Mr. Jay Batson of 733 Winter Street requested the Town's permission to remove 7 trees from the Town's
right of way in front of their house on Winter Street. These trees represent an ongoing safety hazard and
are also now inflicting damage to their property.
Bruce Thibodeau Director of Public Works and John Lavin Tree Arborist reviewed the trees and
recommend the removal of the trees.
Richard Vaillancourt made a MOTION, seconded by Tracy Watson, to close the Public Hearing regarding
the Removal of Public Shade Trees per MGL C87, §3—Judy Batson, 773 Winter Street.

a Public Hearing for the Removal of Public Shade Trees per MGL C87, §3— National Grid.
Roll Call vote: William Gordon yes, Donald Stewart yes, Rosemary Smedile yes, Richard Vaillancourt,
and Tracy Watson yes. Vote approved 5-0.
Chairman recognized Neil Dorman from National Grid
Neil Dorman representing National Grid requested to remove 27 public shade trees and to prune 4 trees
along Sutton St., Main St., Maple St., Second St., Waverly Rd., Mass. Ave. and Peters Street. The work
is recommended to remove hazard trees and prune for additional clearance in order to reduce tree
outage problems affecting large numbers of customers served by these main lines.
National Grid offers the Town to apply for a Grant through the DCR for$2,500 to replace trees which
would replace about 6 or 7 trees.
Board of Selectmen Minutes August 12, 2013 4
David and Mary Moore of 118-120 Second Street asked National Grid to save the tree that is in front of
their house on Second Street. Instead of cutting it down, they suggested cutting off the dead part and
treating the rest of the tree. David Moore offered to treat the tree himself if National Grid would only cut
off the diseased part.
Heather McNeil of 13 Union Street said not to make a hasty decision to cut down the trees and talk about
alternative methods of saving trees.
National Grid's Arborists biggest concern is safety for the community. The trees that were identified to be
cut down are too far gone with disease and could break apart and fall onto buildings, vehicles or
pedestrians.
Bruce Thibodeau Director of Public Works said that he and John Lavin Tree Arborist say the roots are
exposed and the hollow cavity is 11 inches deep and needs to come down.
Richard Vaillancourt made a MOTION, seconded by Donald Stewart, to close the Public Hearing
regarding the Removal of Public Shade Trees per MGL C87, §3— National Grid.
Roll Call vote: William Gordon yes, Donald Stewart yes, Rosemary Smedile yes, Richard Vaillancourt,

Public Hearing
Town of North Andover
Tree Warden
NOTICE OF PUBLIC HEARING
In accordance with Massachusetts General Laws (MGL Chapter 87, Public Shade Tree Law,
Section 3 (Cutting of Public Shade Trees; Hearing; Damages), the Town of North Andover Tree
Warden will hold a Public Hearing regarding an application from Michael Green of Green &
Company regarding the tree removal on the right of way in front of their property on either side
of the entrance to the Saracusa Way subdivision located at 1769 Osgood Street and Bradford
Street. To achieve this sight distance, approximately fifteen (15) trees need to be removed
from the right of way in front of the property on either side of the entrance to the new
subdivision. The line of sight is required for safety reasons. The Hearing will be held on
September 9, 2013, at 7:00 p.m. at the Selectmen's Meeting Room, 2 d Floor, North Andover
Town Hall, 120 Main Street, North Andover, MA 01845. Any person interested or wishing to be
heard on this matter should appear at the time and place designated.
Town trees located within the public way that are designated for removal have been posted with
a notice of public hearing in the field.

Dear Mr. Maylor,
As per our discussion last week, my company is the developer of a 9 lot subdivision located at 1769 Osgood
Street and Bradford Street. The approved subdivision plan, which has been recorded and bonded, includes a
new road which is under construction, and there is a 250' sight distance noted at the Bradford Street
entrance. To achieve this sight distance, we need to remove several trees from the right of way in front of our
property on either side of the entrance to the new subdivision. The line of sight is required for safety
reasons. Any vehicles exiting the new subdivision will need to see approaching vehicles on Bradford Street as
they exit the new roadway, Saracusa Way.
As you have suggested, we are requesting a Public Hearing regarding the tree removal on the right of way in
front of our property needed for the 250' line of sight in both directions. As shown in the photos of the attached
document, this shows the line of sight area and the trees that we are seeking to remove. We would like to be
heard at the next public hearing. We agree to pay the $500.00 charge for the public notice. If required, I would
also request that the Planning Board or its representative be present for the public hearing.
I have 3 attachments included with this email, as follows:
1.) Photo Log of each side of the Roadway Entrance
2.) A Plan shows the entire nine-lot subdivision
3.) Highway Access Plan
Should you have any questions or if I can be of service, please email or call me at 603.765.6515. Thank you for
taking the time to discuss this process with me.
Best Regards,
Michael

