CALL TO ORDER: Chairman William Gordon called the meeting to order at 7:00 PM at Town Hall
Meeting Room.
ATTENDANCE: The following were present: William F. Gordon Chairman; Richard Vaillancourt, Clerk;
Rosemary Smedile, Licensing Chairman; Donald Stewart, Tracy M. Watson, and Andrew Maylor, Town

APPROVAL OF MINUTES:
Richard Vaillancourt made a MOTION, seconded by Donald Stewart, to approve the Open Session
Minutes of June 24, 2013 as written. Vote approved 5-0.

COMMUNICATIONS, ANNOUNCEMENTS, AND PUBLIC COMMENT:
Certificate of Appreciation to Ozzy Properties for hosting Youth & Recreation Department's Annual
Carnival
The Board of Selectmen recognized Orit Goldstein and Ellen Keller of Ozzy Properties for hosting the
Youth & Recreation Annual Carnival Fundraiser on their property.
Massachusetts Priority Development Areas— North Andover sites
The Executive Office of Housing and Economic Development(EOHED)worked with the Merrimack Valley
Planning Commission to expand the state's regional planning efforts. As a result, two sites were
identified in North Andover for priority development Osgood Landing and Machine Shop Village and two
sites for priority preservation are 9,380 acres by the Parker River headwaters (partially in North Andover)
and 564 acres spread across eight(8) parcels in North Andover.
Borderline Running Club—Summary of 4th of July Road Race
Representatives of the Borderline Running Club informed the Selectmen that they raised over$24,000 for
the Friends of the North Andover Senior Center. Chris Marshall, Director of Borderline thanked all the
officials and town departments that helped make the race a success and run smooth. More than 900
runners participated in the road race and it was a huge success. Selectman William Gordon urged the
club to bring back the 10K race and the North Andover Merchants Association and local businesses
participated as sponsors. It was a great community event for everyone involved.

Selectwoman Rosemary Smedile introduced a new brochure titled "North Andover, A Business &
Community Guide"

National Night Out is scheduled for Tuesday, August 6, 2013, from 6:00 to 8:00 pm. more details to
follow.
Announcement
Significant Sewer work is being done in Town and the project is expected to last 30 days. There will be
detour signs to help with traffic flow.
CONSENT ITEMS:
FYI Year End Budget Transfer per MGL c44, §33B
Lyne Savage, Finance Director/Town Accountant requested the Board approve the year end budget
transfers as presented to cover deficits.

Tracy Watson made a MOTION, seconded by Donald Stewart, that the Board of Selectmen approve the
FY13 year-end budget transfers, as presented, as authorized by MGL c44, §33 B. Vote approved 5-0.
Sara Durkin of the North Andover High School Chorus requests the use of the Town Common for concert
on Thursday, August 1, 2013 from 5:00 p.m. to 9:00 p.m.
Donald Stewart made a MOTION, seconded by Tracy Watson, that the Board of Selectmen approves the
request of the North Andover High School Chorus to use the Town Common for a concert on Thursday,
August 1, 2013 from 5:00 p.m. to 9:00 p.m. Vote approved 5-0.
Sandra Sharke' Der Apkarian of St. Gregory Armenian Church requests to block off Main Street from
Water Street to beginning of St. Michael's Church on Sunday, September 8 2013 from 12:00 noon to
6:00 p.m.
William Gordon made a MOTION, seconded by Tracy Watson that the Board of Selectmen approves the
request of St. Gregory Armenian Church to block off Main Street from Water Street to beginning of St.
Michael's Church on Sunday, September 8, 2013 from 12:00 noon to 6:00 p.m. Vote approved 5-0.
Eli Bailin of Green Stride requests permission to hold "The Earth, Rock, Run" on streets of North Andover
on April 27, 2014, starting and finishing at 1600 Osqood Street.
The run will include both a half marathon and a full marathon on a 13.1 mile course. Mr. Bailin is working
with the Police Department and the MA DOT to coordinate the logistics as the event draws near. All
relevant Town Departments recommend approval.
William Gordon made a MOTION, seconded by Donald Stewart, that the Board of Selectmen approve the
request of Eli Bailin of Greene Stride to hold "The Earth, Rock, Run" on streets of North Andover on April
27, 2014, starting and finishing at 1600 Osgood Street. Vote approved 5-0.
Alexandra Coakley of the North Andover Athletic Association is requesting to hold the "3�d Annual Knights
on the Run" road race on streets in North Andover on October 19, 2013, starting and finishing at the High
School.
The race is held as a fundraiser in support of the High School Athletic Department. All relevant Town
Departments recommend approval.
Tracy Watson made a MOTION, seconded by Donald Stewart that the Board of Selectmen approves the
request of the North Andover Athletic Association to hold the"3rd Annual Knights on the Run" road race
on streets in North Andover on October 19, 2013, starting and finishing at the High School. Vote
approved 5-0.
Request to Dispose of Surplus Equipment— Public Works Department
Per the Town Policy requesting surplus material and equipment, the Director of Public Works Bruce
Thibodeau is requesting to surplus the following DPW vehicles; #68, 2001 Holder Tractor w/plow, Vin
#52400686, 2,947 hours of use; #50, 2003 Jacobsen Mower Vin#2008. These vehicles will be traded for
the new tractor and brush cutter equipment that was approved at the Annual Town Meeting.
Tracy Watson made a MOTION, seconded by Richard Vaillancourt, that the Board of Selectmen
approves the request of Public Works Director Bruce Thibodeau to surplus the 2001 Holder Tractor with
plow and the 2003 Jacobsen Mower per his memo to the Town Manager dated July 9, 2013. Vote
approved 5-0.
Acceptance of Various Donations for Lt. Colonel Harold A. Dushame Memorial
The Board is requested to accept the various donations that have been received to erect a memorial in
memory to Lt. Colonel Harold A. Dushame.

