "sell-by date"
Is this a new regulation?
Labeling laws are a part of the Massachsuetts Food Code, which has been in effect since 2000. Due
to recent increased awareness of food allergens following the 2010 Allergen Awareness Act, The North
Andover Health department is now reminding Food Service establishments of labeling requirements.
What are the alternatives to labeling?
You may remove the food from "retail" sale, or do not "package"the food. Food products that are kept
behind the counter and dispensed to the customer by a staff member do not require labeling. Foods
that are not packaged, such as pastries in a dish covered by a sneeze guard., do not require labeling.
Flaw do I create a label?
Label printing machines are available from many commercial food equipment vendors.
You may also utilize labeling software or create your own labels on a computer.

Agenda items:
Van Otis—Variance to have no ingredient label on the outside seasonal wrapping paper. The

The issue:
The N. Andover Health Department recently finished this guide to assist food establishments in
complying with the State requirements for labeling of their products. The need for this guide
came from the increase in labeling violations found on routine inspections and an steady
emergence and growth of"grab and go" prepared foods that are turning up in the
establishments who normally sell products made to order. In addition, making sure labels are
visible was found to be an issue with some products.
For example; When a customer orders a piece of lasagna; the server removes it from a warmer
or cooler, cuts it, places it in a "to go" container, puts it in a bag and gives it to the customer .
This is allowed without providing the customer any product labeling. However, if that same
piece of lasagna was cut and packaged, but then put in a cooler so the customer can grab it and
bring it to the counter for purchase?This piece of lasagna is now required to have a label with
the minimum standard language.
Solutions:
The inspector has suggested that if the product is relinquished to the customer, by the
server/salesperson, from behind the counter; it generally meets the code, Alternatively, if the
product has been wrapped with seasonal paper, a sticker with the ingredients could be placed
on the exterior of the box.
Faster Street—out of season system installation.
The issue:
The N. Andover installation season is March 1st to Nov. 30th. The basis for stopping installations
is primarily the New England weather. In the winter, snow and ice can mix with the sands and
stone during construction. If that happens, in the spring when the ice melts there will be voids,
which, will create a sink hole. This has been a problem in NA in the past and I have seen, this
happen, first hand. The closing of the season can prove to be a burden to homeowners.
Solutions:
It is all weather dependent. Winter installation is not usually recommended, except in
situations where an active failure may affect the public health or in other situations that the
BON deems acceptable. If the question is; can it be done in decent weather? The answer is yes,
if an installer is reputable and only uses the proper materials and the proper installation,
techniques; septic installations can be done in the winter. In certain circumstances and the
board can consider a variance the Board of Health Wastewater Regulations section 4.2.

Meeting minutes from April 26,May 24,and August 13, of 2012 are to be presented for signature.Larry
Fixler questioned if the minutes were the revised ones that he and Joe McCarthy worked on. Susan Sawyer
confirmed they were. Motion was made by Dr.Trowbridge to approve all minutes,all were in favor and
minutes were approved,
V. OLD BUSINESS
A. Tobacco Sales in Pharmacies—follow-up
Dr, Trowbridge discussed the issue of tobacco sales in pharmacies.Other Massachusetts towns have passed
regulations prohibiting the sales of cigarettes in pharmacies. Letters were sent out to local North Andover
pharmacies asking for a voluntary plan for the goal of minimizing the potential for underage smoking in
youths. We are in contact with a corporate office of one of the pharmacies in town.The corporation will
take action to help achieve the goal of reducing the prominence/visibility in the stores while allowing them
to sell the item. They asked that we don't make any public announcements until they have a plan in place.