Adele,
Michael Green is a developer who has purchased several parcels at 1769 Osgood St. These parcels were approved for a
9 lot subdivision by the Planning Board on September 20, 2011. The plan that was approved shows a cul-de-sac to be
built called 'Saracusa Way" off Bradford St. The plans require that the developer cut down several street trees that are
on Bradford St., on either side of the entrance to the subdivision in order to provide for a 250 ft. "line of sight". The line
of sight is required for safety reasons. Any vehicles exiting the new subdivision will need to see approaching vehicles on
Bradford Street as they exit Saracusa Way.
I have attached two plans: one plan shows the entire nine-lot subdivision and the other plan shows the "Highway
Access Plan" or"Line of Sight Plan"
Michael and I have talked with Bruce T. today and Bruce has told Michael that he will need a public hearing with the BOS
in order to remove the trees required for the "line of sight". Michael will be in touch with you in order to schedule the
public hearing. If you have any questions, let me know today because I am on vacation starting tomorrow. Thanks
Adele.

Ray,
As we discussed, the DPW has reviewed the request, which is a requirement of the Planning Board and while I would
rather not have trees removed we concur with the request because of the site distance issue. Further, the developer
should provide 5 to 10 replacement trees either to be used on his site or to be provided to the DPW to be planted
around Town.

RE: August 2013 Monthly Report
As you can see from viewing the statistics,August brought back an increase of calls for service and bookings as
residents and criminals returned from July vacations. There was a marked increase in arrests and assaults.
Officers were kept busy by the activity, and also preparing for the start of school by increasing selective
enforcements in the area of school crossings and travel ways.
The command staff and School Safety unit met with the all district teachers and administrators at the start of the
teacher's school year on August 27th. The new school safety plan was introduced and was well received. This
new protocol was a review and updating of the policy that was currently in place in schools. The safety team
consisted of representatives from the police command staff, the school resource officers, school administrators,
teachers and our fire department. Meetings were held throughout the summer. Once the policy was drafted,it
was reviewed by members of the NEMLEC School Threat Assessment Response System(STARS)team
members. The purpose was to make sure our"best practices"were current, reasonable, clear and uniform
throughout the district. Our concern was that if a student transfers to another elementary school, or goes on to
the Middle and High schools, the foundation training they receive will remain the same as they matriculate.
Our officers continued to conduct"realistic scenarios"at the schools in August. We look forward to an exciting
and safe school year.
One of this month's notable arrests took place at the Oakridge Condominium complex. Alert residents saw a
suspicious male wandering the halls of the complex and called police. Officers arrived and saw the subject
leaving. They called Middleton as they saw the vehicle leave their jurisdiction and went back to investigate.
While Middleton Police had stopped the vehicle and arrested the operator on unrelated charges, our
investigation revealed some apartments entered and items stolen. After working with Middleton, the operator
was arrested once he was bailed out of Middleton Police custody and a warrant was sought for his passenger.
The two alleged suspects may be responsible for over a dozen burglaries at the condominium complex. This is a
great example of the teamwork between not only two police agencies, but also the police and the residents. Our
Criminal Investigations Division has also sought warrants for several suspects for car thefts, larcenies and
burglaries in North Andover using their forensic expertise.

Our 5h annual National Night Out was our biggest and best to date. We conservatively estimated over 4000
people attended the event and our local businesses gave out information and samples. Our State
Representatives,District Attorney, local officials, and other dignitaries made appearances and presented our
department with State House and Senate Citations for our event and what it stands for. Our Neighborhood
Watch program was increased with more residents signing up and joining the Facebook page. We also
presented an appreciation award to Kenneth Wedge of the DPW for his artwork and tireless work in making
sure the grounds are clean and neat for the event.Retired Lt.John Carney was recognized for his 36 years of
service to the police department. I have also attached a recap of this year's night that our intern has assisted
with. Again,Market Basket provided all the food, drinks and condiments for our barbecue. The barbecue had
the owner/chefs of Joe Fish prepare the food with our officers.
Our five new recruits will start the academy next month at the Reading Police Academy. This past month they
have been working on their own after completing an in-depth Field Training program. They have been assigned
some open shifts thus assisting with staffing. These officers are heading to the police academy with some strong
fundamentals already instilled by their field training officers(FTO's)and the training supervisor,Lieut. Gray.
We believe they make the North Andover Police Department look like the professional department that it is. I
have found these officers to be proactive and dedicated to the community.
I am also pleased to report the recent promotional appointments. The new supervisors being Lieutenant Eric
Foulds to the Operations Division Commander and Sergeants Stephen Diminico and Scott Whittaker to shift
supervisors. At the oath of office event the newly promoted officers and their families commented how
impressed they were of the ceremony before the Board of Selectmen. I look forward to working with these new
supervisors.