Richard Vaillancourt made a MOTION, seconded by Donald Stewart that the Board of Selectmen hereby
accepts various donations made to the Lt. Colonel Harold A. Dushame Memorial Fund and detailed in the
list included in the agenda packet. Vote approved 5-0.
OLD BUSINESS:
Draft"Rules and Regulations Governing Takeout Food Served by Mobile Food Vendors
Community Development Director Curt Bellavance drafted "Rules and Regulations Governing Takeout
Food Served by Mobile Food Vendors". This was presented to the Board for review and discussion.
Selectmen said the goal of the regulations is to protect local brick and mortar businesses in town.
Business owners Kathy Santoro, Terry Holland, Nadine Levin and residents Rebecca D'Entremont, and
Ellen Mosier gave their opinions of the Food Truck Vendor Regulations.
After a lengthy discussion the Board said there were too many loopholes in the draft and decided to form
a committee that will review the proposed regulations and make recommendations.
Tracy Watson made a MOTION, seconded by William Gordon, to form a committee of 5 or 7 members to
further review the proposed regulations and to make suggestions and recommendations for the final
version to be presented and voted on by the full Board of Selectmen at a future meeting. Vote approved
5-0.
The Committee would consist of Community Development Director Curt Bellavance, Director of the Board
of Health, Selectman Tracy Watson, two business owners, and two residents.
This would be continued at the next meeting on August 12, 2013.
TOWN MANAGER'S REPORT:
Reserve Police Officers
Due to recent vacancies in the Police Department, five Reserve Police Officers have been offered
conditional offers of employment as Permanent Police Officers. The Police Academy is scheduled to
begin in September.
Route 125 Corridor Study
The Town Manager gave the Board a draft of the "Route 125 Corridor Study"This was done by students
at the University of Massachusetts under the direction of John Mullin. The Board was asked to review the
study and there will be a discussion at their next meeting on August 12, 2013.
Police Department Report
Police Chief Paul Gallagher provided a Police Report and Crime Statistics for the month of June.

Re: Van Assistance overview
Our second van broke down at the end of June. We had 12 trips scheduled for July,three of
which we needed both vans. Because of difficulty locating a replacement parts for the van,
we were looking at the possibility of cancelling several of these trips.
On July 17,2013 two trips were scheduled plus two medical transports and we were still
without the necessary transportation. A notice was sent out to other Senior Centers as well as
the Town Department to see if anyone could offer some assistance in transports. A
suggestion was made by the Town Manager to contact Brooks School to see if they had a
vehicle available that we could use for transport.
On July 17th, Brooks Schools provided a 12 passenger handicapped van that was used to
transport our group to a performance at the Stoneham Theater. Because of this gesture we
were able to run our grocery trip and transport two clients to medical appointments.