ill be a press release sometime next month to discuss this and hopefully move forward with these
goals,
V1. NEW BUSINESS
No new business however Dr.MacMillan asked about truck pennitting season. Susan Sawyer indicated that
Michele Grant has sent out the permits for the truck permitting.Also,the renewal postcards for other
permits that expire Dec. 31"have been sent out, Susan Sawyer explained how there is a link on the front
page of the town's website linking the permit applications. Dr, Trowbridge discussed how in past years a
packet including the permit application was mailed out. To be more cost effective,just postcards are sent
out now to save on postage,and the applications can be accessed on the town's website.The postcards

previous year. Susan Sawyer explained that last year we had a few senior aids helping out with permitting
season. It seemed W work out well since seniors could get u tax break but also keep them connected with
what's going oil imthe town. There are,always new applicants wanting to help out.
Larry Fix|or questioned if any mobile ice cream applications have come in. Susan Sawyer explained that
although they can come in at any time,permitting season for mobile ice crearil trucks usually are in April
since kiw seasonal. We usually see more applications bu the unmnm^r time. /\discussion ensured regarding
ice cream vendor trucks. Susan explained that the state is considering another process specifically for
mobile ice cream vendors in order to protect children.Dr. MacMillan asked the question that this is not
legislation but a regulatory action and through what dept. Susari Sawyer did not want to give the wrong
information but stated she will send the information to the DO}8members.
/\discussion onnucdregarding permitting, Susan Sawyer,brought up the option vf eventually being able to
pay using on-line service. Susan iuinvestigating options for,permitting however there i,u fee involved
with on-line permitting. A discussion ensured regarding online payments.

A. Wrap up oil 2812 mosquito control
Dr. Trowbridge noted that ne have only had one hard freeze this year. Dr. MacMillan stated that two hard
freezes are needed to reach the end uf the mosquito season, Susan Sawyer stated that Jack Card of
Northeast Mosquito control said that residents should be conscious and aware of mosquitoes still around.
Jack Card was very acconlino dating to everyone during the spraying season.A discussion ensued regarding
the spraying. Dr.Trowbridge suggested that Jack Card come in early during the winter tbaeYu discuss next
year, Dr. MacMillan thought i(would hmxgood idea to re-educate the public vo they can understand how
and why we spray. Susan Sawyer said the public had questions oil how trapping sites are chosen and why
not other places.Perhaps Jack Card could come during the off season,possibly im February 20l3.
0r. MacMillan asked if the dates for next years' B0Il meetings were set upyet. Susan Sawyer stated that
we have it oil the calendar to set up. Dr. MacMillan suggested we took at the school schedule so that there
isn't x conflict with scheduling the meetings during school vacation times. �
Dr, Trowbridge asked about the recent Flu Clinic that was field. Susan Sawyer stated the family flu clinic
field last week went very well and was more omoocoxfblthan last year.Last year wn have about l00'150
people,and this year we had about 5O0. Public notification and the electronic sign posted proved very
helpful to draw interested persons.Flu clinic at the High School was supposed to start ut5:00 but people
were lined Lip at 4:40 and didn't stop until we ran out around 7:00,The nurses from the HS were great as
well ao the senior aids. They were helpful and it was x busy day. VVc are hoping to have the same clinic ot

misconception that getting a flu shot causes,the flu.The injectible flu vaccine is not a live virus and does

ensued regarding the flu versus a cold. He encourages everyone to get a flu shot.
Dr. Trowbridge stated lie thought the CDC and WHO suggested that patients over the age of65 also get the
Streptococcus pneunionia vaccine. Dr. MacMillan said it is good for somewhere between 5 to 10 years,,
Susan Sawyer stated that a pneumonia vaccine clinic will be available for seniors soon.

are very slini. It would need to be irjccted by a needle into the spinal co,rd,A discussion ensued regarding

crossed the line between a pharmacy mn(] manufacturer n[drugs.From what lie read, Dr. MacMillan said
the manufacturing company involved in the current meningitis scare didn't use good sterile techniques and
quality control, Tile medicine had no preservatives in it and mold particles were visible.A discussion
ensued about manufacturers and pbarniacies. Standards for compounding pharmacies were discussed. A
compounding pharmacy]o safe and will custom make the product for each patient. Dr.MacMillan stated
that state regulations oversee compounding pharmacies where federal regulations over see tile
manufacturers. A discussion ensued regarding these regulations.
0um side note, Susan Sawyer stated that Dr.Lauren Smith was appointed the interim Department ofPublic
Health Commissioner.
