HomeMy WebLinkAbout2014-05-12 Board of Selectmen Minutes BOARD OF SELECTMEN MINUTES MAY 12, 2014 CALL TO ORDER: Chairman Rosemary Smedile called the meeting to order at 7:00 PM at Town Hall Meeting Room. ATTENDANCE: The following were present: Rosemary Smedile Chairman; Richard Vaillancourt, Clerk; Tracy Watson, Licensing Chairman; Donald Stewart, William Gordon, and Andrew Maylor, Town Manager. PLEDGE OF ALLEGIANCE APPROVAL OF MINUTES: Richard Vaillancourt made a MOTION, seconded by William Gordon, to approve the Open Session Minutes of April 28, 2014 as written. Vote approved 5-0. Richard Vaillancourt made a MOTION, seconded by William Gordon, to release Executive Session Minutes from calendar year 2009 and 2010 as follows: May 4, 2009 (complete) October 5, 2009 (partial) October 19, 2009 (partial) November 18, 2009 (complete) November 17, 2010 (partial) and December 13, 2010 (complete). Vote approved 5-0. COMMUNICATIONS, ANNOUNCEMENTS, AND PUBLIC COMMENT: 3rd Quarter Financial Report Finance Director/Town Accountant Lyne Savage Finance Director/Town Accountant Lyne Savage gave a budget status report for FY14 for revenue and expenses for the 3rd quarter ending March 31, 2014. Property Tax Revenue collections are at 74.3%; Tax Title collections are up by$276,950 compared to last year; Motor Vehicle Excise Tax collections are at 92.6%which is up 20.4% from last year; Meal Tax collections are running at 79.1%; Penalties and Interest are at 174.4% of budget; Ambulance Services collections are on track at 82.4%; Inspection Fees aggregate collections are at 83.3%; Interest Income are at 76.4%. Expenses for all departments are running approximately at 71.6%, with exception of Snow & Ice Budget at a deficit of($569,919.46). The Town identified surpluses within various line items in the operating budget that will be able to absorb this deficit without having to go to Town Meeting to request additional funding. Enterprise Funds: Water revenue collections are at 86.7% of budget with expenditures running at 62.3%. Sewer revenue collections are at 79.3%of budget with expenditures running at 53.2%. All indications are that both water and sewer will end the year with a surplus. Stevens Estate collections are a 78.9% of budget which is down 11%with expenditures running at 78.9% of budget down 5% or$9,448. With the continued hard work of the Division Director there have been several more events booked between now and year end and based on that the Estate should end the year with a small profit. ISO's Public Protection Classification ISO collects information on municipal fire-protection efforts in communities throughout the United States. In each of those communities, ISO analyzes relevant data and then assigns a Public Protection Classification from 10 to 10. Class 1 generally represents superior property fire protection, and Class 10 indicates that the area's fire-suppression program doesn't meet ISO's minimum criteria. The program provides an objective and countrywide standard that helps insurance companies establish appropriate fire insurance premiums for residential and commercial properties. The Town of North Andover's rating improved from a grade of 4 to a grade of 3. Arbor Day Celebration May 14, 2014 The Town of North Andover will celebrate Arbor Day with a Tree planting on May 14, 2014 at the Town Common at 11:00 a.m. John Lavin, senior foreman of the Department of Public Works will be honored who was named Tree Warden of the Year by the Massachusetts &Tree Warden and Foresters Association. Announcements The Annual Town Meeting is next Tuesday, May 20, 2014 at 7:00 p.m.at the High School. Sheep Shearing Festival is on Sunday, May 18, 2014 at the Town Common from 10:00 a.m. to 4:00 p.m. CONSENT ITEMS: Acceptance of Donation $4,414 from Veterans of Foreign Wars, Post 2104 to Police Department for Officer Safety. The VFW Post 2104 has offered to donate $4,414 to the Police Department for officer safety. These funds, raised through the Sean Fountain Memorial Golf Tournament will be for the purchase of high visibility shirts for officers working details/events and for specialty shirts to be worn under the bulletproof vests. Richard Vaillancourt made a MOTION, seconded by Tracy Watson, that the Board of Selectmen accepts the donation from VFW Post 2104 in the amount of$4,414 to the Police Department for officer safety and to send a letter of thanks. Vote approved 5-0. Request by Police Department to install `No Parking or Standing' signs between #275 and #339 Abbott Street for the Sargent Elementary School. Tracy Watson made a MOTION, seconded by William Gordon that the Board of Selectmen approves the request from the Police Department to install `No Parking or Standing' signs on School Days 7:30 AM — 8:30 AM and 2:30 PM —3:30 PM between#275 and #339 Abbott Street.' Vote approved 5-0. Request by North Parish Church Senior Youth Group to use Town Common on Sunday, June 1, 2014 from 4:30 p.m. to 7:00 p.m. for end of year picnic Tracy