The Library will have its end-of-the-summer program for children on Wed. , Aug. 21st, and
we would like permission to close the portion of DAVIS STREET next to the Library's clock
tower entrance. Timing for the event is 9 am - 1 pm. (This was done for last summer's
event and it was very helpful. )
This year the children's special visitors are the "Gardening Rocks Mobile Farm" (a
trailer with raised garden beds, chicken coop, etc. ) and the ice cream truck.
Both vehicles would be inside the street barriers, making it a safety zone for the
children and parents visiting the mobile farm and queuing up for their treats.
I have already contacted Chief Gallagher about this request and include his message at
the end of this one.
Please let me know if you have any questions.

time. The Board of Selectmen must approve road closures with the recommendation of Police
& Fire Chiefs. We will recommend and the police will, supply barricades. Do it soon as the
Board meets next Monday.

Attached please find a letter to the Board from Mr. Timothy Eatman, 77 Beverly Street, stating
the reason why he failed to renew his Livery License—Timothy Eatman, One Stop
Transportation—Eatman Limo Services - for the calendar year 2013. The normal renewal time
for 2013 licenses was at the Board's December 17, 2012 meeting. When Mr. Eatman did not
respond to the renewal packet that was mailed to him, a follow up phone call was made to him
on November 27, 2012, at which time he stated he "did not wish to renew."
Due to vacation schedules Mr. Eatman stated he may not be available to appear before the
Board tonight.

Dear Ms. Baton:
Per the letter you have received from the Massachusetts Alcoholic Beverages
Commission(the "ABCC"), a copy of which is also enclosed,Bertucci's Restaurant
Corp. (the "Licensee)has applied for a change of officer and director, and stock transfer
and issuance, relative to their Massachusetts locations, as a result of a change in
ownership in upper-tier entities,. The transaction involves both of the parent company's
restaurant concepts (`Bertucci's" and "2ovens"), and includes over 90 restaurants in ten
states. The transaction will not result in any change to the manager, operation or
physical structure of the individual restaurant in your municipality, other than in the
normal course of business, and the company has endeavored to make sure all manager
changes were heard prior to this application.
With regard to the liquor licenses in Massachusetts,the Licensee submitted the
applications to the ABCC through the"Inverted Approval Process", and the ABCC has
reviewed and investigated the applications and found that the transactions requested are
in compliance with M.G.L. Chapter 138. Per the letter sent by the ABCC,you will not be
required to send back any other forms, documents or information in connection with the
application other than the Form 43 and advertisement from your community. PLEASE
NOTE: public notice via a newspaper advertisement is required, and the ABCC will
need to receive a copy of the advertisement and the approved Form 43 from your
community.

Gentlemen (/ Ladies) -
We would like to request the town's assent to the removal of 7 trees from the town's
right of way in front of our house at the captioned address. These trees represent an
ongoing traffic hazard, and are also now inflicting damage to our property. Attached
please find a series of photos providing some visibility of these issues.
The first is a traffic safety issue. The first photos illustrate how guests to our house
parking on Winter Street have no safe shoulder to park on due to trees. Sadly, the fast-
moving traffic on Winter St. generally cannot see these parked cars until too-close due a
hill & curves on approach. By removing a small set of trees, and moving a large boulder
in the (right of way) shoulder, our guests could safely pull off the roadway to park,
eliminating the hazard for both them & approaching drivers.
The second is a property damage issue. These same trees emerge from the ground on
the edge of our driveway, and the root systems are now large enough to push up the
blacktop, causing surface damage. By removing the trees to fix the traffic issue, we can
also remove offending roots during re-paving to restore our blacktop surface.
The third is also a property safety issue. A different set of four trees are intergrowing
immediately under the utility lines approaching our house from the street. While a more
minor safety issue, we would feel safer if we could remove these at the same time.
We have discussed this removal proposal with the town Conservation Administrator,
who has determined this poses no conservation concerns.
We have discussed this proposal with the town's DPW, who (we believe) has no
concern in principle, but wishes to obtain town assent prior to removal.
We are prepared to remove and dispose of all trees at no cost to the town (at our
expense) using a licensed tree removal service.

