CALL TO ORDER The meeting was called to order at 7:03 pm.by acting chairman Larry Fixler. II. PLEDGE OF ALLEGIANCE III. PUBLIC HEARINGS IV. APPROVAL OF MINUTES A. September 26,2013 minutes presented for signature. MOTION was made by Mr.McCarthy to approve the minutes,the motion was seconded by Mr. Pease,all were in favor and the minutes were approved. V. OLD BUSINESS VI. NEW BUSINESS VII. COMMUNICATIONS,ANNOUNCEMENTS,AND DISCUSSION A. 2014 BOH Agenda The February 20,2014 meeting date was changed to February 27,2014 due to School vacation. This meeting will be held at the Senior Center due to room availability. B. New Open Meeting Law Guide BOH Members will review the open meeting law guide and will sign and submit the last page. C. Announcing septic consultant for 2014 RFP awarded to Mill River Consulting Mr. Fixler announced that this year's RFP award was given to our current consulting company,Mill River. There were only two submissions for the 2014 RFP award.Mrs. Sawyer stated that there weren't that many submissions due to the fact that if you are the reviewer,you cannot do work in the town. CORRESPONDENCE/NEWSLETTERS A. Discussion of exempting properties from mosquito control activities. Mrs. Sawyer discussed how North East Mosquito Control is working on the town's current needs. NEMMC sent a copy of a press release,which is more of a reminder,to let residents know how they can opt out of spraying if wanted.The state requires this to be done prior to mosquito season. The town clerk's office needs the request by March I`of each year.Mr. McCarthy noted the exclusion deadline, which is March 1st and commented that the exclusion would be effective from April 1"of that year through March 31St of the following year and that if residents opt out,their catch basins will not receive applications to minimize the birth of the mosquitos as well as the spraying during the mosquito season. Mr.McCarthy then read additional information contained in the press release.A discussion then ensued regarding the potential effects of a large number of residents opting out and the effect this would have on the town in controlling the spread of mosquitos. The Health Department will receive a list of residents who do choose to opt out.Mrs. Sawyer asked the Board members when they thought a good time would be for Jack Card,Director of NEMCC to come address the Board regarding the upcoming mosquito season. It was decided that the January 23,2014 BOH meeting might be a good time for him to come and address any questions.A discussion of spraying ensued and Mrs. Sawyer stated there are questions that need to be addressed to NEMCC regarding the spraying of roads around schools.Mrs. Sawyer noted that in 2013,parents were concerned that certain spray nights coincided with night football practices and games.The Board noted that it would be very beneficial for residents to tune in to hear what NEMCC has to say when they come to the Board meeting in January. B. Introduction to consideration of changes to local tobacco regulation. Mr.Fixler stated that Dr.MacMillan and Dr.Trowbridge have drafted changes that they would like to review regarding the current tobacco regulation. It will be discussed at the January 23,2014 BOH meeting.Mrs. Sawyer briefly reviewed the draft.Handouts of the draft were given to the BOH members.The subject then moved on to medical marijuana and a brief discussion ensued regarding dispensing,zoning,etc. Members questioned whether or not a speaker regarding the marijuana law may be a good idea;however Mrs. Sawyer noted that local boards of health do not have jurisdiction over the enforcement of these regulations.Mrs. Sawyer will undertake a further review of this matter. C. Mrs. Sawyer discussed the ongoing permitting season for trash trucks,food establishments,dumpsters and other categories.Mrs. Sawyer commented that permitting is going well with the exception of some missing applications and paperwork.Mrs. Sawyer noted that there have been some issues with mail sent to the Health Department being returned to applicants even though mail is addressed correctly. Ozzy property management is aware of this issue and they are working to correct it with the Post Office. Mrs. Sawyer stated that we are at the end of our septic season.It's been a busy year compared to the last few years especially reviewing applications for building permits for additions.Mrs. Sawyer discussed the new 8 lot subdivision that will be going in off of Bradford Street.The plans have been approved and the septic systems will be installed next year. Mrs. Sawyer stated that new food establishment applications are always coming in.Businesses are constantly opening,closing and renovating. Mr.Fixler led a discussion of the many things that the Health Department is responsible for, including the Department's responsibility;for food establishment permitting and inspections,septic systems,ice skating rinks,housing rental issues,semi-public swimming pools,the local beach,trash trucks routes and permits,dumpsters,tobacco,flu shots and weights and measures among other vital services that the Department is involved with. 11/21/2013 North Andover Board of Health Meeting—Meeting Minutes Page 2 of 3 Note: The Board of Health reserves the right to take items out of order and to discuss and/or vote on items that are not listed on the agenda.