Watson made a MOTION, seconded by William Gordon that the Board of Selectmen approves the request from the North Parish Church Senior Youth Group to use the Town Common for an end of year picnic on June 1, 2014 from 4:30 p.m. to 7:00 p.m. Vote approved 5-0. Request by North Parish Church Junior Youth Group to use Town Common on Sunday, June 8, 2014 from 10:00 a.m. to 11:30 a.m. for end of year picnic William Gordon made a MOTION, seconded by Tracy Watson that the Board of Selectmen approves the request from the North Parish Church Junior Youth Group to use the Town Common for an end of year picnic on June 8, 2014 from 10:00 a.m. to 11:30 a.m. Vote approved 5-0. Affordable Unit Resale -#4 Harvest Drive, Unit 307 at Oakridge Village The Board of Selectmen has been notified by CHAPA regarding their right of first refusal for the property identified as#4 Harvest Drive, Unit 307 at Oakridge Village. It is recommended that the Board of Selectmen not exercise their right of first refusal. Vote approved 5-0. LICENSING COMMISSIONERS: Richard Vaillancourt made a MOTION, seconded by William Gordon, to open a meeting of the North Andover Licensing Commission. Vote approved 5-0. Maria Serrano of Merrimack College requests seven One-Day Wine Licenses & Malt&three All Alcohol Licenses during the Months of May and June 2014 Richard Vaillancourt made a MOTION, seconded by William Gordon, that the Board of Selectmen acting as Licensing Commissioners approve a One Day Wine & Malt License for Merrimack College on the following dates and times: May 15, from 4:00—9:00 PM at O'Brien Plaza; on May 16, from 5:00—8:00 PM at Cascia Hall; on May 16, from 6:00—9:30 PM at the Rogers Center; on May 17, from 12:30—4:00 PM at the Rogers Center; on May 17, from 3:00—to 8:00 PM at Sakowich Patio; on May 17, from 5:00— 9:30 PM at the Rogers Center; on May 19, from 10:30 AM—3:00 PM at the Rogers Center. Vote approved 5-0. Richard Vaillancourt made a MOTION, seconded by William Gordon, that the Board of Selectmen acting as Licensing Commissioners approves an All Alcohol License at Merrimack College on the following dates and times: June 6, from 5:00 to 1:00 AM at Mack Center Parking lot; on June 7, from 10:30 AM — 2:00 PM at the O'Brien Plaza/Sakowich Parking lot; and on June 7, from 4:00-9:00 PM at the Sakowich Patio Vote approved 5-0. Michael Smolak of Smolak Farms requests two One-Day Wine & Malt Licenses on May 17 and May 31, 2014 from 5:00 PM— 10:00 PM Donald Stewart made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen acting as Licensing Commissioners approves two One Day wine & Malt Licenses for Smolak Farms on May 17, and May 31, from 5:00 PM to 10:00 PM. Vote approved 5-0. Dolly Miller of Psychic Readings, 163 Turnpike Street, requests renewal of Fortune Teller License Donald Stewart made a MOTION, seconded by William Gordon that the Board of Selectmen acting as Licensing Commissioners approves the renewal of a Fortune Teller License for Dolly Miller of Psychic Readings. Vote approved 5-0. William Gordon made a MOTION, seconded by Rosemary Smedile, to close a meeting of the North Andover Licensing Commission. Vote approved 5-0. PUBLIC HEARING: Richard Vaillancourt made a MOTION, seconded by Tracy Watson, to re-open and continue a Public Hearing from April 28, 2014 regarding the Road Layout Hearing — Empire Drive Roll Call vote: William Gordon yes, Donald Stewart yes, Rosemary Smedile yes, Richard Vaillancourt, and Tracy Watson yes. Vote approved 5-0. Town Counsel has reviewed and approved as to form the conveyance documents submitted by the developer's counsel, subject to receipt and approval of final executed documents and updated title certification prior to recording and recommend that the Selectmen approve the layout of Empire Drive. Richard Vaillancourt made a MOTION, seconded by Tracy Watson that the Board of Selectmen recommend acceptance of Empire Drive as a public way, and declare that public necessity and convenience require the aforesaid way to be laid out and do hereby order and direct that said way be laid out as shown on Plan of Land entitled "Street Layout Plan of Empire Drive located in North Andover, MA"; Scale 1 inch =40 feet; prepared by Christiansen & Sergi Professional Engineers Land Surveyors, 160 Summer Street, Haverhill, MA 01830, dated January 1, 2014, and to accept deeds to all related open Board of Selectmen Minutes May 12, 2014 4 space parcels and easements, shown on Plans filed with the Essex County(Northern District) Registry of Deeds of the Land Court on October 16, 2009 as Plan No.18083E and on the above referenced Street Layout Plan. Vote approved 5-0. Tracy Watson made a MOTION, seconded by William Gordon, to close the Public Hearing on the road layout of Empire Drive. Vote approved 5-0. TOWN MANAGER'S REPORT: Capital Project Status Report A status summary of on-going capital projects as well as a milestone timeline through the end of August, 2014. These status summaries will be provided on a monthly basis.