NOTICE OF PUBLIC HEARING
In accordance with Massachusetts General Laws (MGL), Chapter 87, Public Shade Tree Law,
Section 3 (Cutting of Public Shade Trees; Hearing; Damages), the Town of North Andover Tree
Warden will hold a Public Hearing regarding an application from National Grid to remove or prune
public shade trees on [Date and time here] at the North Andover Town Hall, 120 Main St, North
Andover, MA. Any person interested or wishing to be heard on this matter should appear at the
time and place designated.
The program included a tree-by-tree hazard assessment of public and private.trees, along the
main three-phase lines which serve the community. The work is recommended to remove hazard
trees and prune for additional clearance in order to reduce tree outage problems affecting large
numbers of customers served by these main lines. National Grid's arborists have identified
twenty seven (27) town-owned trees for removal and four(4)town trees for pruning along the
following roads: Sutton Street, Main Street, Maple Street, Second Street, Waverly Road,
Massachusetts Avenue and Peters Street.
Town trees located within the public way that are designated for removal have been posted with a
notice of public hearing in the field. Trees designated for pruning have been marked with a small
blue ribbon.
A complete list of town trees designated for removal or pruning including information about the
location, size and species of the affected trees and the reason for work proposed, is available
weekdays from the Town Hall, Library and Highway Department during normal business hours.

July saw a decrease in calls for service and motor vehicle traffic.As many of us who live in this town
know,July is a popular month for vacationing and our population seems to diminish significantly.
Our Officers made sure to conduct their vacation home checks and also increased the bike patrols on
Weir Hill,Stevens Pond and the lake where complaints of dog waste have increased. Dozens of
residents were advised by Officers and the Community Service Officer of the town's bylaws of
picking up waste and no swimming in our water supply area.
The Fourth of July brought a record number of participants in the renewed road race this year. Our
Officers managed thousands of runners and spectators as the races went through the Old Center and
out country, Officers were deployed on bikes and at fixed posts to maintain safety and order. Civilian
volunteers were issued green police shirts to assist our staff. The fireworks display and festivities on
the common were closely monitored by our Officers both on foot and on bikes. Our Special Officers
also volunteered at the events and provided a much needed supplement to our force.
Recently the North Andover Police received a call from a concerned citizen at Heritage Green who
observed two suspects stealing tires in the parking lot early one morning.The midnight shift
responded and with the quick actions of our Officers, one suspect was arrested at the scene and the
other was arrested after running from the scene and being spotted by another officer. Both
individuals were charged with Larceny over$250.00 and may be responsible for other similar crimes
in the Merrimack Valley. Investigation is continuing on other suspects regarding recent thefts from
unlocked automobiles.
Our new Reserves Police Officers have begun their Field Training Program. Although they will soon
be entering the Police Academy,they are being trained to supplement the shifts. Openings have been
created.by recently retiring Officers and in order to keep the shifts at preferred staffing. The Reserves
will join the regular Officers on certain shifts.

This month the North Andover Police Department said good-bye to one of the pillars of the
department. Lieutenant John P. Carney was the Operations Division Commander for 24 years and a
Police Officer for over 35 years. He is one of the reasons this department is an incredible
organization that serves the residents of this town with professionalism. Lt. Carney exemplified the
police adage"To serve and protect". We wish him the best in is retirement and know that we have
some very big shoes to fill.
As we loop towards August, our annual National Night Out event will be held on August 6ti,.this
year. Plans and preparation have been underway for the past few months and we expect an even
larger turnout than last year. The coalition of the Fire Department,town departments,North Andover
Merchants and Youth Services should make this event once again a success.
We will also begin our transition back to school in North Andover which starts for teachers on
August 27ttz.Plans are already moving forward to update the schools evacuation and lockdown
policies.We have been meeting the Superintendant and his senior staff as school safety is one of our
utmost priorities.We are having additional Officers trained and certified as School Resource Officers
(SRO) as backups and a nearing retirement.
